My husband and I are in a contract with *** Homes. Due to the COVID-19 I no longer had childcare which resulted in having to resign from my job. To make matters worse my husbands hours were drastically cut back making us unable to move forward with the purchase of our dream home.

Even more so we are unable to be financed through *** at this time. I was supposed to receive verbiage stating they are unable to give us our earnest back due to resigning. I have yet to receive this information as no where in the contract does it state we are not able to receive our earnest back. I'm aware we will not be receiving the full amount and that $495 will be held for an admin fee.

A gentleman by the name of Sean was supposed to contact me but never did instead another lady did.

Desired Outcome

Refund At this time due to unforeseen circumstances with this virus and our family truly needing our money back I am rightfully asking for our earnest to be returned.

Improper Drain Installation. Builder refused to fix it while it was under warranty. New builder not responding to claim. Issue is becoming worse.
On Jan 2017 I purchased a new home through Dunhill homes. Within the first week we received some rain and I noticed a big pool of water was just sitting in my driveway due to the uneven concrete Dunhill poured when building my home. My uneven driveway then turns into a slope, creating a 2nd pool in front of my garage, where the water just sits untill it evaporates. I contacted Dunhill Homes via their website under warranty request.
When they called me back and I explained to them the issue I was having they told me "As long as the water drains within 48 hours you have nothing to worry about".
Over the next several months I would reach out to them, several more times, with the same issue. Because I knew it was a real issue and would eventually lead to foundation issues, if left unrepaired. However, Dunhill would give me the same response each time "As long as the water drains within 48hours you have nothing to worry about"
Well two years later my backyard is now becoming a swamp due to Dunhill's poor drainage system, and the front of my driveway is becoming a deeper pool everytime it rains now.
I have video to support my claims and it is terrifying, and unsettling to see a river flow from the front of my house all the way through my backyard. I can't even sleep at night anymore because I know its just a matter of time that my home's foundation will be compromised due to the poor drainage by dunhill. Water also appears to be penetrating the front of my home, behind the gutter, on the side of the garage.
I have also reached out to Trendmaker Homes who have bought out Dunhill Homes in regard to this issue however they have yet respond to 2 of my claims.

Desired Outcome

I am requesting that this issue be resolved once and for all before it gets even worse. I need a drainage system that directs the water away from house and onto to the street & I also need the slope in my driveway corrected ASAP.

This home was delivered with adequate drainage. Property has been inspected multiple times after rainfall and each time there is adequate drainage at time of inspection.

My home was not delivered with "Adequate Drainage" that's absolutely false. Because Adequate Drainage ensures removal of excess surface water and sub-surface water through the process of proper draining. However, you can clearly see in my pictures which I've attached, that the water is not draining at all, it just floods and sits in the front of my garage driveway where nowhere to go. This will eventually compromise my foundation it's just a matter of time. And my backyard becomes a river, please see attachment. I also have all of this on video, when it rains my house literally turns into a Creek/River. I want this fixed ASAP. I've been complaining about this since I bought this house and it's only getting worse as you guys refuse to correct the issue. It's evident the front of my home needs a French Drain. My neighbors house doesn't do this, so why does mine? I want this issues corrected once and for all.

I submitted warranty requests when my house was under one year warranty and it has been a long time and issues are not fixed.
I have submitted warranty requests for my home right before my one year warranty expiration and they have not been fixed yet. I called multiple times about the request but all I get is we will call back but I never received any call

I want those warranty requests to be taken care of ASAP. I am tired of calling them about these requests

Homeowner has no outstanding warranty requests at this time. All items submitted during 1st twelve month warranty were inspected and all warrantable items were completed. There is an active review of drainage in the community and this home is on the list for evaluation, but has yet to be inspected due to the current weather patterns and excessive rainfall.

The warranty tickets I am talking about is not related to drainage. I submitted a ticket for squeaking floor which is not addressed. I am very disappointed in the service provided by Dunhill Homes. Even though they are taken over by Trend Maker Homes they should do a due diligence in keeping a customer happy. The fact that they are trying to cover up my warranty request is disgusting. Firstly I had to follow up multiple times on the requests and some of the requests are not even taken care of. And now they are boasting that I don't have any requests open. This is ridiculous. I also have attached a email which I sent over to dunhill reminding the warranty request before my warranty expired. Attached the copy of the same. I would rate them the lowest of all the builders. If you have any conscience you should stand by the one year warranty claim. I will take any legal action required to get my warranty claim fixed.

04/18/2018 warranty request was made for a master toilet not flushing properly and a floor squeak in game room. Plumber was sent to address toilet.The floor squeak was investigated and could not be found at time of inspection, and it was determined there was no issue.
5/23/XXXX Xrd party inspection was performed at home and no mention of floor squeak in report.

