When I received the call from [redacted] regarding the issue at hand, I told him I would have our Job Sup contact him as soon as possible, which he did. Rick (Our Job Sup) was on his way to Woodbury when I contacted him so he went and spoke to...

Mr. [redacted] in person immediately.
He then went and made numerous phone calls to try to rectify the problem in the quickest timeframe possible.
From the very beginning, he was told that we would resolve the issue, but it was going to take some time hence why Paul [redacted] asked if there was any way that he could push back the installation date of his fence.
When the previous Owner sodded XXXXX [redacted] we assumed that he had his property surveyed and actually sodded all the way to the property line since the home was built 10+ years ago. Apparently that wasn't the case and unfortunately, we therefore went onto his property with our silt fencing which is used to protect his sod and is required by the City.
Paul [redacted] personally went out there to look at it again this afternoon, August 18, but the ground is too wet for them to do anything today.
Donnay Homes is more than happy to make things right in this situation. Weather permitting, we will re-grade the land where the silt fence was. At which time Mr. [redacted] may want to finish sodding.

If Donnay Homes would've taken corrective action in a prompt, professional and effective manner, the request for re-sodding the damaged and intruded property would not have been made. The request would've been to re-grade the aforementioned property to repair the depressions and holes in my soil left from the barrier fence and other damage to my property. In addition, it was apparent that many many rocks were pushed out of the Donnay property, on to my property. Furthermore, in the next Donnay lot to the north/east of the complained property, Donnay also failed to remove the construction barrier from that property and simply buried it. However, in the same fashion as the current issue, it was on MY property.
It is also important to note that I do have photographs documenting the intrusion onto my property from Donnay's site.
After weeks had passed without Donnay acting as a good neighbor, I re-graded and removed the rocks myself to shorten the "loss of use" of my property.
While I acknowledge that the intruded and damaged area was not sodded before Donnay's actions, the request for sod was made for the following reasons:
1) After weeks of inaction by Donnay to replace the construction barrier and erosion barrier, my property which I re-graded, hauled in new fill, and planted grass seed, sustained erosion from Donnay's construction site.
2) Since Donnay did not act in a responsible manner, a conservative and reasonable request to rectify the situation is simply a few rolls of sod along the damaged area which young grass and new fill was washed away from Donnay's site.
In closing, due to Donnay's negligence and unprofessional response from Paul [redacted], I was forced into repairing my property which was damaged by Donnay. I suffered loss of use of my property, financial loss due to the time away from work to repair the yard, and continue to deal with this issue which is due to the sole negligence of Donnay Homes and/or its affiliates.
If a resolution cannot be met in an amicable fashion, I may be forced to retain counsel to compensate me for the previously highlighted reasons.

Paul [redacted] spoke to our landscape company and will have them come out and assess how much sod is needed when they are out at the site to landscape our property.
