The original agreement was for 20% up front and the balance due only upon successful completion of the entire project before 5/29/I paid the 20% prior to commencement of workAs of this writing TFD has not completed the project and abandoned the work site in an unusable stateOn 7/10/I sent *** *** with TFD written emails describing my intent to pay provided he signs and has notarized a contract to repair all damages done by his excavatorHe has failed to provide any written response to that emailI have received ball park estimates to repair the damages from $10,to $16,
I should add that ***'s repeated poor decisions first in the supervision of the excavator, second in the development of a perimeter drain that doesn't drain, third in the payment of the excavator of over 85% of the contracted amount for an unfinished job, and ***'s inability to keep the project moving during adverse weather has eroded any confidence that even if he were willing to perform the work he has the skill set and tools required to get the job done
