We were hired by the City of [redacted] to complete work on city parkway property. We have never completed work for this person...

or even been in per private property. Mrs. [redacted] did contact us about the supposed damage. Her claim was immediately forwarded to our insurance company for them to handle. After review by an independent insurance adjuster, the adjuster & our insurance company determined the damage on her private property had nothing to do with any work we completed for the City and the claim was closed.

The response is merely a re-iteration of the chosen bad faith practice to not pay on a claim. I have even asked for details of the supposed "investigation" that was done, and did not receive a response. To simply ignore / discount the witness (who had nothing to lose or gain by reporting what he saw)is simply not legitimate. As per the statement that Trees 'R Us personnel were never in/on my "private property", I find that impossible to believe, because the parkway tree that was removed had limbs extending so far over my front lawn that they were dangerously close to touching the front of my house. Even the Township arborist had to trim them away from my house a time or two over the years!! And the Electric company was made well aware of the problem, as the limbs overhanging the service line running from the parkway to the house were reaching a point of making contact with the service line. The point is that the equipment used to remove these HUGE and LONG limbs had to have hovered over my "private property" lawn and "private property" stairway in order to remove these limbs and further "de-construct" the parkway tree. And the visual huge and deep divet on the lawn, leading toward and over the area of damage to the stairway, clearly showed where a limb (or part of a limb) had been dropped. Just because my witness doesn't have a video of the actual occurrence doesn't mean there isn't plenty of circumstantial evidence that supports what happened especially considering that the witness observed perfectly fine condition of the property that day before the tree removal began, followed by the huge lawn divet and broken stairs within a short time after the removal of the top portion of the tree (this was at the point where quite a bit of trunk was left, to be removed at a later time).

Our company does not take damage lightly & we carry a large limit policy for the protec6on of our clients with an A rated company. There was a through investigation on this matter by our staff, village staff & insurance staff. All came to the same conclusion that the damage was not caused by our company. We cannot discount such an involved investigation & we respect the decision of our insurance carrier. We cannot discount several professional opinions on this matter. Our company will not just fix something because this homeowner wants to be a bully. We provided a service for the Village & just because this consumer can't go after them, she has turned to us. The Village & insurance company have closed this claim
