Regarding the compliant 10190581 and the response we provided back to the Revdex.com on September 4, 2014, we can provide the following additional information.
 
The person/company making the compliant acknowledges that they signed contract for the service in question through one of our resellers. That contract included a fee for terminating the service. They last used the service on 5/24/2014 but did not terminate until 8/22/2014. If they would have terminated on 5/24/2014 they would not have been charged our active client fees, but they would still have been charged the termination fee. The signature that the person making the complaint seeks as proof would be available from the reseller that they contracted with originally and is further reinforced with our service web site that they were required to log into anytime they used the site. We conducted our business with this company in accordance with the terms of the contract that they signed and find the compliant to be unwarranted.

Review: I signed up with Heartland Payment Processing back in 2011. The check processing portion of my merchant account was transferred to transmodus without my knowledge. Everything was fine until recently when I called Heartland to close my account in May. First they did not tell me that I needed to call transmodus to close the check processing portion. After noticing I was still being billed a $50 fee from transmodus I called to see why my account had not been closed. Upon calling trandmodus they advised me that they were no longer with Heartland and that I would have had to call them to close my account. This did not bother me, because it's not their fault that heartland didn't tell me. What did bother me is that they require a $295 cancellation fee. That I never agreed to originally. After telling their rep about this I was told I would be sent the terms and conditions, which it turns out are on their web site when you log in. Since I had already had an account with heartland and a contract with them I assumed that the terms and conditions pertained to the website itself. I was unaware I was signing a new contract that automatically renewed every year with out a 60 day notice of cancellation before the contract ended. This is very sneaky and underhanded. Why would there be a cancellation fee? I don't have any equipment owned by transmodus in fact I purchased the equipment from heartland to avoid this exact thing. Transmodus is taking advantage of the fact that no one really reads terms and conditions on websites. Like I said before sneaky and underhanded. I feel swindled by a company I never really even knowingly signed up with. In fact I didn't even know that Heartland and Transmodus where two different companies.Upon further investigation I found out that I had contacted transmodus about my cancellation and even emailed them a written cancellation letter.Desired Settlement: I would like the $295 cancellation fee refunded and any monthly charges since 5/21/2014 refunded
