Review: Tri-Boro Paving installed a new asphalt driveway at my home. The business owner, [redacted], indicated his firm does superior work and always stands behind each job it performs. Regrettably, this has not turned out to be the case. The asphalt surface has developed deep depressions and cracks after cars have parked on the driveway for as little as a minute when temperatures reach or exceed approximately 80 degrees. In some areas, it appears as though the asphalt/aggregate mixture is tearing apart. The raised edges of the depressions, of which have created tripping hazards, have to be pounded with a piece of 4X4 timber and sledgehammer before the asphalt cools in order to minimize the risks and unsightliness. When I brought the matter to the attention of Mr. [redacted], he recommended that we "keep driving on it." We followed his advice and it only exacerbated the problem. When we last met a few months ago, he opined the asphalt could be defective and indicated he would check into obtaining a "core sample" from the material to confirm his suspicions. Needless to say, he never contacted us afterwards, including failing to respond to my phone call or letter. Subsequent to that meeting, I had representatives from two separate paving companies, as well as friends employed in the heavy-construction industry, inspect the driveway. Each of these individuals immediately indicated the problem was attributed to a defective batch of asphalt. They indicated the condition is rare, but it does happen.Desired Settlement: The representatives from the other paving firms indicated the only way to properly remedy the matter is to remove a two-inch surface layer of the defective material with a milling machine and repave the entire driveway with new asphalt. Based on Mr. [redacted] past actions and failure to honor his verbal promise by standing behind every job he does, my wife and I do not want his firm to perform the corrective work. We ask that he issue a draft to us immediately for the disputed amount so we can effect the repairs ourselves.
