I did respond to this complaint on 4-9-18.? I am not sure why my previous response did not go through.? ? Here it is:We have reviewed *** ***? concern along with our warranty file and we agree that his boat should be evaluated quicklyWe do hire an outside contractor to
transport boats to and from the manufacturing facility.? According to the transportation company, *** ***? boat is scheduled to be transported the first part of next week.? When it is received at the factory, they will bring it in and evaluate it.? I also have an update as of 4/25/18:? The repairs to this boat are complete and transportation back to the dealership has been requested by the outside companyBoth port and starboard pontoon logs were replaced with new logs.?

We have taken the opportunity to review Mr***’s complaint along with our warranty filesOur warranty department has reached out to both Mr*** and his local Tracker dealership and? are currently working with both? to address the concerns

We have reviewed Ms***’s concerns along with our warranty files.? According to our files the dealership cannot recreate Ms***’s concern with her boat.? When they lake tested the boat, they found no cavitation and it performed at RPMs.? We have spoken with the dealership
and they have a lake test scheduled with Ms*** on 11/6/

I am rejecting
this response because:All tracker is wanting to do is repair the current issues with the boat with no way of repairing the trust that I have lost in the boatI have owned this boat for less than months, have made one payment while it was in the shop, and have another due on the 31st of September while the boat is still in the shop! Tracker or it's authorized dealer have been in physical position longer than I have! It is my request that they either buy the boat back or give me a different boat of comparable price! Anything less is unacceptable by me!?

Tracker Marine has the right to cure As a gesture of goodwill, Tracker Marine provided transportation of the boat to our manufacturing facility for repairs at no cost to Mr***Mr*** boat is currently at our manufacturing facility and the repairs have been completed, and a letter of explination of repairs has been mailed to Mr***Transportation back to the dealeship is currently being scheduled, once again at no cost to Mr***Since the repairs are complete, we will consider this case closed with your office at this time

I received the boat today (4.1.16) from the Tracker Marine Store in Memphis, TN Upon inspecting the boat, all of the aluminum on the decking (forward, mid, aft) is still warped and un-level
On the front and rear decks you can still see where the aluminum has bent around the sub-floor framing, just as it had before I sent the boat back to the factory for repairs due to manufacturer's defects
There are "waves" in the front deck and middle flooring
There are also many places in the front and rear deck that feel "soft" (were being depressed by mine and the Tracker employees hands while we were standing in the parking lot adjacent to the boat Not even the full weight of a grown man standing on it like they were designed for)
In many places there are actually more chips in the special paint coating than there ever were before it was returned for repairs
They got paint on my Fishfinder/GPS Transponder
I spoke with the GM of the Tracker Marine center, as well as Glenn and the other Service tech on duty (On a positive note, all three of these employees went above and beyond in this entire ordeal and were very nice) They all agreed that you could still see the areas were soft and wavy, they also told me that they would *** another warranty work claim
I also called *** *** at the factory in Springfield (my customer service rep referenced in my complaint above)in front of the GM and left her a message indicating that I was not happy about with the repairs and requested her to call me at her earliest convenience (4:04pm CST 4.1.16)
Since I had plans to use the boat this weekend, the local Tracker Employees told me to take the boat for the weekend and use itI was told by *** *** on Wednesday that all of the repairs had been completed to return the boat to factory condition due to manufacturers defects (*** on the warranty team told me they have had numerous complaints because the foam they used in the boats shrunk, and the aluminum was not thick enough, and they have had to replace the foam and re-brace the aluminum in a lot of boats)
I will return the boat Monday morning after I use it for the weekend and I expect to have the situation resolved before the end of next week This warranty complaint was filed in October and you acknowledged that it was a major repair that would have to be performed at the factoryI gave you the boat February 1, and received it back on April 1, It is not my fault that your manufacturing defects have:
Forced me to use a boat that is possibly structurally unsound due to manufacturers defects
Forced me to use a boat that is now an eye sore to look at due to manufacturers defects
Forced me to make boat payments for full months while the boat was being repaired (even though I can't tell that they did anything)due to manufacturers defects
Are forcing me to go through this process again, because either
aThey did not fix it at the factory and just sent it back to me after months
bIt has already bent again and is structurally unsound, again due to factory defects
Are forcing me to use time and resources that I cannot bill them back for to resolve this matter when they should have given me a new boat to begin with If this had happened in my Chevy truck, I guarantee that they
a would have given me a new truck because of major structural defects
b would not have sent me a truck with wavy and soft sheet metal on the outside of the body
c would have given me a loaner vehicle if they did decide to send it back for repairs, due to factory defects
Are going to force me to go another extended period without my boat while you determine your next course of action Based on recent experience, I am under the impression that I will go to the back of the line again, waiting for my boat to be repaired? Even though it was already supposed to have been fixed?
I will again be forced to make boat payments on a boat that will be in your possession, due to manufactures defects
Even if you repair it (actually repair it this time)I will be forced to use a boat with questionable structural integrity (you will have to cut it and re-weld, again if you ever did the first time)
Go another months without my boat, bringing the total to 1/of the first year I have had a BRAND NEW BOAT it will be in the shop for warranty work due to manufacturers defects
My original request is still out there, please either replace the boat with a brand new one (hopefully free from major structural manufacturers defects), or refund my money plus taxes, title, registration, and fees

