I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait for the business to perform this action and, if it does, will consider this complaint resolved.
In reference to ID [redacted], I accept the
response from the business and I am grateful that this conflict is being taken
care of. However, within the response provided by the business it is very
apparent that several miscommunications took place leading to this unfortunate
situation. First off, I did not request a full refund and I absolutely do not
mind paying for the work provided, I simply do not agree with paying 241.25$
for the service provided. I have never made a complaint like this before but I
felt so taken advantage of that I could not let this go unresolved.
[redacted] clearly states that I did not tell her
about the shrubs and bushes in my yard, although that was the main objective in
reaching out to the company in the first place on 12-20-2016. If you refer to
page 9 in her original attachment provided you can see (in her own writing) the
notes she took while on the phone with me the night of 12-20-2016 which clearly
states “branches, bushes, shrubs, etc.”. In that case, the crew should have
arrived at my house the following morning properly equipped to remove such
branches and shrubs.
The crew also said my yard was not mowed for 6
months. This is completely and utterly wrong and misleading. There is one
circle in the middle of the yard that has not been cut in a long time because
it is surrounded by large rectangular bricks and our mower would not fit in the
circle. However the rest of my yard, which is quite small, was mowed roughly 3
weeks before the service was provided. The two men who stayed behind finished
mowing and weeding within 40 minutes, then waited for the third person to
return with a hand saw. If the crew came equipped they would have been done
within an hour. The two crewmen waited for the third to return and after she
returned it only took about 30 minutes for them to cut all the shrubs down with
a hand saw. I am not sure what [redacted] is talking about with grape vines because
I have never seen any in my yard, I am not a plant expert, but she is correct
about the shrubs and bushes not being “pruned” because I just wanted them gone.
I had my brother cut them down about a year ago but I do admit the bushes and
shrubs have not been “pruned”. Regardless, they would have been easily cut
within a matter of minutes if the proper equipment was used.
[redacted] stated she had been in this work for 20
years, and she knows what work to describe to the crew, however her personal
notes from our initial conversation (page 9) was definitely not brought to the crew’s
attention.
I have reattached her initial documents provided
and added some input in red. I feel like the images are an unfair judgment of
the size of my yard. Not to mention, fifty percent of my yard is gravel. I
added in red lines that separate my yard from my neighbor’s, as well as a few
other inputs I felt necessary to point out.
I would like to have at least a 100$ refund,
which would mean I paid 141.25$ to have only my front yard done, and even that
to me is an overpayment due to the crewmen directly lying about their time
spent at my house - as well as paying for the third person to leave to get
equipment when they should have been prepared according to the notes from our
initial conversation.
I was also charged for a dump run which was not
discussed to me prior to. I live 2.1 miles away from the dump and my husband
owns a truck, I would have not agreed to pay for a dump run.
Even with all the apparent miscommunications and
information listed above, [redacted]'s customer service and lack of respect towards
me was completely unacceptable. After giving her my credit card number and
before hanging up I told her I did not appreciate her attitude towards me and
it wasn't until then that she mentioned she was “upset with her crew” (which I
feel was an excuse she quickly came up with because she wasn't expecting me to
mention her attitude) but continued the remainder of our conversation in a
disrespectful manner. If [redacted] had not been so rude and would have been able to
nicely discuss the charges, I think I would have felt comfortable to a
reasonable agreement. I was in tears when I hung up and I felt bullied into
paying her the full amount and taken advantage of. I will accept [redacted]'s
response and receive a partial refund.

I am writing in response to the complaint that was submitted to you by [redacted] on 12-21-16 and assigned the above ID number.On December 20th I received a call from Ms. [redacted] asking about getting an estimate on having some work done which consisted of mowing and weed eating. I explained to...

