January ** at 9am before work I checked my car on *** *** ** *** and Old Broadway to see if I needed to move it At 9:26am my vehicle was towed by Tow-arrific and was taken to their lot on *** *** ** *** **, for parking tickets
I went to Department of Finance in Brooklyn, NY, day's later to see how much I owed
I payed the entire amount of $on February * and several day's prior I had a sales hold place on car so it would not be sold I also contact Ford Motor credit because I'm financing my car and wanted to keep them in the loop of current situation
On February *** 2016, I arrived at 5:pm at Tow-arrific with receipt of payment to get car released I also brought my valid Drivers licence, current car insurance from Geico and registrationHours of operation are 9am - 6pm The receptionist told Manager Mike to bring out car At 6:15pm, Mike informed me that he had to boost my car cause it would not start and had to charge me $

On Friday, February **, 2016, the registered owner [RO], *** *** ***, came to pihis vehicle, a Ford Fiesta from our impound yard, right before closing (6pm) accompanied by a newborn babyHe provided valid proof of registration, proof of insurance and drivers licenseUpon retrieving
his vehicle out of the yard, we discovered the car was not starting and needed to either be Towed Out for $+ TAX (+ 3.5% CC Fee if paying via Credit/Debit) or Jump Started for $+ Tax (+ 3.5% CC Fee if paying via Credit/Debit)The RO did not want to pay any fee for either option and called the policeThe police officer arrived to the yard shortly after and asked what *** *** needed to do in order to get his vehicle out of the yardAfter explaining all of the options *** *** had been given to the police officer he explained to the RO he had to decide if he wanted a Jump Start or a Tow Out service and must pay the corresponding fee to get the car out of the yardAt this point, *** *** decided to get a Jump Start, but claimed to have no money on him to pay the feeHe wanted to provide a Credit Card over the phone, but we explained to him we cannot accept any Credit Card over the phone without a signed authorization form and a copy of the card holders I.DAfter another long debate in the freezing cold and after our business hours, *** *** finally had his wife come to the yard to pay for the Jump StartWe did everything we could to help this customer out and get his vehicle to him in a timely fashion, we were aware he had a newborn baby with him and it was a very, very cold nightDespite all of our efforts to try and help *** ***, when the car was finally started and brought up to him he started to complain once more, but about “damage” this time around and then proceeded to call the policeThe RO then started that we “damaged his shifter/transmission by drilling a hole in it ”*** *** refused to take the vehicle at this point and for the second time decided to call the policeThe police arrived to the yard again and tried to mediate but could not get through to him*** *** left the yard without his vehicle by his own choice a little after 9pmWe advised him if he did not come back for his car by 4pm the next day he would start to collect storage at $55/day + TAX (+CC Fee 3.5% if paid Credit/Debit).On Friday, February **, the RO, *** ***, came back to the yard to retrieve his vehicleThe RO called the yard prior to his arrival and was quoted how much it would be to pick it up and without any problems or hesitation *** *** stated he understood and would be in to pisoonWhen he arrived back to the yard on 2/**, he came straight to the window and Nicole (Tow-Arrific’s office manager) started to go over all the fees due on the carThe vehicle would not start up again with just the key so *** *** was informed he needed to have his vehicle towed out rather than Jump Started in order to avoid any chance or suggestion of us adding the additional “damage” to his vehicleDespite agreeing to the fees that were quoted to him over the phone prior to his arrival, the RO stated he did not have enough money on him and would return shortlyUnfortunately, *** *** did not return back to the yard that day nor has he attempted to retrieve the vehicle himself since.As all of this was going on with *** ***, the Lien holder was staying in contact with Nicole in regards to the FiestaOn Tuesday, February **, a representative from the bank called the yard for a quote and updateShe mentioned that this customer is very difficult to work with on her end as well and that is why they are trying to follow the progression of *** ***’s vehicle release and/or pithe car themselves if the RO doesn’t piby the end of the day Friday, February **, Nicole then quoted the fees for the Lien holders, which was days of storage at that pointWhen the vehicle was not pickby *** *** before the end of the business day on Friday, February ** the lien holders proceeded with a Repossession Order and hired a company to tow out the vehicleConsolidated Recovery was the company chosen by the bank and they contacted Nicole on Tuesday, March * for fees and other information on the Ford FiestaSaturday, March *, the hired tow company came to Repo *** ***’s Ford Fiesta from our facility with the “Notice to Release” form from the NYC Department of Finance/Administrative Attorney’s Office stating to release the vehicle to the lien holders rather than the registered ownerThey paid the total fees due for all days of storage collected and the tow outAs per the Notice to Release, both the NY license plates were restrained off of the Fiesta before towing the vehicle to the front for Consolidated

