Train with Trin

Review: In September 2013, I (along with a partner) signed a contract with Trinity P[redacted] for personal training services. The contract was for 50 personal training sessions at a cost of $1748.87 per person (total was $3497.75). The terms of the contract included a refund for medical necessity. Around January 2014, I learned I had a torn tendon and was later scheduled for surgery in April 2014. I notified Ms. P[redacted] that I would need to discontinue my training services due to the injury via email. Shortly after receiving my email, Ms. P[redacted] called me and verbally assured me I would received a refund of all monies due for the 23 remaining sessions. The average cost of each session was $34.96. Despite this conversation and the contract (which clearly states refunds for medical reasons), Ms. P[redacted] miscalculated my refund as $290 when I was, in fact, due $843.92 for the remaining sessions.Desired Settlement: I would like Ms. P[redacted] to honor the terms and conditions of my contract which clearly states "refunds are granted for medical reasons only and require a written statement from your primary care physician." Ms. P[redacted] violated the contract when she deviated from the refund policy and only refunded me $290 of the $843.92 I was due. Ms. P[redacted] used an arbitrary method to calculate a drastically reduced refund despite verbally assuring me I would receive all monies I was due.
