Review: Touch of Class Fencing (TOCF) owes me $559.50.

I requested TOFC to calculate the cost of replacing a defective gate and moving an existing fence. A TOFC representative surveyed the property and took necessary measurements. A contract was initiated between myself and TOFC on 6/24/2014. Also a surveyors plat of the property was provided to the TOFC representative. This included replacement of a 10' double gate ($850), removal of an existing fence ($291), installation of a new vinyl fence ($1622), and Gothic post caps ($56). Total cost was to be $2819.00. TOFC was to obtain the necessary permit for the work and I paid TOFC a deposit of $1409.50 at contract signing.

Removal of the existing fence was started and several post caps were removed. However, work was stopped when it was determined by TOFC that utility lines had not yet been marked. The existing fence remained in place minus the post caps. After the utility lines were marked TOFC again returned to perform fence installation. However, before work commenced a TOFC installer stated that he didn't believe the fence should be installed because the fence posts would penetrate the storm drain. Work was again stopped. Subsequently I was informed by TOFC that there was an error in obtaining the permit and the planned fence installation could not be completed because of the storm drain. I asked that the gate be installed and that I be refunded the amount over the cost of the gate. The gate was installed on 22 September 2014 and the post caps, previously removed, were replaced. I expected to pay $850 for the gate and that TOFC would cover the cost of the post caps since it was a TOFC error. So Taking $850 from the deposit of $1409.50 leaves TOFC still holding $559.50 of my money which I would like returned.

On 6 November 2014 I received an invoice marked “Paid” showing the original price of $2819.00 minus my deposit of $1409.50 and minus an adjustment of $1409.50 leaving a zero balance. No other explanation was included. Two attempts to contact TOFC by phone were unsuccessful and on 7 November 2014 I sent an e-mail to TOFC requesting a refund of $559.50. As of 24 November 2014 no response has been received.Desired Settlement: Refund $559.50 to me.

Review: I entered into a contract on 5/4/15 to have a fence installed on my residence, within 30 days. To date there's been no installation. I've contacted this business by phone and in person on more than 10 occasions and have been given the run around and lied to. I provided them with the required $3000 deposit and was informed my materials would be ordered and work would be completed. I acquired a permit in June 2014, which expired 6/16/15. [redacted] from this company assured me on 5/4/15, 5/18/15, 6/1/15, and, 6/11/15, that they'd have my fence started before the permit expired and if not, the company would pay the $50 renewal fee. We also requested to have the utility lines identified prior to the fence installation, and were assured by [redacted] that as soon as the guys came to do this, our installation would begin. I was informed 5/26/15, my materials had come in the previous week. To date our yard has not been sprayed for line identification nor has the permit been renewed per Amy at the Permit office. [redacted] stated to me again last week, that he had gotten behind because of the rain, but would start our fence on Friday 6/19/15. I informed him, that the land had still not been sprayed and if my fence had not begun and permit extended at his company's expense, I'd be expecting a full refund of my $3000 deposit. I called and left a message for him on 6/19/15, 6/22/15 and today, I've yet to get a response.Desired Settlement: I would like a full refund of the $3000 deposit for work not initiated or performed as it has been, 50 days, their website says work can be installed and completed usually within 48 hours.
