After reading the statement my Mr***, I find there are deviations from what I know to be the facts Mr [redacted] lives at [redacted] ***, which is a busy thoroughfare with heavy traffic Given its heavy use by many travelers the city plows that street often The city plows onto the sidewalks throughout all of Yale so given the kind of winter we have had the City of Nampa has piled on quite a lot of snow onto the sidewalk not only in front of the property I manage but also all other areas where the plow passes I have been in contact with the City of Nampa and am aware of my responsibility to shovel the sidewalk if a complaint is filed, since they work on a complaint based system They have informed me that they would drive by the property and assess not only my property but all others as they understand that there are snow related issues throughout Idaho currently The problem with Mr [redacted] complaining about the sidewalk in front of his house is very simply that he does not use it or need it to get in or out of his house Lastly with regards to the sidewalks, this issue has only been recently brought up by Mr*** Mr***’s original complaint was the walkways around his house and his driveway directly in front of his front door Given the layout of the property Mr [redacted] does not use the walkways around his house because once he steps down from his stairs he is at his driveway On December 15, 2016, I personally did shovel the walkways around the house since I had a new tenant moving into an apartment in the back that had just been remodeled If needed when a new tenant moves in, we do clean up the areas around the apartment so they can move in without obstruction I also informed Mr [redacted] that we would not continue to do this and it was done as a courtesy On January 3, 2017, Mr [redacted] sent me a message again telling me what my responsibilities were and that I had to shovel his driveway and threatened me that he would be getting an attorney I informed him at that time that it was his responsibility to shovel his own driveway just as everyone else does After a night of heavy snowfall on January 4, I sent him a message that considering the excessive snow, as a courtesy, I would send someone out to shovel his driveway and walkwaysMr***’s response was for me to send someone out that morning I told him I couldn’t guarantee morning but that we would do it that day The very next day Mr [redacted] messages me again demanding me send people out again because he and his girlfriend had not move their cars and he needed it done again with the cars moved I called him and told him that I would not be sending people out again and that he should have moved the cars the day before so they could have done the entire driveway This conversation with Mr [redacted] set off a chain of events from him by where he indicated he would be seeking legal counsel, contact the City of Nampa, contact your organization etc Mr [redacted] has gone as far as to contact the property owners about the issue of his driveway Since I took over management of this property Mr [redacted] has called made several maintenance related calls to our office all of which were handled in a timely manner Mr***’s has gone as far as complimenting how our response was much better that the “previous management company” and how professional our maintenance tech was Most recently on January 6, he delivered to us a letter requesting some items to be fixed at his house which we did at the first available time he allowed us to Mr***’s request for payment will not be met, nor a written apology from me, only because I don’t feel I We have a very short amount of time left on his lease for which we are likely both happy I have been very cordial and professional with Mr [redacted] the fact that I told him I would not shovel his driveway does not constitute that I was being rude I apologize for the length of this letter but felt compelled to give a detail account of the facts given my professional reputation was in question Please feel free to contact me directly should you need additional information I can be reached directly at 208/869-

It is very clean that Mr*** and I have different views on the interpretation of the contract and my compliance with city ordinance. Without re-hashing the entire incident I will focus on a few key points of contention
1. The contract Mr*** references does not state anything regarding snow removal, and refers only to lawn maintenance which we have done in accordance to the contract. The driveway Mr*** uses is only used by Mr*** and his roommate so it is not even shared by other tenants
2. I have never implied that snow removal was part of my responsibility and I have addressed the fact that I did remove snow from the property walkways because there had been construction there on the back unit. I then did clear it again as a courtesy to Mr*** and to try to maintain good relations with him and did inform him that this would not continue
3. I disagree with Mr*** regarding how I have treated him and responded to him as addressed in my previous letter. I feel I have treated Mr*** the same way he has treated me, and in no way, has my intention been to demean or belittle him. I have only known Mr*** a very short time, and his negative perception of me only has come about because I told him we could not shovel snow for him which he can do
4. Mr*** would not know how I treat other tenants since he and I have only done business together a few months and likely does not know any of my other tenants.
While I am disappointed about this incident, I think Mr*** has made the best decision for everyone to rent elsewhere. I wish him luck in the future

Complaint: ***
I reject MrS***’s response to my complaint for the following reasons:
I appreciate MrS*** responding to my complaint. However most of his response is simply untrue. It was my hope that in reading my complaint he would better understand the dilemmas that I as well as the other tenants are having while residing at ** ** *** *** ***. However it seems that he is not willing to maintain this property in accordance with our contract or even comply with Nampa city’s snow removal code and ordinance.
MrS*** is responsible for the removal of snow and ice from this Triplex as it is implied in the contract. MrS*** stated that it is the tenants’ responsibility to remove this snow, this is simply not true. 1) The contract states that the property management company is to maintain ALL landscape and outdoor maintenance with the exception of each tenant’s trash, while snow removal is not specifically stated this is implied 2) All areas of the Triplex are jointly used and would be considered community property, there are no assigned parking areas and we all share driveways, how is the property management to hold one tenant responsible? 3) Walkways are to be kept clear of snow and ice, nowhere does it say that this would depend on how often these walkways are usedI also question MrS***’s ability to know how often these walkways would be used by the property’s tenants or others coming onto the property including delivery persons4) after the first snowfall of the season MrS*** or one of his employees did come and clear the property of snow, this was done without contact which shows me that he was fully aware of his responsibilities, but then he failed to do any further clearing until contacted at which time he came and cleared the property, however during this conversation MrS*** became defensive and argumentative. He never came again to clear the property. He clearly lacks the desire to maintain the property for which there are paying tenantsThese tenants all had difficulty in their access to and from their units due to the lack of removal of snow and ice and several also had damage caused to their vehicles from the snow and ice. When I called to discuss these issues with MrS*** it was he who became elevated and uncooperative and told me that he will never remove snow and/or ice from this property at any time
MrS*** has been known to speak with several of his tenants in a hostile manner, he also belittles and demeans them. Since this incident I have made the decision to rent elsewhere which will cost me money I do not have as I will be forced to pay the last month’s rent at the Yale unit if he cannot find a new tenant for February, but I simply cannot continue to rent from a company that fails to uphold their responsibilities and speaks to their tenants in such a manner. I hope that MrS*** will reflect upon his treatment of paying tenants and hope that in the future he learns to treat people with respect and kindness, keeps a level of professionalism and keep his properties in a safe manner for all who reside or visit there