The flooring is warped causing extreme depreciation (I took this boat to trade in on a boat that did not have structural issues, different dealers offered less than half of trade in book value due to decking problems)I bought this boat brand new in May I purchased this boat from the largest boat manufacturer in the US thinking their customer service was not as bad as all of the reviews indicated on every website I looked at Since my last communication, there are new places in the boat that have warped Also now the exterior of the boat is warping around the motor brackets due to substandard materials being used in the manufacturing process Also additional weld points are pushing through causing wrinkles in the boat that were not there when I purchased the boat At this point, I want my money back plus tax, title, fees, and time The next communication you receive if you rebut this again will be from my attorney

There is some paperwork that will need to be signed by Mr*** before he can transport his boat to the Lebanon facility Once we receive Mr***'s acceptance of our offer, the paperwork can be faxed or emailed to Mr*** directly

I would accept the response from Tracker MarineLLC providing that after they weld the crack in the bottom of the boat that they complete applying high density spray foam to entire inside hull to prevent another tear of the hull and to provide a photo proving the foam is there Also provide transport of the boat from and back to my home in Kentucky to and from the Lebanon, Missouri manufacturing facility
Also I feel that my overhaul of the boat trailer from single axle to double axle is not as good as the dual axle trailer now provided with that model boat My attempt to fix the trailer has it sitting too high off the ground which is difficult to launch I had to fix the trailer as the boat was over weigh for the single axle which they did not acknowledge or fix at the timeIt would be nice if they would make it right and replaced the trailer with the one they now provide for that model boat

Tracker's repair would be to re-weld the area of concern and re-foam as needed and within Coast Guard and manufacturing guidelines after the welding process However, according to the terms of our warranty statement, "In the event repair must be made at the purchasing dealer's location, a factory authorized repair center or at the TRACKER factory, transportation to and from the applicable repair center shall be at the owner's expense and not at the expense of TRACKER", therefore, Mr*** is responsible for the transportation
Even though Mr*** voided his Trailstar Trailer warranty by modifying it, our manufacturing personnel will evaluate it while it is at the factory

My concern is the miles each direction from my home to your factory Such a trip would have to be made twice most likely to bring you the boat and to return to pick it up when you finish the repairs on the boat with the cracked hull due to no internal spray foam to support itA total of miles plus my valuable time
I would consider such a trip if I knew for certain the trailer which came with the Tracker would be replaced with one as sold with that model boat now by Tracker I informed you of the problem of the single axle trailer not being adequate to accommodate the weight of the boat while it was in warranty which was before I modified it to a dual axle trailer You only aligned the tires which was not a fix I had to modify the trailer because I had to replace the tires each time I made a trip to the lake and back The modification left the trailer too high in the water for launching and loading the boat easily
OR would you be interested in giving me the $17,payoff on my Tracker Boat and Trailer as is toward a new Nitro ZBass boat with a L OptiMax(r) Pro XS w/Torque Master motor and adequate trailer at fair price