her that I would have to check and see if we had any mowers still available for mowing since most all of our equipment had been wÍnterized by December 20th and would not be available for mowing. After learning from our General Manager that we still had mowing equipment available I called the customer back and said we could do the work. I asked if she wanted us to do an estimate first of just come out and do the work as it would take a few days to get someone out to do the estimate, but we could do the work pretty quickly if she just wanted to do it on a time and material basis. At that point I explained how time and material work was billed; we charge $70.00 per hour if it is a two man (person) crew or $105.00 if it is a three man (person) crew or basically $35.00 per man (person) hour, and it really doesn't matter if it is a two or three person crew because it will take the same man hours as three person crew will simply get it done faster than a two person crew.(These rates include truck usage, travel & equipment used.)She opted to just have us come out and do the work and forego the estimate. She told me that their mower had been broken for a few weeks and she needed mowing and weed eating the weeds around their deck down, this sounded pretty straight forward and I told her we could do it the next day and wrote up the work order. I told the customer since we had never been there before that t would call her when the crew was done, with the crew time and amount due for her to give me credit card payment after the work was completed.  (Normally we ask for deposits from customers with signed contracts.)I asked my General Manager to make sure and send our heavy duty weed eater as it sounded like some of the weeds around the deck were pretty tall. Per our crew leader the crew arrived at the property at 8:30 and the husband came out and showed them what he wanted done, at that point they realized that they didn't have all the equipment they would need to complete the work, so they unloaded the equipment they had taken and the crew leader [redacted], left and went back to our shop in [redacted] to get more equipment including heavy duty loppers, handsaws and a chain saw. After they were done with the work and had taken a large load of debris to the local dump (which involves truck fuel, employee time and dumping fees) they reported their time to me as arriving at 8:30 AM and finishing at 10:45, this was 2.25 hours for a three person crew which included the time making the dump run and disposing of the debris.When I called Ms. [redacted] to report the crew time and give her the amount due, she questioned the billing and said that they hadn't arrived until 8:50 and didn't start to work right away and that the woman had left and didn't come back for an hour and she felt the bill was too high. I was upset to hear that my employee had apparently lefr the job and gone off the job. I told the customer that I would have to call her back after finding out why [redacted] left. I called my crew leader [redacted] and this is when I learned that she had to leave to go back for more equipment and a chain saw. I called Ms. [redacted] back and explained all of this to her and that by rights I should have been able to charge her an extra trip charge because they had to go all the way back to our shop for more equipment as the work was not adequately described to me for them to know to bring a chain saw, etc. and that I was willing to let that go and just call it a wash, at which point she provided me with her credit card information and I thought the matter was settled. I ran the card, created her invoice and mailed her a copy.It came as a great shock to receive your notice of customer complaint. I feel like we moved heaven and earth to get equipment and a crew out to them as quickly as possible to get the property mowed and weedeated before Christmas. I was not told that she actually had small trees and bushes growing up through her deck or my crew would have had the proper equipment with them when they first arrived and they would have been prepared for what was really there; as it was it was far more than mowing and weed eating down weeds growing up through the deck, it was small trees and shrubs that had trunks that were between 3-6 inches thick. Unfortunately the chainsaw [redacted] went back to the shop for did not work properly and they had to use the hand tools instead.If necessary I will refund all or part of the customer's payment but I would like you to be the judge. l'm sending pictures taken by our crew along with my notes taken during my initial conversations with the customer, the work order I wrote up based on what she described as the work to be done. If she had told me that there were small trees and shrubs to be removed I would have written it down and the crew would have taken the proper equipment. My crew said the grass looked like it had not been mowed in 6 months not weeks and that the grape vines, mimosa trees and buddleia shrubs had not been pruned in at least two years, they were growing up between the steps and boards of the deck. I've been doing this work for twenty years; I have no reason to write a work order that did not describe what the crew was to do on site. I explained to the customer that my upset (what she calls rudeness) was not with her, but with my employee for what sounded like she had left the job to go goof off or something until I learned the circumstances of why she had left the job; which was to go get equipment they needed.I'm not concerned about the money, I will refund all or part if that is what is required here.  What I object to is the slight against our reputation and the harm that may be done. We have always gone over and above the call of duty to satisfy our customers. Based on the pictures my employees provided, the charge of $241.25 was more than fair. However, as stated if necessary I will refund it all.Please let me know what I need to do to keep this from harming Messer Landscape's reputation.Best[redacted] SeigfriedPresident