It is a wrong statement that "The floor squeak was investigated and could not be found at time of inspection". The Representative from builder came and checked and did acknowledge that there was squeaking floor and told that he would send out somebody to inspect it further but nobody showed up. It was bothering for a while before warranty expired but wanted to submit all the warranty requests together at the end.

This was not included by the inspection company in the report because they only added any structural issues in the report and this was more of a non-structural issue but something that was not expected in a new home.

This was submitted before warranty expired and there was no professional evaluation of the warranty request and nothing was done to fix it after the request. I still have the issue and want this to be fixed as it was reported before warranty expired.

My experience with Dunhill Homes was a total of three weeks before I requested my earnest money back. As a retired veteran and new to the area, my family and I were living in a hotel room for a month and we needed a home. We chose a spec home with Dunhill Homes that was 'ready? and had the inspection two days after contract. The inspector found multiple issues with the home that needed to be addressed on the exterior structure and interior of the home. However, the home sat until a week before closing to address the repairs needed. Three days before the closing date was the first meeting with the builder. At this time, the issues still needed to be addressed from the inspection and buyer walk list. In particular, several of the interior/exterior doors of the home were damaged and missing large chunks of wood. Betsy Webb from the Dunhill Homes model home called me after she received the buyer walk list and shared with me that, 'Great news! We will be replacing your doors!', I asked which doors and she explained, 'All of the ones you requested on the buyer walk list'. However, the doors were not replaced and Dunhill Homes proceeded to repair over multiple previous repairs. This was one of many issues that was promised and never addressed. At the final buyer walk, the home had damage to the driveway, roof/structural issues, and many cosmetic issues where Dunhill Homes cut corners (e.g., using a Sharpie black marker to paint the wrought iron stairs/exterior fence where workers damaged it, using a white crayon to repair holes in the cabinets, covering up graffiti on the interior of the home with paper vs removing it). We addressed our concerns that we were unhappy with the home to Betsy and the VP Margie two days before closing. Margie verified that, 'We cannot get there and make it to the closing date'. However, no new closing date was given and we asked for the earnest money to be returned to us since the product would not be ready as promised at closing and we needed a home d/t living in a hotel.

Refund We want our earnest money returned. For a veteran and his family to live in a one bedroom hotel room for a month while we waited for the home, Dunhill Homes could have offered to make things right by offering accommodations to assist in paying for our hotel and/or food while the home repairs were addressed or refund our earnest money as requested so that I could find a home that was ready for my family and I to move into. However, Dunhill Homes cancelled my contract but never returned the money.

The customer contracted to purchase the home (noted). During this process, the home is removed from the sale list to any other prospect. Dunhill Homes uses a "third-party" licensed inspector (not an employee) to evaluate every one of our homes, in addition to our own internal quality inspections and on top of the numerous municipality inspections. This home graded 90+ by the outside inspector putting it in the "exceptional" category.

WRT to recollections of conversations, Dunhill is very specific that verbal conversations should always be backed up in writing as different people recollect differently - that is why we rely on the contract and the design paperwork. In this case, the Dunhill employee's recollection of any conversations differ from the former customers and would have been completely out of character for any of the 350+ homes we build each year. Dunhill exercised the contract in which the customer forfeits the deposit if they refuse to close.

Dunhill did offer to recognize and reinstate the customer deposit towards a home should the customer wish to recontract prior to Dec 31st. Thus far, the customer has not used this option.

We are firm that all contractual measures were followed and the customer was treated respectfully throughout the process. I am personally disappointed that the customer would play the "veteran" card which has no bearing in this matter. As a 31 year veteran myself, it is disappointing when veterans use their former service for personal gain elsewhere - fortunately, it does not happen that often.

