Dear Revdex.com, In regard to complaint #*** Townhouse Kitchens only contracted for the sale and installation of the cabinetry in the site conditions that was delivered by the contractor. ** *** had independently hired the interior designer and the contractor separate from our contract. We cannot take responsibility for the condition of the space that the cabinetry was installed. The contractor and cabinet installer was the same company and same workmenThe wall against which the disputed cabinetry was installed was a structural wall in an apartment building built in approximately With structural walls in older apartment buildings they most often cannot be “altered” in accordance with the condo/rulesThese structural walls in old buildings are often out of square, out of level and out of plumb, as previously noted this condition contributed to the set back that *** is complaining about The attached photos show the installation that was in place for weeks prior to the delivery and installation of countertops*** *** lived in the apartment during the entire construction phase and had unlimited access to see the installation and convey that he was not happy with this condition. He expressed no such concerns until after the job was completed with countertops were installed and plumbing connections were final As noted the cabinetry and countertop installation was completedThe set back that *** is unhappy with was noted in the drawings in a less pronounced way but Townhouse Kitchens has offered to change it at no charge if he will sign off on the attached work description I am sorry he is not happy with the installation but will not offer him a refund to remedy the situation Joy Y*** *** *** ***

*** Thanks for your return call today regarding Complaint # ***. The complaint #*** asserts that the kitchen work was not completed. The kitchen work was completed. All the cabinetry and countertops and tile were installed and were in good working order
when *** submitted final payment. After the installation was complete *** *** felt strongly that he didn’t like the cabinet with the countertop on it being set back from the face of the refrigerator. In the attached document I describe the changes that I am willing to undertake at no additional cost to himIf he will sign the document and return it I will order the required pieces and perform the work at the promised not charge The photo I attached was before the refrigerator / cabinetry panels were installed and unfortunately I don’t have the completed photos but I believe that the photo will better help you understand the complaint Please let me know if You feel I need to provide additional clarification? I have reviewed the response made by the business in reference to complaint ID#? ***, and have determined that my complaint has NOT been resolved because:
[To be very clear, the cabinets are in working order, that was not in question and this has nothing to do with my not liking something that I wanted changed? The installation of a cabinet was not done properly and there was an agreement to fix the ERROR in installation? Again, I cannot stress this enough, the job was NOT completed as agreed to and paid? The attached document clearly states that I paid Townhouse Kitchens for cabinetry AND installation? The cabinet in question was not installed as agreed to nor was the back panel made correctly as two ends are unfinished with no edge banding? I did not agree to the changes that were made to the design and installation of the panel and cabinet? Furthermore, when I met with MsY*** and the contractor on the job *** ***, to discuss the ERROR, there was an agreement that the cabinet installation would be corrected? It is still unclear to me as to why that has yet to be done and why the panel that was agreed to in October was never ordered? The document that MsY*** produced was created nearly months after we agreed to the corrections? Msy*** did not order the part as was agreed to in October ? Townhouse Kitchens has been deceitful in its business practices and I question if a claim for fraud may be made? Again, this job has NOT been completed as designed and paid for, nor have the corrections to the ERROR that was made in the installation been completed in a timely manner? I do not trust that Townhouse Kitchens will do what is claimed given the history of deceit? I have little confidence that even if an overreaching document is signed that the job with be completed as it was designed and paid for? I am willing to accept a refund in the amount of $5,000, alternatively, MsY*** can order the panel as she promised in October of to adequately correct the job as was designed and paid for? I am not a kitchen designer or contractor but I know the difference between a cabinet that is drawn to be flush with the rest of the cabinetry and a section of cabinetry that is not flush with the rest of the cabinets? The document that I have provided here includes the contract I signed for design and installation, along with the drawings of the kitchen design? As you can see from MsY***'s documents ]
