To Whom it may concern, The main reason I took my [redacted] to Transmission & Engine Repair [redacted] facility was, Mr [redacted] came to my business and told me they weregood and fast at repairing ***I assumed Mr [redacted] was being truthful I agreed to $5, This included: $for LaborThis included tearing down the Frontand Rear DifferentialsInstalling the new componentsTest drive the ***to ensure all work performed was operating properly This included: $3,for parts with a 15% markup, which came to$3, This amount covered all the new parts listed on his invoice and anyfreight costs to get parts delivered in a quick mannerThe job was supposed tobe completed on 04/16/This is plainly stated on his invoice I even gave Mr [redacted] my Visa card information for additional coverageHe took my information and told me, "I like to deal in cash, only" After not receiving a call that my [redacted] was done by the agreed upon date, I went into his shop to ask about progressMr [redacted] told methe parts we were going to install, he can't getMultiple times Idelivered printed out options for reputable parts suppliers and he would notget the ball rollingI don't know what the issue was, Mr [redacted] knew I needed that [redacted] for upcoming events and I didn't want to miss them I have had to borrow, rent and even buy a [redacted] to use while Mr [redacted] was wasting time trying to figure out how to install simple axle components in a "92" [redacted] ! This [redacted] has some of the most simpleDifferentials ever built! No wonder his operation is such an eyesore to the community, he can't get any vehicles repaired and it takes time for his"Shop Storage" scam to work Thanks, ***

I answered both letters you sent to me As you can see, I attached a copy of the fax print out saying that the faxes went through One was on 6-28-14, and the other on 7-20- I faxed them as that was the only way I could find to send them to you There was email address to which I was supposed to send them Attached are pages with my response Since you apparently did not get my faxes, please let me know if you get this email.

I am rejecting this response because: *** *** has failed to upgrade my *** in the agreed upon timeline
These are the undeniable facts:
1- Mr*** and I, met prior to the contract signing, for the purpose of ironing out the details of the Differential upgrades
2- Mr*** verified he could accomplish these simple upgrades, on or before, the date he stated in his contract. HE HAS NOT
3- Mr*** agreed to supply the new parts, as he defined in his contract HE HAS NOT
4- Mr*** stated he would perform upgrades to my ***, inside his shop, not in his Driveway HE DID NOT
Mr*** has failed to uphold his side of the contract he provided
All the other arguments he brings up are nothing but attempted distractions, they have nothing to do with these facts

The main reason I took my [redacted] to Transmission & Engine Repair[redacted] facility was, Mr [redacted] came to my business and told me they weregood and fast at repairing [redacted]. I assumed Mr [redacted] was being truthful.
I agreed to $5,762.53.
This included:  $1807.02 for Labor. This included tearing down the Frontand Rear Differentials. Installing the new components. Test drive the [redacted]to ensure all work performed was operating properly.
This included: $3,200.00 for parts with a 15% markup, which came to$3,535.83.
This amount covered all the new parts listed on his invoice and anyfreight costs to get parts delivered in a quick manner. The job was supposed tobe completed on 04/16/14. This is plainly stated on his invoice.
I even gave Mr [redacted] my Visa card information for additional coverage. He took my information and told me, "I like to deal in cash, only". 
After not receiving a call that my [redacted] was done by the agreed upon date, I went into his shop to ask about progress. Mr [redacted] told methe parts we were going to install, he can't get. Multiple times Idelivered printed out options for reputable parts suppliers and he would notget the ball rolling. I apologize for this letter taking so long,...

