Review: I purchased a software program from this company that was to work with 2(two) bowling leagues. At the time of purchase my wife was only the secretary for one league, but the software was for 2 leagues at no charge and then an additional 2 leagues for $10 each. Now that we are attempting to add a second league the company does not want to give me what I paid for and wants to charge me for the additional league. They said in an email that the names of the leagues are required, but it does not say at the time of purchase.Desired Settlement: I want the second league added an no additional cost since that is what I paid for. If they don't want to do that then they can refund my entire purchase and I will go with another software.

Response:

It needs to be mentioned that the order in question was placed online on May 13, 2013, and the registered user is [redacted]. We assume the order was placed by [redacted]. The credit card information is for [redacted]. We have never talked to either person, all communications have been over the internet and the order placed online.

This order of May 13, 2013 was placed on our website which is treasuresoflware.com .

See Exhibit A. One important thing to note is that this is a “New Product” and thus is ordered under “New Product - Order a new Perfect Secretary ...See Exhibit B. On May 13, 2013 [redacted] chose to purchase the Perfect Secretary Version 2013, 4 thru 16 team version for $99.90. An additional very important thing to note as listed at the top of the Secure Order Form under the heading stating Select product it states “If you are a first time customer, use this form to place your order.” See Exhibit C. Also directly above the listing of the league name section note the statement clearly stating “League names are required for 16, 24, 32, 48 versions.” See Exhibit C. The one league name listed on this order was “Monday Night Summer Mixed”. No additional league names were listed on this “New Product” order.

As clearly stated on the case #9658017 - “At the time of purchase my wife was only the secretary for one league”. Exhibit D. Thus [redacted] did not have a second league on May 13, 2013 to fill in a second league name. Unfortunate or changing circumstances on [redacted]’s part, do not make Treasure Software at fault or responsible for those circumstances.

IMPORTANT: Any business has the right to offer special promotions for a “New Product” purchase. That is exactly what we do with the pricing on additional leagues at the time the “New Product - Order a New Product” - “If you are a first time customer, use this form to place your order” is placed.

To handle the situation of adding a new second league name on the current version of Perfect Secretary as a REPEAT registered user, that is handled on our website under the “Change” section. An important note is that we have moved on to the next version of Perfect Secretary called Version 2014. So the Change section now as of July 30, 2013 clearly states: “Changes - make changes to my Perfect Secretary 2014 (.... Add a New League). “ See Exhibit E. [redacted] does not have this Version 2014 of the Perfect Secretary. If Ms. [redacted] had the current version of Perfect Secretary Version 2014, this would be the section to Add a new League.

To handle the situation of adding a new second league name as a REPEAT registered user on our website of a Prior Version of Perfect Secretary 2013 and earlier, that is handled under the “Upgrade” section. [redacted] has Perfect Secretary 2013, thus this is the correct section for her to upgrade to the current 2014 and add a second league. See Exhibit F & G.

We gave [redacted]/([redacted]) her options in several emails in which we have corresponded with them on. Copies of the emails and the response emails from [redacted] are enclosed for your viewing. Please read all of them. Many of the statements by [redacted] are “over the top” demanding and unreasonable (not what any other customer has received at the price he demands) in our opinion. See Exhibit H.

It would appear to us that apparently Mr. [redacted] is trying to intimidate and bully his way into getting free or reduced priced products from Treasure Software. It is very transparent to us and we hope that the Revdex.com can see through this.

The Perfect Secretary comes with a policy that the user can evaluate the software for a maximum period of 30 days from the date of purchase. After 30 days the software stops. The user can activate the Perfect Secretary to the full operating version at any time during that first 30 days, at which time the software can no longer be returned for a refund. [redacted] activated the Perfect Secretary on June 9, 2013 at 5:56 pm.

It should be noted that [redacted] has already used the Perfect Secretary for each of the twelve weeks - Monday Night Summer Mixed bowling league from May 13, 2013 through August 5, 2013. The results for each of the twelve weeks were posted online at bowl.com. Copies of the weekly reports for all twelve weeks are included for your viewing. Perhaps [redacted] is trying to get a Full Refund for the Perfect Secretary after [redacted] used it for the entire twelve week summer league that just ended on August 5, 2015 (see the report for Week 12 of Week 12 for August 5, 2015). See Exhibit I.

In two separate emails, there was a request for a Full Refund made by [redacted] on August 6, 2013 (See Exhibit J) and again on August 7, 2013 (See Exhibit K).

Even though [redacted] has activated the Perfect Secretary and it has been over 90 days since purchase, and she has already used it for a twelve week summer league, we offered her a Full Refund via email on August 8, 2013- See Exhibit L.

This refund offer was very generous on our part. We certainly were not required to make any refund offer, over 90 days after the purchase on a computer software product that we have proved was used by [redacted] for 12 weeks on a summer league. On that last email of August 8, 2013 we offered [redacted] a FULL REFUND as long as all of the steps listed were completed. These steps include Deactivation of the Software; Uninstall of the Software; and Completion of the Affidavit of Deactivation, Un-Installation and Non-Use of the Software. See Exhibit M.

As that Affidavit states we will confirm that the software has been deactivated after the completed Affidavit is received, before the refund will be made. We can verify from our office that the software has in fact been deactivated. Of course it is only reasonable that the software can NOT continued to be used, if a customer is to receive a refund. As stated on the email this offer was good for one week through August 15, 2013.

To date we have not received the signed Affidavit and the software has not been deactivated. We find the fact that the full refund offer has not been accepted by [redacted] very odd, as this is what he wanted. Please note the “desired settlement” statement as listed on your case # 9658017. See Exhibit D.

The Problem Occurred date is listed as August 4, 2013 and the Revdex.com cover letter is dated August 9, 2013. [redacted] requested a full refund on August 6 & 7, 2013. So this whole case is probably a mute point as the full refund offer was made on August 8, 2013.

Summary: Mr. [redacted] is trying to get a second league for free, more than 90 days after the fact of a “New Product - First Time Customer” purchase placed in May of 2013. A second order for a Repeat Customer would go through all of our same departments -(sales to write up the order, credit card charging, uploading, and then email confirmation with license id & password information) as [redacted]’s “New Product” order did in May 2013 and take just as much labor and time for the second order as it took for the original order. Our website clearly handles adding a second league after the fact of the original purchase, in the “Changes” for a current version or “Upgrade” for a previous version as described above for an additional charge. [redacted] has clearly already used the Perfect Secretary Version 2013 product for a twelve week summer league. [redacted] requested a full refund on August 6th and 7ttvia email. A generous and definitely not required, well after the normal 30 day Refund Policy has expired, Full Refund offer was made on August 8, 2013 asking for the software to be deactivated, uninstalled, & completed Affidavit to be returned to us by August 15, 2013. To date we have not received the completed Affidavit and the software has not been deactivated.

ft should be noted that Treasure Software has been selling the Perfect Secretary since the summer of 1988. I am sure you can check the Revdex.com records, or in our case the lack thereof, on our business. We feel that our online order is clearly marked by listing the wording of “New Product - Order a New Product” and “If you are a first time customer, use this form to place your order” and “League names are required for 16, 24, 32, 48 versions.” We have had the same Order Online wording for several years and we have never had a problem.
