I am rejecting this response because:  This is completely false.  The owner was well aware of what was in the 2 boxes that were dropped off for shipping.  Yes, my parents dropped of the boxes for me that I packed and I paid for as I was flying back home a day prior to them.  Here is a statement from my parents - "Just like the post office we were asked if there was anything volatile or explosive in the boxes.  We identified that there was wine in the boxes.   We discussed with the owner that our daughters visited the wineries while we stayed home and babysat the grandchildren.  The fact that there was wine in the 2 boxes was very clear during the course of our time in the business."My parents are both consistent and clear about what was discussed during the transaction.  It is clear to me that the owner was well aware of what was in the package and played the odds that nothing would happen during the shipment so he could retain the business and make money off of it.  Now that there is an issue, of course he does not want to accept responsibility.  I have spoken with UPS who state that because it was shipped by a UPS Store that I must deal directly with the UPS Store and not UPS.  I again request my shipping fee and my $100 insurance paid to me as the shipment was not completed and damage occurred.

It is a policy with all shipping carriers that wine or any other alcoholic beverage can not be shipped from individual to individual. The couple who had originally shipped the item are the parents to the individual who has started this claim. When the parents came into the store it was never made...

Our process with shipping is to first ask if the item is worth more than $100, if it is than we ask what the item is, if it is not worth more than $100 than we do not ask what the item is. If an item is damaged in transit it is the hands of UPS corporate on whether they will approve a claim for it. The item was not packaged by the customer correctly causing it to leak wine when the damage occurred. When UPS corporate discovered it was wine the shipment was stopped and returned to the sender, which was our store. We regret what has happened and are sorry for the inconvenience but as stated it is in the hands of UPS corporate and at no point during the transaction were we made aware of the contents of the package. Sincerely, [redacted]

Review: • 5/**/13 Tracy’s Nails- put acrylic nail on both big toes • 5/**/13 Tracy’s Nails – pedicure - Right foot- cuticle on big toe was cut which cause an infection in nail bed. • 5/**/13 Tracy’s Nails (4:00 PM) removes both acrylic nails; clearly see that toe is infected. Says, “Sorry” and wants to know if I want her to paint my toe nail. Told me nail would be fine wait a week. • 5/**/13 Mid Hudson Medical Walk In (4:45 PM) Diagnose: Nail bed infection Rx prescribed: Amoxicillin-Pot Clavulanate 875-125 mg Tab for 10 days I do have documentation to support this claim.Desired Settlement: Would like to be reimbursed for all medical care, nail salon service and rental reimbursement for a weekend trip (5/** and 6/*) that I couldn’t attend do to this situation. I do have documentation to support this claim.

Response:

We take many precautions to prevent infections. We use pedicure liners and sterilize our tools and pedicure stations after each use. In our five years of operation, this is the first that we have ever heard of a customer getting any kind of infection during their visit with us. It was a routine pedicure. We clean and trim the cuticles of all our pedicure customers without incident. During the initial pedicure on 5/**/2013, there was no reports of irritation or bleeding so it is possible that the toe was infected sometime after the pedicure. However, we are willing to reimburse the cost of the pedicure and will consider reimbursement of out of pocket medical expenses with appropriate documentation including documentation that the infection was a result of the pedicure performed here. It is not reasonable to ask for rental reimbursement as a toe infection would not prevent anyone from taking a weekend trip.

We are willing to reimburse payment of $25 to Tracy's Nails on 5/**/13 and $10.25

co-pay to United Heathcare.In th materials that were sent to us,we did not see

a receipt from CVS for $21.78 on 5/**/13 and the receipt from Dr.[redacted] was

illagible.We do not feel that reimbursement of $28 to Tracy' Nails on 5/*/13 is

appropriate.It is clear that Mrs.[redacted] was satisfied with the service reodered

on that day by the repeat bussiness on 5/**/13.If there are any futher issues

please let us know.