as my secretary was not in the office due to a two week vacation, and I had to await her return in order to get this letter typed and sent to you. Thank you for your pltience. 
On April 11, 2014, Mr. [redacted] delivered to our shop his 1992 [redacted], which had no doors on it, and the license plate on it was a temporary tag that had expired in 2013. At that time, we disassembled the rear differential for inspection. 
Later on April 11, 2014, 1 went up to Mr. [redacted] house to discuss the findings and pricings fort ae 1992 [redacted]. It was determined the gear ratio would be changed in both the front and rear differentials. ids.o, Mr. [redacted] stated that in the front differential he wanted a 30 spline axle kit with a Detroit locker carrier. In the rear differential, Mr. [redacted] wanted a 30 spline axle kit with Yukon locker carrier. Mr. [redacted] approved $7,350.01 for these changes and repairs, and a deposit was made of $1,500.00 cash, and at this title, Mr. [redacted] was indecisive as to which credit card he wanted to use to pay the balance, and said he would come down to the shop on April 14, 2014 to pay the balance. 
On April 13th, 2014, as I was looking outside, I noticed that there was no radio in Mr. [redacted]. Mr. [redacted] drove it down to my shop, and left it in the driveway unsecured, as Mr. [redacted] had no doors on it to secure his vehicle. 1 did not look inside the vehicle prior to this time, but saw the box where a radio had been at one time. In the document signed by Mr. [redacted] (see attached document 2,) it does state that we are not responsible for loss due to theft. Sometime later, I asked my technician what type of radio II td been in the [redacted], and he said be had never seen a radio in the vehicle, only the hole where one had been, while he was working on it on Friday, April 11th. On June 27, Mr. [redacted] came into my shop, and upon questioning him on the type of radio that was in the [redacted], Mr. [redacted] changed his story at least three different times, 
stating at first it was an AMIFM radio, then stating AM/FM radio with cassette player, and then kMIFM radio with disc player. Mr. [redacted] then advised it was just a cheap [redacted] Radio. 
On the 1 46 of April, Mr. [redacted] came into the office and wondered if we could get the price down for the repairs. We renegotiated it to $5,762.53. Part of this renegotiation [redacted] 
[redacted] would pay the full amount by April 16th• in order to get a reduction on the cost of the par, and Mr. [redacted] also agreed that he would pay for the job in cash. 
Mr. [redacted] did not come back on April 16th as promised, and the $1,500.00 Mr. [redacted] had give me did 
not even come close to the amount of the parts, let alone the labor, for these changes and repair:, Mr. [redacted] had agreed upon. Mr. [redacted] finally wandered in on April 30th, when I was out on a tow, and at hat time, Mr. [redacted] gave my secretary $2,000.00 which was applied to his account. This was still not the full amount Mr. [redacted] had promised to pay on April 16th, in order to get the full discount from the $7,350.01 to the 
S5,762.53. 
On May 16th, Mr. [redacted] came into the shop, showing me pictures of another [redacted] he had found sc'mewhere in [redacted] and Mr. [redacted] wanted me to change the whole negotiating again, for a third time. At this time, Mr. [redacted] wanted to order a complete G2 axle and gear assembly which Mr. [redacted] wanted installed into his [redacted] so he could trade his for this other [redacted]. (See picture number 5, which Mr. [redacted] gave to ne). I told him to buy the axle assembly and we would install it. After the axle and gear assembly arrived, depending

 on what we had to do, we could figure out the cost of installation depending on what had to be done complete the job. 
On May 30. 2014, Mr. [redacted] arrived at the shop again. Mr. [redacted] did not have a rear axle assembly. Mr. [redacted] then demanded we take it over to Flaming Gorge Auto at our expense, and refund all his money. This occurred at the end of the day on May 30, 2014, and I told him to come back on the following 
Monday, which would have been June 2nd, 2014. 
Mr. [redacted] did not come back on the 2", but did come back on June 3"1, 2014, At that time, I presmied him with my bill for the work that had been done and for inside and outside storage of his [redacted], whi ch occurred while we were waiting for his agreed upon funds. 
Please see attached copy of document #2 where Mr. [redacted] signed to have work done, where Mr. [redacted] signed for agreed upon payment schedule, and the receipt of his payment of the $1,500.00. Also signed receipt (document #4) for payment of $2,000.00, dated April 30, 2014. This was not the amount of reed upon nor the date agreed upon for payment_ Also note document number 1, which is not signed by Mr. [redacted], which was the original estimate for the repair of his vehicle. It had been agreed upon by [redacted] for paying the $1,500.00 down. Also please note in the upper left hand corner of the invoice that Mr. [redacted] signed, the provisions he was authorizing. 
Inside and outside storage was charged on this vehicle, due to the following reasons. Mr. [redacted] insisted the vehicle be stored inside after his "loss" of the unknown brand or type of radio that was "suppo >edly" taken while in our driveway while his vehicle had no doors in order to secure it_ Mr. [redacted] was also 
charged storage as Mr. [redacted] never fulfilled his agreement to pay for the job when agreed upon a 3 you can see on invoices 1-4. Also storage was charged, and is continuing as Mr. [redacted] has not paid full payment and the vehicle still sits in our storage area. (We have now moved the vehicle into our fenced-in c utside storage area due to him not deciding to pay the complete bill nor finish the job that he agreed upon.) 
His requests are totally unrealistic. Mr. [redacted] signed the invoice stating we were not responsible for his loss due to theft, especially since Mr. [redacted] did not have any way of securing his vehicle as then: were no doors on it. (See pictures 2 & 4). Mr. [redacted] needs to pay for the work that was performed, as we II as the storage fees in full that Mr. [redacted] has accrued since Mr. [redacted] brought the vehicle in and did not fulfill his agreement of the payment schedules. The reason the vehicle has sat for so long was due to his 
procrastination in paying the amount agreed upon. NO COMPENENTS were damaged or destroyed by our technician. The only thing that possibly had some damage was the part Mr. [redacted] had inappropriately 
welded onto the differential, which had to be removed by a disc grinder, in order to make any repairs. (See pictures I & 3, which show no damage to these parts he had welded.) Mr. [redacted] has also left the [redacted] 
sitting at our facility through this date, which has accrued additional storage charges.

These pictures, especially on picture number 1, shows where a disc grinder was used to remove ,rather than a "torch" as Mr. [redacted] put in his letter.
