On Saturday, January 12, 2019 we attended an advertised estate sale on South Broad St., Philadelphia, managed by the co-owner of Treasure Me. We bought several items and inquired about a crystal chandelier that was tagged for sale. if we purchased it, we were told we needed to secure an electrician to assist with removal before Tuesday because the house sale was scheduled for closure then. We left and returned later to find the chandelier for sale at a reduced price. While in co-owner's presence we placed several calls to an electrician. Prior to making payment, we asked that the homeowner was called so that we could work out logistics for the removal of the light on Sunday. He did so and informed us the homeowner agreed to the sale and was apprised we would be in contact later in the day. We paid cash for the chandelier, were given a receipt marked paid in full and a contact number for the homeowner. At Treasure Me’s suggestion we removed several crystals to make removal and transport easier. When we contacted the homeowner to let her know we had an electrician for Sunday, she informed us that neither she nor her son was available. She also stated that the sale of the house was postponed due to the government shut down and that she would contact Treasure Mel and get back to us to make alternate arrangements. We received no call back so we called TM that evening to apprise them of the situation and to ask for assistance facilitating the timing of the removal the chandelier. He returned the call Sunday morning; expressing surprise the owners would not give us entry. He said he had a signed contract with the house owners to sell its contents, including the chandelier. He said he would speak to the Executor of the Estate and get back to us. He called back to say that the executor of the estate did not want to sell us the chandelier and would return our money in exchange for the crystals we had removed and that he would extend us a $100 credit at a future sale.

We sold a chandelier on behalf of our clients. The customer paid $100. It turns out the client was erroneous on authorizing the sale of the chandelier and that it belongs to the new home owner. The settlement of the home is coming up in just a few days and we simply cannot go into someone's home and remove their chandelier. We have no recourse but to offer a sincere apology and a refund, which we have offered. We also offered a store credit on top of the refund. We would simply need the crystals from the chandelier back, as we cannot offer a full refund when the customer has already secured part of the merchandise. We also have an alternate proposal for a resolution which would be: the customer keep the crystals they have from the chandelier and we will offer a $100 refund (and no store credit). Last I spoke to the customer they declined my offer of a refund

I am rejecting this response because:

As per our Friday call, I am writing to request the matter referenced below is reopened. We do not feel the issue has not been satisfactorily resolved. Had the owner not been called and authorized the procurement of the chandelier at the point of sale, perhaps we would feel differently. As it stands, we believe the purchase to have been legitimate and what we really want is the chandelier. Since Treasure Me Estate Sale does not appear willing to negotiate this on our behalf, we are prepared to accept their offer to simply return our money. Obviously, this is not the outcome we had hoped for and continue to believe our interests have not been fairly represented by Treasure Me Estates. Moreover, we do not have faith in their ability to avail us of a comparable product in the foreseeable future and have no interest in waiting for an opportunity for which there is no guarantee. Furthermore, we were not made aware of the offer to return our money, without conditions, until Treasure Me Estates responded to our complaint to the Revdex.com. It was not an offer that was extended directly to us. Please advise as to what steps are necessary to finally resolve this complaint. Sincerely, ***

We are mailing a check for a full refund. Unfortunately, we found ourselves contractually obligated to let the client keep their chandelier. We had no way of resolving this other than a refund as the home transferred ownership and the chandelier now has a new owner. We apologize profusely to the customer and are glad to resolve it best we can with a full refund.
