Initial Business Response / [redacted] (1000, 5, 2016/03/17) */ Contact Name and Title: Michael S [redacted] Contact Phone: [redacted] Contact Email: [redacted] Mr [redacted] took out a car loan with us on September 3, He did purchase an extended warranty from us that covers specific areas When Mr***'s car went down he informed us at the Credit Union that the extended warranty would not cover it because the problem, which occurred less than a month after he purchased the car, was a pre-existing condition, not something that actually "broke" in the carWe advised him to work with the dealer as they sold him a car that was faulty from the beginningIn the meantime, Mr [redacted] pursued action with the warranty provider who refunded his purchase prices but also offered him some form of settlement, which he refusedMr [redacted] did speak to me that he would not be making his payments and that "if we wanted his car it was in pieces and we could go get it." I informed him, as I would anyone that borrows money from us, that he signed a legal document in his promissory note and he was still responsible for making payments or we could pursue collection against him as the dispute he had with his car was separate from the loan we granted on itRepeatedly, Mr [redacted] declined to return our calls until he recently made the aforementioned depositOur collections department, while acting fully within the law and our rights, exercised right of offset to apply the deposited funds to his loan, which has not had a payment made since October Our VP of Operations attempted to contact but never received a call back from Mr [redacted] regarding arrangements to have that payment reversed and provide at least a portion of it back to himAs of addressing this complaint Mr [redacted] has yet to return our callWe believe that we have gone above and beyond to assist Mr [redacted] with this problem between himself and the car dealer and while we are sorry for the issues he has encountered have a responsibility to collect on Mr***'s loan and to enforce the legally binding promissory note he signed

When Mr. [redacted]'s car went down he informed us at the Credit Union that the extended warranty would not cover it because the problem, which occurred less than a month after he purchased the car, was a pre-existing condition, not something that actually "broke" in the car. We advised him to work with the dealer as they sold him a car that was faulty from the beginning. In the meantime, Mr. [redacted] pursued action with the warranty provider who refunded his purchase prices but also offered him some form of settlement, which he refused.