I did not cancel my contract with Dunhill Homes. In a meeting with my realtor, VP Margie stated that we would not close on our closing date due to the repairs needed to bring the home to a quality living standard. Dunhill Homes VP Margie, sales manager Betsy Webb, construction manager Arnold, and president *** Rodriguez all stated that clearly there were mistakes made with my home during the building process. At contract, Betsy Webb promised us that our concerns regarding the exterior/interior doors that were damaged would be replaced. However, Betsy now denies the promises that she made and Dunhill Homes will not hold her accountable for her actions. In my three week experience with Dunhill Homes, my family and I were living in a hotel room while we waited for our home to be ready at closing. As a disabled veteran, I lost time off from work to move my family to a hotel room because the spec home that was sitting for six months was not ready and did not pass *** I incurred additonal storage fees, hotel costs, an inspection fee, and an appraisal in which the home appraised for lower than expected. Betsy Webb, the sales manager, harassed my VA appraiser to get the inspection higher and when the VA did not change the amount, Betsy harassed my realtor and my wife and I for the additional money. If Dunhill Homes honors the military and its veterans, they should honor what the VA appraises the home at and keep their promises to the customer. My VA lender was also harassed by Betsy Webb when the VA did not feel that Dunhill Homes met the requirements for the higher appraisal. I am not confident that Dunhill Homes can build a quality built home that is safe for my family to live in and will pass reputable inspection. My inspection was by a third-party thst was reputable and the home did not pass *** due to structural deficiencies that were not addressed prior to closing. It is unacceptable and unfair for Dunhill Homes to retain my earnest money when they did not earn the right to do so. It is stated in Dunhill Homes contract that if the seller cancels the contract, the buyer is refunded the earnest money and this is the honorable expectation that is fair.

The purchase agreement states that if the seller terminated or cancels the contract then the buyer is refunded the earnest money. Dunhill Homes is not a reputable or respectable builder. Military families and veterans beware!!! Dunhill Homes did not pass third party inspection and their reputation speaks volumes when a refund of earnest money to a hard working disabled veteran who was living in a hotel with his family for over a month is denied. It is unfortunate and quite shocking that Dunhill Homes has numerous sites with bad reviews of unsettled claims, unhappy buyers, and failing to follow through with terms agreed upon by their employees, Betsy Webb and VP Margie, in my experience. To all prospective buyers, beware! Dunhill Homes has accepted a deal to operate under Trendsetter Homes because they do not have the capital to expand with recent low home sales. Unfortunately for Dunhill Homes, when you treat military customers as you have, the karma is the bad construction home you tried to sell my family sits available and rightfully so.

Drainage issue in back yard.
We closed on our new home in late May/early June 2016. Once we were in the home we began to notice we had a drainage issue in our back yard. When the sprinklers came on or it rained the middle of the yard was not draining and it was very soggy. There were also pools of water on the sides of the yard that would not drain. We contacted Nathan Carlisle numerous times before anyway responded via their website and also through the neighborhood office. At one point someone was sent out and installed a French drain beside the patio but that did not solve the problem. Again we contacted the office and didn't hear anything for weeks until we just kept filing complaints. We have been put off until a few months ago when they sent someone out who actually looked at the back yard. He then returned to the office and "reviewed" their paperwork only to tell us they had done everything that was required and there was nothing else they could do. We have had 2 landscapers out to do work in the back yard and the first comment they have is that we have a drainage issue, interesting. One comment that the representative from Nathan Carlisle made as he was leaving was "when you sign off of a house you assume everything is in order". That is correct but we had no way of knowing until we started living here and attempting to use the back yard that there was an issue. So, we are headed into our third year in our "new" home and we are still unable to use the back yard.

I should also advise that one of our neighbors had this same issue, took Nathan Carlisle to court and won. Three other neighbors are in a similar lawsuit for the same issue so it is not an isolated problem, we just cannot get the problem resolved and wanted to make others aware of the service/warranty issue we have experienced.

Desired Outcome

We want our back yard drainage issues resolved so that we and our family can use the back yard. It is ridiculous that we have paid for this new home but can't get off the patio because the yard is like a marsh.

A Nathan C/Dunhill Homes representative (Trey F) inspected the complaint in February 2018 and determined that the yard had proper drainage as confirmed in the final yard grade certificate. Our warranty for the first year covers standing water in drainage sw*** for 48 hours or more and within 10 feet of the foundation for 24 hours or more. We did not see that standing water is occurring. However, will send someone else out to inspect as a courtesy.

We do not accept the response from the business. I have photos that show puddles of water standing in the back yard and this is without any rain. The green pipes in the back yard, when we removed the rings, have water to the top of the pipe. There are electrical wires in these pipes and they are standing in water. We had no way of knowing this was an issue when we closed in June and we have been trying to get this resolved for 2 years. This isn't a new complaint, we have just had anyone take responsibility for the issue.

Jeff Eberle and I (Grayson W) met with Mrs. on Thursday, 4/19, and determined that the rear "horseshoe" drainage swale was not properly directing surface water flow to the side yard drainage swale and French drain. Nathan C Homes agreed to correct that drainage issue at our expense. We hope to make that repair in the next 10 days and we will let her know when the repair is scheduled. Mrs. agreed to that course of action.

I did meet with these gentlemen and they seem to be willing to resolve the problem. At this point, we are satisfied that will be done and appreciate all that they did to get this taken care of.

