Totally Kickin' Fitness

Review: In February 2014 I signed up for 3 months contract at totally kickin fitness with owner [redacted]. Our agreement was 3 months of unlimited classes for total cash payment of 215$. The owner owes me 140$.

I began class in mid February and on march 26 I sent a text message back to owner requesting she refund me because I would no longer be attending her business. She had cancelled more then 10 classes since I started, the facility was closed on another occasion for no power which she attributed to the facility owner probably not having paid the electric bill. Her workouts much like her text messages are full of gossip of others and excuses. She did not respond to my refund request, instead went on about some new thing in class she would be starting. I have not heard back from her on my money that I am owed nor have I received any refund. I have numerous text messages back and forth between owner and myself that I am willing to share to have this resolved. I would like my 140$ refunded to me ASAP as I am owed. This seems to be an issue that plagues this owner. I have since found multiple reviews on line detailing exactly what I went through.Desired Settlement: I want my 140$ that I am rightfully owed. I want no contact with the owner, so a check would be fine.

Review: I paid in full for a 6 month contract from 4/2012 to 10/2012. The owner text messaged me 10/2012 informing me of the expiration and asked me to come in to renew. I told her that I was not renewing or signing a new contract. My credit card was then charged a monthly fee for the next (5) months including Oct. which I had already paid. I did not notice the charges until late Dec. and immediately contacted the owner. She apologized and said she would remove me from the billing cycle with her 3rd party billing agency, ASF, and refund the charges right away. January came and once again I was charged. I contacted the owner again and she then requested I type up a letter of intent to discontinue service which I signed and emailed to her 1/17/13. My card was expiring at the end of Jan. and much to my surprise I was charged again in Feb. on an expired card. This charge was tacked to my newly generated card. I contacted the owner again to inform her of this. I had no choice, but to cancel my credit card. After several months and countless text messages of desperately trying to obtain my refund, the owner emailed me a refund contract 5/2013 that she would pay me $84.02 each month beginning 6/2013 to 10/2013. After 15 months of excuses, I have only received $204.08 of the $420.10 that was owed. There are several other clients who are trying to obtain refunds as well.Desired Settlement: I would like the balance of $216.02 refunded within the next 30 days. I've attempted a payment plan with the owner more than once to which she completely disregards.
