October 7, 2015Dear ** ***:In response to your letter dated 10/1/received 10/5/regarding ID *** and the complaint that we will not admit to our mistakeThis member came into the credit union office on September 29th at that time I explained again to him what needed to be done
regarding the automatic payment that was being issued by ***, He stated that we should have called him and told him what was going on and that he was closing his account, I again explained to him that someone spoke to him and explained to him that only he could call the auto payment system and stop the auto pay.On September 29th I took copies of what the member looked up on the web for the *** payment system and told him that I would research this again and get back to himWe work with a third party vendor to handle our *** contacted them and told them that I need to talk to someone that would stop this auto payment from continuing to be processes since the member refused to do thisI filed a request and was told that it would take anywhere from to business days for them to get back to me.I myself spoke to this member about two weeks ago and again explained to him what was happening with his account and that he had to stop the transaction that they would not allow us to do so I asked the staff member here that works with *** to give this member the phone number for ** *** which she did.I believe what was happening was this - the member at one time set up for a recurring payment to come from his account here and to be paid on his ***, we process over members account and do not look at each individual account until there is a problemSomewhere along the line the member had no money available in the account and we informed him via letter and by attempting to call him that he had ACH transaction coming from his account going to *** and he had no money in the accountAt that time he insisted that he did not set anything up for auto payment from his account - it was suggested to him that maybe someone else in his house hold may have set this up for him but he stated again that no one did thisAt this time we discovered that the *** payments were being made to his *** account with us and it was delinquent because 1) he wasn't making payments and 2) the recurring payments that were being made were being returned for Non-sufficient funds.I would like to point out that at no time did the member contact us regarding the return payment on his *** statement as per the statement instructionsThe member also gets a monthly statement from us directly on his account with us and at no time did he question any transaction as per the instructions on the statement, All our regular account statements and *** statements have the “Billing rights' disclosure that informs the member that they have days from the date the error appear and must dispute the error in writingThis member did not do this just insisted that we were in the wrong and refused to cooperate with us and stop the recurring payment,I am in the process of finalizing my research and will forward such research to our attorney for review and then on the member.Thank you,Sincerely, Margie CCEO

I am rejecting this response because:
I have been trying to obtain information on those transactionsThere was never a withdrawal they were deposit transactions which resulted with change being returnedHow can this be corrected?

I am rejecting this response because:
they say it was a reoccurring account so then why on their own statements does it have a different amount each month, shouldn't it be the same amount every month and the statements that they sent me were all late notice statement like if there were no payments being made to the accounts even the ones I was making on the phone or at the branch threw my payroll which sometimes they took without my permission. if the two were working together than the bank would have notified the [redacted] people that the account was closed. if I wasn't making payments for years then why wasn't the account referred to collections, any other credit card company would have done after 135 days of none payment

Branching site to deposit $100.00 and then you also withdraw $30.00. Subsequently on April 20, 2017, you also visited another Share Branching site to deposit $40.00 and withdraw S15.00.Please be advised that per our fee policy each time you utilize any Share Branching sites to withdraw funds there will be a fee in the amount of $1.75. As a result, you were charged $1.75 for each withdraw transaction at the Share Branching site for a total of $3.50. We do not charge any fees to deposit funds at any of the Share Branching sites.In regards to your concerns that our locations are closed on the weekend and you are unable to deposit funds via the ATM, we apologies for the inconvenience. Review: On 7/23 my credit union charged me a $25 overdraft fee for a transaction for my vehicle insurance payment. The payment amount was $166.00 at the time I had $164.97 in my account. I feel a $25 fee is a bit outrageous for a less then $2 mathematical error. While I understand that I made the mistake I was not notified so that I could deposit the $2. I called the bank and they told me I would have to write a letter and it may get refunded but offered only what seemed to be a generic response otherwise. I would like my $25 refunded and maybe better practices when it comes to insufficient fund fees.Desired Settlement: I would like my money refunded and if possible maybe a change to their system that charges these fees

August 5, 2014Dear [redacted]:Transit Workers Federal Credit Union is a non-profit federally chartered credit union located in [redacted] that serves the employees of [redacted] and the family members of these employees. We are not a community chartered credit union, but rather one that serves only one sponsor group-[redacted].Regarding [redacted]’s complaint about being charged for a non-sufficient fund fee of $25.00, we tried to explain to him that this fee is generated automatically by the computer. We have over 5900 members with close to 2400 of them having sharedraft/checking accounts and a large percentage of that membership also having ACH/EFT transaction for us to review each transaction on a daily bases would be impossible. We do not offer overdraft protection to our members as other financial institutions do, however, we will automatically transfer funds from a share/savings account if available to clear a draft/check or ACH transaction, but this is done only if the money is available. [redacted] was asked to write a letter to the manager of the credit union asking that the fee be refunded. This is our standard policy when member call inquiring about the fee and asking them to be refunded. The request is reviewed and the funds are more than likely refunded to the members. As we explained to all our members the funds are to be in the account before writing a check/draft or initiating an EFT/ACH transaction so as to avoid the expense of a non-sufficient fund fee. As a non-profit credit union we do our best to work with our members and to help all in need. [redacted]’s request to have the $25.00 refunded will be honored, however, his request to change our system to stop these charges cannot be honored nor do we agree with this suggestion. We charge all members that overdraft their account a nonsufficient fund fee and this is disclosed in our quarterly newsletter and the information given to all members when they open an account at the credit union. Similar to other financial institutions we offer an open membership which allows our members to find another institution that might meet their needs If you have any other questions please do not hesitate to contact me at the credit union.