When I made it clear that I was not going to close escrow until Dunhill Homes fulfilled our contract honestly and accurately, they cancelled contract.
Last November I entered an agreement with Dunhill Homes to have a new home built in their Paloma Creek development in Little Elm, Texas. I had placed a deposit and flew to Texas to spend several hours to select all of the specifications for my home in person. As they began building my home, they repeatedly made mistakes without fixing them and outright ignored the specifications of our contract. They did not put the correct window in my master bedroom, which I paid an upgrade for, they did not screw and glue the floors, which is listed as an included feature on their Paloma Creek paperwork, and they did not provide all new fencing, which also was listed as an included feature. I went back to Texas multiple times to check on the progress of my home, and regularly had one of my future neighbors, a close friend, send me pictures of the construction. Multiple times I reminded my builder, Dustyn, that they needed to take care of the screws and glue, as well as the window in the master bathroom. He kept telling me that the screws and glue had been taken care of, and yet whenever my friend went over there, it was still untouched. After months of being clear with Dunhill Homes that I expected them to stay true to our contract, they ensured me that all was well and that it was time for my final walk-through so that I could close escrow. They still had not replaced the window or screwed and glued the floor. This is in addition to them leaving old, mismatched fencing on the North side of the property, and refusing to address the fact that there was a 12" vertical rise to the neighbor's property, leaving their fencing posts exposed. I emailed them after that wasted trip, making it clear what items needed to be taken care of before I could close escrow. They sent me an email five days later with some pictures of a couple small issues that they had taken care of. I expressed my gratitude that they were working with me and then asked when they were going to screw and glue the floor and replace the bathroom window, so that I can close escrow. They never responded to thatemail. Instead, days later, I got a call from their VP, Chris Hartley, who told me that they were going to cancel my contract because they could not "please me". Since they have sent me the cancellation letter, they have replaced the old fencing, and leveled out the yard so that there is no longer a 12" vertical rise. This makes it clear that they did not cancel because they could not please me, but instead decided to cancel my contract (that they had already broken in multiple ways) so that they could re-sell it to someone else, allowing them to reap the benefits of the equity that has accrued since I entered my agreement with them. What I have described of my complaint with them is brief in comparison to all the issues that have arisen over the past year. They went through 3 different framers on my home, as well as multiple builders. When the framing kept failing to pass inspection, they said that it's because their laborers could not read the blueprints. They did not have qualified builders on the job site for the most significant aspects of construction, thus requiring multiple tear-downs and delays. I have several emails documenting my complaints with them, and their lack of responses, as well as Dustyn's outright lies in regards to the flooring being screwed and glued. In spite of how their mistakes and avoidance have cost me money and time, I have patiently waited for them to do the right thing, by keeping true to our contract so that I can move into my new home and begin the process of moving by business from California to Texas. Instead, they unethically ripped it all away from me, a day after my wife and I signed our refinance loan. We had every intention of moving into this home, and did not have unrealistic expectations. They did not provide the work that they had promised, and when they realized that I was not going to let them, they cancelled.

Desired Outcome

Fulfill parameters of contract as previously addressed and complete sale of home to myself and my wife.

Dunhill Homes followed the Purchase Agreement via Paragraph #25 which is titled Seller's Option to Terminate. This paragraph was executed after it was determined that Mr. expectations were outside our business parameters. We thus exercised our right and returned the earnest deposit to Mr. in full. Paragraph #25 is shown below. Mr. signed the Purchase agreement.

SELLER'S OPTION TO TERMINATE: If for any reason a bona fide dispute should arise between Buyer and Seller prior to Closing and if such bona fide dispute cannot be resolved to their mutual satisfaction, Seller may terminate this Purchase Agreement by written notice to Buyer. If Seller elects to terminate under this section of the Purchase Agreement, Seller shall refund all of Buyer's earnest money deposits and payments for selections of options, and neither Buyer nor Seller shall have any further obligation or liability to the other party arising from this Purchase Agreement
If either party cancels this Contract as authorized by the terms hereof, Buyer shall have no further right, title or interest in or to the Property.

While we did sign the agreement that allows Dunhill to terminate our contract should they be unable to please us, our claim is that Dunhill Homes was perfectly capable of pleasing us, as they corrected all but one of our complaints within days of cancelling the contract.

The primary complaint that we had, was that their salesman, builder, and paperwork all promised us screwed and glued floors. We never got them. I was transparent and patient from the beginning, reminding Dunhill Homes about the flooring. They kept telling me that it had been taken care of. Only for me to find out that it had not. I have emails and text messages showing all the times I tried communicating with them so that we could move forward as planned, but I would go days without any response. In spite of this breach of trust, I kept working with Dunhill Homes, merely asking that they provide the work as promised.

