see attachment.Thank you very much for the opportunity to respond to this issue as we were unaware of the complaint until we received your letter dated April 28, marked “URGENT.” Our customers are very important to us and because of this we follon every problem or complaint.On February 9, we sold Ms [redacted] a Ford MustangShe had a small problem with the vehicle on the way home that evening so we had the vehicle towed to our lot the next day at which time we repaired the problemMs [redacted] picked the vehicle up the same dayHer first payment was due weeks after the purchase dateShe failed to make her first payment so we contacted her by phone and was told the vehicle had a lot of issues (none of which we were aware of)We instructed her to bring the vehicle to our lot and we would be happy to make the necessary repairsIn response, she didn’t want to keep the vehicleWe offered to exchange the Mustang for a vehicle of equal value, out of several vehicles she chose a Mazda She seemed very happy with this transactionOn the way home in the Mazda she did have a small mechanical issueWe immediately picked the Mazda up, brought it back to our lot where we serviced the vehicle and it was ready the next morning.We perform a multi-point vehicle inspection on every vehicle before selling it, however, used vehicles are unpredictableMs [redacted] was contacted regarding the vehicle being ready but she never came to take possession of the vehicleBecause of the Mustang mishap, we pushed her first payment back two weeks, we’ve never received a payment on either vehicle.When unexpected problems come up for our customers we try to make fair accommodations, but it takes two reasonable parties to work out a solutionDespite our best efforts, we have been unable to make Ms [redacted] happy.In our now fifty years and thousands of happy customers, very few would claim to not be treated more than fairly.Sincerely,

Thank you for the opportunity to respond to the concerns registered by Ms***We have completed an extreme examination of her records and have found her complaint an extreme examination of her records and have found her complaint to be of a true natureDue to a glitch in our computer system
and miscommunication with our employees, Ms***'s payment history was not being reported to the credit bureaus correctlyWe spoke to *** on Thursday, July 16th requesting this error be corrected immediatelyWe spoke with them again today and have been assured her credit report is now correct and accurate
Our customers are very important to us and because of this we personally contacted Ms*** with our sincere apologiesHer response to our call was very positive and she informed us that her credit report had indeed been updated with her score improving by approximately points

Hi thank you for letting me respond back to Circus Auto Sales. I do not agree with the businesses responseThe business did make a few accusations that didn't seem fairThey were fully aware of the issues we had been having since I picked the mustang up from being fixedWe contacted them several days in a rowAsking for *** (salesman that closed the deal) but he wouldn't answerI began to think they knew all along the car wasn't in working conditionAfter we finally got thru we let them know the car felt unsafe and was having more issues than car still smokingThey fixed the mustang twice before I decided to ask the owner *** for my deposit back and out of the contractThat's when I was told no and I only had one option and that was to trade car for another car on their lotI had many options on what I chose but I went in believing no issues wouldnt come up againThings seemed great until I left the lot to go homeThey came and got it the same day by tow truck but it wasn't ready the next day I recieved a call from then stating they had to get a specific part from Mazda and would take about a week to get the part in townAfter everything that happened within the first month at that point I was upsetI just wanted a working carI would have loved to have done business with Circus Auto sales if it was fairI'm very understanding the a used car is unpredictable but when you have the same issue with two cars back to back that doesn't seem to unpredictableI'm hoping we can both come to a agreementI feel I'm owed as a customer to Circus Auto sales a fair situationI feel I should be agreed with my situation shouldn't be and the fair way is to let me out of the contract and by getting my deposit backI believe Circus Auto sales can come to some kind of agreement with me

payments beginning June 29, 2015. We contacted her on numerous occasions regarding her payments before and after the repossession with no success. We were forced to place this account with our attorney and therefore, cannot discuss this account as it is in litigation,Our Policy is to contact every customer regarding past due payments and we always try to work something out to their advantage to make it possible for them to keep the vehicle. When a business is forced to repossess merchandise everybody loses. subject of current and/or possible future litigation in the Jefferson county court and/or the Federal Bankruptcy courts and I can therefore not get into the particulars of this case. I can say that as a matter of policy a bankruptcy does not remove the occurrence of a repossession from a credit bureau. It could be that Ms. [redacted] is having trouble getting housing because her credit bureau shows she does not pay her bills..this is the purpose of the credit bureau. As far as removing a "legal item" from her credit bureau the actual judgment showing on her credit bureau is a matter of public record reported to the bureau by the court system and is completely out of our control. 2016 we sold Ms. [redacted] a 2005 Ford Mustang. Our customers are very important to us and because of this we follow-up on every problem or complaint. Mr. [redacted] purchased a 2003 Dodge Ram 1500 on July 13, 2017 from Circus Auto Sales, Inc. At the time of purchase, Mr. [redacted] also purchased a Vehicle Service Agreement on his 2003 Dodge Ram which covered a period of 12 months/12,000 miles with a $100.00 deductible (see attached). Mr. [redacted] returned the day after purchase with problems which we immediately repaired. He had other issues which we responded to immediately although he often did not show up for his appointments. We did install a used engine after his vehicle had exceeded 12,000 miles and only charged him the $100.00 deductible which warranty did not cover. The last time the vehicle was in our Service Department we were unable to hear any engine noise or locate any oil leaks. We did, however, repair his heat issue at no charge. We currently have been unable to find any problems with the vehicle. When unexpected problems come up for our customers we try to resolve them fairly, but it takes two reasonable parties to work out a solution.Sincerely,[redacted] Vice President

[Circus Auto never contacted me after the Auction of the car we could have worked something out, No they responded to calls or anything. Already having their mind made of going forward obviously because now the only person winning is Circus Auto demanding 8,000 dollars with $5 interest accruing everyday which is 27% even after the sale of the car. I only know the information I know because of the Attorney's office. That's not good business at all.]
