Re: [redacted] Dear Ms [redacted] ,This letter is the response of Ace Hour Towing (herein "Ace Towing") to the complaint of [redacted] , which has been submitted to the Revdex.com of Minnesota and North Dakota.Ace Towing agrees that, at the request of the Police Department, Ace towing removed Mr [redacted] 's car from a flooded road the vehicle was then towed to the Ace Towing lot Due to its flooded condition, Mr [redacted] 's car could not be removed from the Ace Towing lot under its own power, and was towed to a new location by another company.Thereafter, Ace Towing made the first contact with Mr [redacted] , making an administrative call to verify the method of payment which had been used to pay Ace Towing for its work It was only then that Mr [redacted] made his complaint.After receiving the complaint, Ace Towing sent one of its employees, who has extensive mechanical background, to view Mr [redacted] 's vehicle The employee inspected the hole in the engine block and took pictures The employee reported to Ace Towing that the hole is located on the rear vertical surface of the engine block When Ace Towing moved this vehicle, it was lifted by its wheels.Clearly, Ace Towing did not put a hole in the rear of Mr [redacted] 's engine block Based on the nature of the towing procedure, and based on the location of the hole, Ace towing absolutely denies that it caused this damage.Ace Towing, contrary to the assertions of Mr [redacted] , did take this claim seriously If, as Mr [redacted] claims, Ace Towing had ignored him, it is difficult to explain why an Ace Towing employee actually inspected the vehicle, after it had been returned to Mr [redacted] 's possession.Ace Towing stands by its long history of customer service and by its attention to customer satisfaction However, in a situation such as this, where investigation has shown that Ace towing was not the cause of damage, Ace Towing will not pay for damage, which it did not cause.Very truly yours, [redacted] & [redacted] , P.C.By: Charles "Casey" L [redacted] lwcc: George ***, Ace Hour Towing (via email)
Initial Business Response / [redacted] (1000, 10, 2015/08/14) */ ***see corresponding pictures attached Re: Ace Hr Towing - [redacted] Complaint Dear Mr [redacted] : This office represents Ace Hr Towing, as legal counsel, and I have been requested to respond to the Consumer Complaint received by your office from [redacted] , dated as of July 15, Ace Hr Towing is not familiar with the storage arrangements alleged by Mr [redacted] for his 5th wheel camper at the Lincoln, North Dakota address identified in his complaintAce Hr Towing initially became involved in the matter through telephone contact from the individual storing the camper, indicating it had tipped its side, in a storm, causing damage to the camper and an adjacent motor homethis contact having been made due to Mr [redacted] not being able to be contacted at taht timeThe storage facility requested that Ace Hr Towing return the camper to an upright position, and tow it from the premises, as Mr [redacted] was in default regarding his storage feesPhotographs of the camper in its tipped condition are transmitted herewith, for your information and reference Ace Hr Towing was able to upright the camper and tow it from the rental premises, with use of two vehicles/trucks, at that time towing the camper to its business premises in BismarckThis service call took place on June 20, At that time, Ace Hr Towing was informed by the rental facility that they would continue to attempt to contact Mr [redacted] , to inform him of the situation The charges that have been assessed by Ace Hr Towing amount to $for the service call and towing, and $2,for storage, at $per dayThe storage fee is based upon the camper taking up two storage spaces, each charged out at $per dayThis is a standard storage charge in the industry Mr [redacted] had a contractual relationship with the rental/storage facility in Lincoln, and any obligation to contact Mr [redacted] about the change in circumstances regarding his camper rested with that facilityThis is the manner in which a private impound is generally handled in the industry, due to the actual business relationship being between Mr [redacted] and such facility It is important to note that Mr [redacted] indicates in his complaint that he had paid for storage through May, 2015, whereby he acknowledges that his rental situation was in default when he finally checked on his camper on July 12thThus, Mr [redacted] was negligent in not properly attending to his property, and not being able to be contacted regarding the damage incident Under such circumstances, Ace Hr Towing handled this matter properly from a legal standpoint, and was thereby entitled to collect the charges assessed to Mr [redacted] for the service call and subsequent storage Please advise if any additional information is requested from Ace Hr Towing at this time Thank you for your consideration in this matter Very truly yours, [redacted] , P.C By: Charles R [redacted] tf Attachments cc: Ace Hr Towing (w/out attachments)