We felt that they should screw the floor before closing escrow, as once we move in, it would be a huge inconvenience to have to move all of our furniture and stay out of the house so that they could then finally screw the flooring. We also asked them to build a retaining wall or re-grade the North side yard as the neighbor's property had a 12" vertical rise above our yard. They said that it was the developer's issue, not the builders. However, per paragraph 17 of our contract, were I to fix this problem myself, the limited warrantee listed in paragraph 23 would be completely voided.

FENCES, GRADING, AND DRAINAGE; OTHER CHANGES: Any such work conducted on the Property by Buyer may void and terminate the Limited Warranty provided by Selleer as described in Paragraph 23 as to any part of the Property affected, directly or indirectly, by such work. In addition, Buyer shall be responsible for any damage to other properties and the common areas that results from any such work.

They brought in 12" of dirt and re-graded within days of cancelling my contract, even though this was one of the reasons they used to justify cancelling our contract.

This whole interaction has been such a shock. As our final email to them was to thank them for working with us, while expressing our excitement for moving closer toward closing escrow, and asking one last time about whether they had screwed the floor. The next time they communicated with us was days later to notify us that they were cancelling our contract.

Per our standard features, Dunhill Homes did screw and glue the subfloors on the second floor of the home. This was completed before cancellation, however buyer did not believe that it was completed.

In regards to the rear drainage. The property met all code requirement for drainage. If a retaining wall was required for a positive drain flow it would have been required by the developer.

Buyer had expectations that could not be met by the builder. After each list was completed a new list would be submitted with new items that were never discussed. The home was built to meet all required codes.

Per the rights of the Seller, that the buyer had signed, contract was terminated.

In regards to my refusing to believe that the floors had been screwed and glued: I never decided to not believe them, when I was told that it had been taken care of. Instead, I was told through email and text, that the floors had been screwed and glued, only to find out later, that that was completely false. Then when I notified the builder the discrepancy, he would once again tell me that it would be taken care of, then would tell me within a couple days that he knew for certain that it had been taken care of. Then, once again, I would find out that it had not been taken care of. This whole process of my being lied to, and Dunhill's builder telling me over and over again that THIS time it actually had been taken care of repeated itself multiple times. At that point, I had no option other than to require confirmation from a superior that the floors had in fact been screwed and glued. I emailed all of the relevant parties about this issue, bringing to their attention that their builder was repeatedly lying and failing to address the issue and asking that one of his superiors take it upon themselves to resolve the issue. They NEVER ONCE replied to this issue. They never even acknowledged that I emailed them anything about the floors being screwed and glued or their builder lying. Instead, they would choose to reply to a couple minor issues from the email and then completely ignoring the major issues that I had been discussing FOR MONTHS. Their previous reply through this Revdex.com complaint, is the FIRST TIME I have received any confirmation from them that the floor has finally been screwed and glued.

In regards to their accusation that I kept creating new lists: Every issue that I wrote in my emails, up to the very last one I sent, addressed issues that I had personally discussed with Dunhill's builder both in person and via text messages. In the emails, on the rare occasion that they would respond, they would pick and choose which issues to acknowledge, requiring me to bring up the neglected issues in my next email response. My final email, that had an itemized list of issues, was a compilation of previously addressed issues, each of which had already been discussed between myself and their builder. The reason I had to write such a list, is because during our final walk-through, which solely serves the purpose of addressing any remaining issues with the house, their builder REFUSED to add those particular issues to his punch list. When I pointed them out to him, he would just nod his head and say that it would be taken care of. Upon seeing that he did not write them down, I asked him to do so, and he said he didn't need to because he had them on a list elsewhere. I told him I wanted them included on the final punch list so that it would be documented, but he wanted me to just take his word that these items would be taken care of, even though, as previously mentioned in this response, his word meant nothing. He refused to include these items on the punch list, and yet said they would be fixed, which then begs the question, why not write them on the list whose sole purpose is to ensure that all these issues are taken care of? I did not create new lists, I merely reminded Dunhill Homes, of pre-existing issues, that they never acknowledged in our email correspondence. Some of these items in that final email complaint that they deem too difficult to address, thus "justifying" them cancelling our contract: A broken window in the Master Bedroom, the Master bathroom window that I paid extra to be rain glass, and instead was obscured, a fence on one side of the property that was 3 different types of wood. I ask them, which of these issues in particular did they feel was too difficult to fix?

If Dunhill works with me, then I can lock in the current interest rate before it goes up again. I have been trying to work with them from the beginning.
