Trak-received an inquiry from *** *** on 1/5/regarding a background screen conducted on him on 1/3/*** indicated that he believed this was an employment screening conducted without his written permissionOur research with the customer that requested the report, Sterlings
Property Management, indicated that they manage several properties owned by *** ***Mr*** also is involved in the management of a restaurant, Old Towne BistroEvidently Mr*** and Mr*** were discussing an opening available in the restaurant and Mr*** was interested in housing as part of the compensation packageSince Mr*** also owned a rental property that was vacant, he was willing to consider this based on approval through his property management companyTypically, Sterlings Homes Property Management has applicants complete a paper application but since these discussions were occurring over the New Year Holiday weekend and Mr*** was in Indiana and the Property was in Colorado, Mr*** took Mr***’s information verbally and forwarded it on to his property management agent, so they could run the report to determine if he would be accepted based on standard rental criteriaThe agent told Mr*** verbally that normally this wouldn't be someone they would rent to, but since the occupancy was based on compensation, they saw no issue with it.Trak-then reached out to *** *** by phone on 1/6/and explained to him that this background screen was not requested by Old Towne Bistro but by Sterling Homes Property Management for residential purposesMr*** denied that any property was discussed but when we mentioned that based on our research, Mr*** had requested that housing be considered in the compensation package conditions, he said that was for his employment compensation thus needed written permissionWe explained that due to this inquiry being for a residential property qualification and not for employment purposes they did not need written permission and verbal permission was sufficient*** stated that he was going to reach out to his lawyer if we did not remove the inquiry from his credit report.We have attempted to resolve this issue to Mr***’s satisfaction but were not successful.Trak-acted in accordance with its policies and in compliance with the Fair Credit Reporting Act regarding Mr***’s background check. Therefore, the inquiry that is reflected on Mr*** credit report is valid and Trak-is unable to remove that inquiry as requested. Mr*** may make this request directly with the credit bureau, but in our experience because the inquiry was valid his request is not likely to be successful.Thanks,***