Yesterday I went to pick up my impounded vehicle at *** ** *** *** *** *** ** *** (address different from the one listed on this complaint)Because my vehicle isn't currently registered the order from the Administrative Attorney of the City of New York states my license plates are to be removed and my vehicle is to be towed away from Towarrific by a licensed tow truck operatorIt is the policy of Towarrific to charge a towing fee to have the vehicle towed to the front gate because it isn't to be drivenI paid this fee of $plus taxInstead of Towarrific towing my vehicle from the parking spot that it was in to the front gate it was driven there by a staff memberI was charged for a service that wasn't provided to meThere are sings all over stating the lot is under hour surveillance so it will clearly show that the vehicle didn't get hooked up to the tow truck that I provided until after it was off the property of Towarrific

On Friday, February *, 2016, I, the registered owner [RO], *** ***, was at Tow-arriffic at 5:10pm , not right before closing (6pm) to pimy vehicle, a 2013 Ford Fiesta from their impound yard I provide Nicole the receptionist with the release form from the Department of Finance stating it was paid in full and to release my vehicle.At 6:15pm there was not any communication between Mike the Manager and I about a Towed Out fee for $95, only a Jump Started fee of $and that was when I statedthat the Jump Started in Tow-arriffic office is for $45, and why was he trying to extort money from me and almost double the fee, that was when he repeated amount again and walked away I was willing to pay the correct amount of $which is the right amount for the Jump Started fee as staated in their policyThis conversation lasted minutes because Mike kept going back and fouth in and out of the towing yard on his phone stating I needed to pay $ As the registered owner I was not going to pay the extorted fee of $and I then called the police at 7:pm The police officer arrived to the yard thereafter and I explained to them the situation how Mike the Manager was trying to extort $ The office asked Mike how much the Jump Started fee was and why was he asking for $instead of $45, he did nothave a response but he did get a bit irrate with the officers, which inturn they tolded him to calm down or they would take him in for disorderly conduct After care thought Mike stated $for the Jump Started fee, which I agreed to paid and the officers leftI had my niece come out and pay for the Jump Started fee of $ Everything wouldhave been paid for in a timely manner if Mike the manager did not try to extort $from meDespite all of the ordeal that Mike put me thru, when the car was finally broughtout of the locked yard, I inspected the outter shellWhen I went into my car, the car front seats were pushed way back and you could clearly see damaged to interior gear console, someone drilled hole in it which was not previous there I asked Mike what happened and he stated it was the Tow-arrific guys, in which I stated YOU are them. At no point did I refuse to take my vehicle, Mike without my consent drove my car back into locked yard and closed down for night Even after all the hassell that Mike put me thru, it makes no sense for me pay the Jump Started fee and then leave my vehicle, to continue to collect storage fee Therefore, I called police again, and when they arrived to the yard, and after hearing the ordeal Mike put me thru, the offices advised me to file a Criminal misconduct/criminal mischief report with the Better BusinessBureau I the RO, *** ***, came back to the yard to retrieve my vehicleI called the yard prior to my arrival and was quoted by Nicole the receptionisthow much it would be to pick it up and without any problems or hesitation I did understand and would be in to pisoonHowever when I arrived back to the yard on 2/**, I came straight to the window and Nicole started to go over all the fees due on the car, the dollar amount she quoted me over the phone did not match what she was actually going to charge meNicloe and Mike stated that they would not start up my car and that now I had to pay to have my vehicle towed out then Jump Started again Again this time around I was not going to allow them to extort money from me as Mike tried to before I have attempted to retrieve my vehicle but this time thru the court system.I went to the Civil Court of the City of New York and filed a summons in which the Defendant (Tow-arrific) was to answer and I did return back to the yard on March 1, with someone to legally serve Mike the paper work and Tow-arrific, which he was, but no one never responded to the summons.

My newly purchased vehicle was towed and impounded by the City After obtaining a release, I came to pickup the vehicle the same dayThe city ordered that my vehicle be towed out since I did not present my dealer plates with reg and ins while obtaining my release
I have my own tow vehicle and head to the impoundThey would not let me tow out the vehicle myself because of insurance issues therefore they must charge a "tow out" fee of $before taxesI tell them the vehicle is working fine there is no need for a tow, they tell me we cannot drive a vehicle without plates
I agree to their charges, moments later they tell me they did not realize the vehicle was a truck, which they charge double So the total is now $for a "heavy duty tow out"
So after I pay the total bill, I watch my truck get driven out of the impoundThey charged me double the rate to not even tow the vehicleHow can you claim it's because it's heavy duty but you are just driving it like a regu
