Complaint: [redacted] I am rejecting this response because:I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is not satisfactory to meUS Bank (the Mortgage company) has called him a total of times and left voicemails with him each timeAn Insurance Investigator has also called and left him a voicemail to which he has not returned their call eitherMy Insurance deductible had already been taken out of the initial bid from [redacted] and per my insurance and mortgage company, I do not have to pay that since they already covered itMr [redacted] refused to provide the appropriate contractors to finish the job he was paid in full for on a timely manner and when I gave his suggestions for contractors who could infact do the work per the insurance bid, Mr [redacted] refused to allow itWhat Mr [redacted] doesn't understand is, this is my home, my insurance company, my mortgage company and I DO have a say in what is done by whom on my houseBoth the mortgage company and the insurance company agreed with me on this matterMr [redacted] refused to do several of the requested items the insurance company listed in the agreement, which he also agreed to do, per his signatureMr [redacted] refused to abide by the contracts in getting arequired city permit (which he was also paid for) for our home which covers an inspection from the city after the completion of the roofI arranged an inspection after Mr [redacted] abandoned the job, and it was found that several vents from our water heaters had been knocked off during the placement of the roofThese vents allow for toxic gasses (Carbon Monoxide) from the water heater to escape the attic safelyMr [redacted] was responsible for checking to make sure this had not happened and had we not called for a city inspection ourselves, this could have had a fatal affect on our family and infant sonMr [redacted] 's contract and bid was over the amount the insurance company estimated the cost and per [redacted] ***, he was to supply them with additional paperwork prior to the job being started, which Mr [redacted] did not doIt has been determined by both US Bank and [redacted] Insurance Company, that Mr [redacted] did infact commit insurance fraud by accepting payment and not completing the jobs in full as he agreed to doMr [redacted] even went as far as taking pictures of a worker on our roof, clearly violating OSHA policies and mocking OSHA on social mediaMr [redacted] has also received multiple certified letters from the home owner which I do have proof he has signed for them, and is refusing to cooperate, sign and return Regards, [redacted]

He received limited lifetime shingles that are rated to months which is years

I’ve already stated I can provide proof of all the work that was completed that exceeded the initial payment madeMy contract that states she is required to pay the deductible which wasn't paidThere is nearly 7k left in her insurance claim to complete the work that she said she would do on her own and hire her own people, when I stated I am going to quitI don’t have to keep working, when I am no longer financially obligated to do so due to non-paymentI am allowed quit and at this point there is no money to refund to her because she owes money! She was also trying to pocket over $from the insurance proceeds in the end to replace her air conditioning coils which WASN'T listed on the insurance claim! This scam of hers came out after I started working on her homeI am owed money right now and chose not to continue to work for a home owner that was trying to rip me off and her insurance carrierI am choosing not to move forward with her scam! And this is the result, public slander and harassment facilitated by the Revdex.comOnce again no one has contacted me from the sources that she has listedThis complaint needs to be voided out as it’s an attempt to slander, extort and facilitate theft of services from my companyIf a client doesn’t want to pay for services, I don’t know a company that would continue working for freeThe initial payment made covered the work completed, the total WRITTEN value of all the work completed ALSO exceeds the payment madeWhich I have stated several times

The roof was completed in full $21,386, the shutters were power washed and restained $219.47, the fence was power washed and restained $$22,in total repair costs completedI have received $21,as a paymentI also repaired cracks inside on the ceiling as well as making an attempt to match year old paint and repainted the cracks as a test to see if the paint would match and it did noti offered to make another attempt to match the color and this is when Mrs [redacted] went on a rampage and started attacking me verbally with threats of hiring other sub contractors and stating she would try and make claims against me for fraudIf include the ceiling repairs, the total is well over $23,and as stated I have only received $21,as a paymentThis is an at work state and I can quit at any time due to non payment or for any other reason I feel fit as a business ownerThis work environment became very hostile and It made me uncomfortable so I quitShe still has nearly 7k to collect between paying her deductible and additional insurance money from her insurance carrierThis is more than enough for her to complete the work as that [redacted] estimatedThe totals of all work that is finished superceeds the payment I have receivedI am allowed to walk away and take a loss if a chose to do soI cant be forced to continue to work on a house with no additional payments or when the client wants to hire their own sub contractors and then try to force me to pay the bill or make threatsI can scan and send in the insurance estimate and my contract for review.All sub contractors have been paid in full for the work that was completedAlso her insurance did not pay for any type of permits or inspectionsI have also received death threats from her brother in law which I haven't filed a complaint against due to not knowing where he called me fromI am requesting that this complaint to be removed from my Revdex.com record and this case to be closed out due to being a form of extortion and public slander

I’ve already stated I can provide proof of all the work that was completed that exceeded the initial payment made. My contract that states she is required to pay the deductible which wasn't paid. There is nearly 7k left in her insurance claim to complete the work that she said she would do on her own and hire her own people, when I stated I am going to quit. I don’t have to keep working, when I am no longer financially obligated to do so due to non-payment. I am allowed quit and at this point there is no money to refund to her because she owes money! Once again no one has contacted me from the sources that she has listed. This complaint needs to be voided out as it’s an attempt to slander, extort and facilitate theft of services from my company. If a client doesn’t want to pay for services, I don’t know a company that would continue working for free. The initial payment made covered the work completed, the total WRITTEN value of all the work completed ALSO exceeds the payment made. Which I have stated several times.

The mortgage company had tried to reach Mr [redacted] multiple times and have ask Mr [redacted] for proof of receipts for work done, which Mr [redacted] can not provide. He admitted to "cutting corners or not completing work" because he has to make money & stay in business in a competive industry.Mr [redacted] gave me multiple excuses why certain jobs were not getting completed, everything from his own sub contractors quit on him or just wouldn't return his calls. I believe Mr [redacted] never had intentions of finishing the job he agreed to do and used our unfortunate situation for his financial gain. He knew our home needed to be finished in a timely manner as it was going on the market. Mr [redacted] told me he could have everything completed in about a week. After 2.5 weeks of not hearing from me [redacted], I started asking questions. Mr [redacted] did not like me questioning the jobs that hadn't been completed.Our home has surveillance cameras and we have recordings of Mr [redacted] refusing to do work he was paid to do, refusing to get required city permits and mocking the city for requesting such permits. Mr Garscia has chosen to not return calls to [redacted], US Bank, the code enforcement officer of Highland village so if he felt valid in his actions, he should have no problem returning their calls.As far as "hostile work environment" there is nothing hostile about our home, my husband is a Police Officer of 15 years!i request this information about Mr [redacted] remain visible so that no other person will ever fall victim to his scam. We are also seeking out legal advise with another home owner in our city that he also scammed.

I have received $21,136 as a payment. I also repaired cracks inside on the ceiling as well as making an attempt to match 8 year old paint and repainted the cracks as a test to see if the paint would match and it did not. I offered to make another attempt to match the color and this is when Mrs. [redacted] went on a rampage and started attacking me verbally with threats of hiring other sub contractors and stating she would try and make claims against me for fraud. agreement. She also refused to pay her deductible which is apart of the contract, the total work was for $27990. The remaining work she was supposed to complete on her own after I quit due to non payment! I have NOT heard from the city or the mortgage company. This is slander. If you have any other questions please call me.  In addition her insurance carrier hasn't contacted me either. And they are also withholding a final payment of $3440 for the remaining work. She has received instructions from them on how to retrieve the remaining balance. Her deductible is also required to be paid in order for the work to be finished and that final payment to be issued.
