July 31, 2015     Re: Complaint filed by [redacted] against Tradewinds Auto Sales   Dear Revdex.com,   My name is [redacted]. I am the owner of Tradewinds Auto Sales.   [redacted] purchased  a 2004 Chevrolet Tahoe from us on June 19, 2015....

  At the time of purchase, it was noted that we agreed to repair/replace the fuel pump, which we did and the vehicle was delivered. No other guarantees were expressed or implied.   The following week, Mr. [redacted] came in and stated he was having problems with the transmission; when it got up to operating temperature, it would slip/wouldn't move.   Being that he works directly next-door to us, we told him to leave it with us and we would take a look and see what we could find.   Upon checking the fluid level and a subsequent road test, we confirmed that the transmission was indeed, slipping, and it needed to be professionally overhauled, or a different one installed (used/rebuilt).   I informed him that although the vehicle was sold As-Is and there was no warranty, that I would stand behind the vehicle and repair the transmission at my expense. The only stipulation was that the man who does all of my transmission work,  (overhauls), was with his family, on vacation, and wouldn't be back until the following week.    He stated that he really needed the vehicle and that it was putting him in a bind because that was his only means of transportation. While I empathized with him, I gave him some options.   I told him that I wasn't comfortable replacing the transmission with a used one, because we'd be wasting time/energy/resources should it prove to be bad. I have been doing business with this man and his father for over 30 years, and I trust him. He does quality work  and very, very, rarely do I ever have any 'comebacks', or problems with his work.     So I told him that I would cover the cost of  the transmission repairs, (removal/overhaul/installation/fluids/etc), but only if this man does the overhaul. (and, again; he wouldn't be back until the following week).   The other option was that if he wanted to purchase a used transmission, we would cover the cost of the labor to remove/replace it, one time. If the transmission turned out to be defective, he would have to cover the cost of the labor to re-remove/re-replace the transmission the subsequent time.   Or, he could see if there was another vehicle, in our inventory, in the same price-range as the Tahoe, he purchased  and we would put the money he paid in on the Tahoe, on that vehicle. In other words, we would unwind the Tahoe deal and transfer the monies onto that other vehicle.   After looking over the selections, he stated that he really needed a full-size SUV, and he opted to wait and let us get the transmission overhauled.   Later that week, (Thursday, I believe..?), I instructed my mechanic to remove the transmission on [redacted]'s Tahoe,  so we could send it to the transmission man, when he returned on Monday.   My mechanic came into the office a short while later and informed me that the hydraulic cylinder on our 'lift', had ruptured a seal and the lift was inoperable. I called the shop who sold us the lift and asked them to send out a technician to service the lift and the soonest they could send someone out would be the following Thursday. I told him that I needed someone ASAP and would get back to him. Long-story short, we finally got the lift operational, but it was several days later....and we kept [redacted] updated on the progress throughout this ordeal.       Once the repairs on the lift were completed, the transmission was removed, overhauled and installed, and [redacted] took possession of the Tahoe after a successful road-test and clean-up.   I have not heard one word from him in the form of complaint, or negativity regarding the repairs nor of the vehicle, so this letter/complaint comes as somewhat of a surprise.     The only thing I asked of [redacted] with regard to 'payments',  was simply to pay the "Deferred" portion of the Down Payment, as he agreed to do, when he purchased the vehicle. (signed the paperwork/contract/took delivery/etc).   I informed him the reason for my even asking was because we, (Licensed Dealers in The State of [redacted]),  are under a legal obligation to register the vehicle within a certain time-frame,( by law), and that "deferred" portion of the Down Payment goes towards helping cover the expense incurred with getting the vehicle transferred and registered into his name, with the State Of [redacted]   (see Ex. C;  Vehicle Purchase Order) The Total Down Payment was $1600.   [redacted] paid, $1100, initially, (and took delivery of the vehicle), and agreed to pay the $500 difference, (which was the amount, "Deferred"; or, The Deferred portion of the Down-Payment), in two weeks, (on, 7/3/15). This was all that was asked from [redacted]. Nothing more.            In the matter of customer service and good will, I feel that Tradewinds Auto Sales not only stepped-up and stood behind the vehicle, by covering the expense of the transmission repairs, while under absolutely no obligation to do so---went over and above the call of duty-  to make things right with this vehicle and more importantly, this client.    While it is unfortunate that [redacted] was without the vehicle while the repairs were being performed, I, personally gave [redacted] a verbal agreement to defer his first payment for 30 days, for his being inconvenienced, and I will, and have, honored this agreement.    So, I feel that Tradewinds Auto Sales has done everything it could to rectify this unfortunate situation. From discussing this with [redacted], upon his taking delivery of the vehicle after the repair, he seemed satisfied of what we did do for him.   Thank you for your time and consideration.   Sincerely, [redacted]   Owner Tradewinds Auto Sales
