Ms. [redacted]’s came to Travelers Haven looking for short term housing in a market with limited availability. It was challenging for our team to find many housing available during the dates Ms. [redacted] requested, in the location she wanted, and within her budget, however we shared this unit...
with her as a possible option. Ms. [redacted] signed the attached occupancy agreement for the unit on 9/26/2017. Simultaneously, and in reliance of Ms. [redacted]’s commitment of renting the unit as evidenced by her signed occupancy agreement, Travelers Haven signed a lease with the property owner. Ms. [redacted]’s first complaint to Travelers Haven was that she would have to pay $1,901.61 upon move-in on October 13, 2017 (which includes prorated rent for October, the security deposit, and move-in fees as defined in the occupancy agreement) and that she would also have to pay November rent on the first of that month. After signing the occupancy agreement, Ms. [redacted] communicated that she could not afford the terms set by the contractual agreement she had agreed to. When Ms. [redacted] informed us she did not want to honor her signed agreement, we had our Contract Specialist reach out to the owner of the unit to find out if he would allow Travelers Haven to terminate the lease we signed with the property owner. Travelers Haven was able to negotiate an early termination on behalf of Ms. [redacted]. When we informed Ms. [redacted] that she could terminate the occupancy agreement contract by paying a $4,000.00 fee, she filed this complaint with your office as well as with the [redacted] State Attorney General’s Office. The $4,000 termination fee is a $3,500 reduction from the original contact’s total amount due. Contractually, Ms. [redacted] signed a lease agreement that obligated her to pay the rent for the full term of the lease. Travelers Haven offered this early termination option to Ms. [redacted] as a courtesy and as a way for her to get out of the occupancy agreement at a lower amount than she originally contracted for, even though Section 6 of the occupancy agreement does not allow for early termination. Travelers Haven incurred real costs on behalf of Ms. [redacted] when we paid the property owner the negotiated early termination fee. Accordingly, Travelers Haven was requesting that Ms. [redacted] compensate us for the costs incurred on her behalf. Additionally, as a sign of good-faith towards Ms. [redacted], Travelers Haven is willing to waive all applicable late fees and interest that we would otherwise be entitled to pursuant to the occupancy agreement. The occupancy agreement that Ms. [redacted] signed clearly indicated utilities and services that are included or excluded, the monthly rental amount, details on how rent payments would be invoiced, and how prorated rent would be due if she were to move in mid-month. The contract also explains Travelers Haven’s policies on default and early termination. Ms [redacted]’s account has been in default, recently closed, and sent to collections.
