Complaint: I am rejecting this response because the explanation is not accurate in that my original trade in was paid off to the lien holder, in this case, Honda FinancialAt that point, my name should no longer be a part of that vehicleI was told by this dealership that they do not put the trade in in their nameObviously to avoid a cost to themI spoke to three representatives from the California Department of Motor Vehicles and all three assured me the dealer needed to complete the required paperwork for both the trade in and the new motorcycleSince my complaint to you and your contacting this business, it's interesting how I just received my new plates in the mail for the Honda Glold WingThis was something I wanted completed in the first placeSecondly, I want them to complete, if they haven't already, all required paperwork taking my name off of the traded in motorcycle.? Regards, Paul Arnold I do not accept this businesses response to my complaintI spoke with three representatives of the California Department of Motor Vehicles who assured me they knew what they were talking aboutI was informed by them that until the dealer completed the required paperwork for the new purchase, I would not receive my new registration or platesInterestingly, after filing the complaint with you and the DMV, I received my new plates and registration a few days ago so something had to have motivated the dealer to send in the paperworkMy concern now is having my name taking of as the registered owner of the motorcycle I traded into TriCounty PowersportsAgain, the DMV informed me the dealer did not complete the paperwork which would have solved this problemI had asked the owner of the dealership to contact me asap to discuss the issue, but he failed to do soHe can tell you that the DMV is not knowledgeable about this all he wantsI was convinced by their representatives that they indeed we're knowledgable and well informedOne part of my complaint is rectified, not sure about the trade in motorcycle issue thoughIt seems to me that as a consumer, one should go to the experts for answersThe DMV are the experts in this matter, not a dealership that "forgets" to give me copies of documents I signed at their dealership during the transactions with them.?

I am familiar with MrA***'s concern and have tried my best to explain the sales and transfer of ownership regulations of a Motor Vehicle Dealer on two occasionsHe feels we are being deceitful in some fashion when in fact, there are explanations and standard practices for each of his concerns
Unfortunately when he contacts the DMV office and speaks with an employee that is unfamiliar with Vehicle Dealer Law he is getting mis-information about the guidelines that a dealer operates under compared to a private citizen saleHis report that we communicated to him that we “don’t have to turn in their required paperwork" and that we get "perks" with DMV show that he did not understand at all what I was trying to explain to him because he reduced that lengthy explanation (given again below) to those two phrases, can assure you we follow established DMV Motor Vehicle Dealer rules and regulations 100% of the timeI will again attempt to explain my years of DMV experience in a brief summary, here it goes:Purchase of the Honda Gold Wing ??" A delay in processing his registration occurred due to a wrong date on one of the DMV formsThis required MrA*** to return to the dealership and resign the document, which he didWe then filed his application with along with other customers in a bundleFrom that point on, assuming no corrections are needed, it's in DMV's hands as to when license plates and registrations/ titles are issuedA motor vehicle dealer has days to post fees (in essence make a deposit towards completing the transaction) and days to complete the transaction without fine to the dealer, Due to the incorrect date on the form, and having to resubmit the application this transaction took longer than days to complete and we paid the $penalty, During that time MrA*** was in possession of a temporary registration card so he could operate his new motorcycleThis temporary card does not have an expiration dateSo, yes this process had a delay but I believe is complete at this timeTrade in of used vehicle ??" The vehicle he traded in was owned by a lien holder that uses a paperless titling systemThis means that there is not a physical title in existence until the loan is paid off by the owner or in this case by the dealer that took it in on tradeOnce the lien holder receives payment they create a paper title for the vehicle as they did in this caseThe title would still have the previous owners name as registered owner and the Dealer Name as the new lien holderThe reason the registered owner is the same is because that is the person of record on the registration/title, The dealer is never the registered owner, instead, just a middle man (the very essence of being a vehicle dealer)The reason they put the dealers name on title as new lien holder is to protect the dealers' interest in the vehicle and guarantee title to them (since they were the ones that paid it off, not the registered owner)The generation of this new title would also auto-generate a rew registration that would be sent to the previous ownerThis was alarming to MrA*** but it is just a computer generated documentThe previous owner could then bring the document to the dealer, verify that a release of liability has been submitted and then turn the registration over to the dealer or simply destroy it, as I communicated to MrA***In some cases the previous owner may also receive a request for insurance from his insurance companyThis is a also a computer auto-generated document that his/her insurance company or DMV generates to remind the owner that a change on their insurance policy should be made, 1F they still own the vehicle, which in this case, MrA*** did notThe request to change lienholder information on the insurance policy can also be discarded.Once a vehicle is traded in to a California Motor Vehicle Dealer it is considered Dealer Inventory and is no longer the responsibility of the previous ownerWe put on our books and send in a release of liability in to DMV for the sellerWhen it is sold, the dealer will transfer the vehicle into the new owner's nameThese are the DMV laws we comply with and as you see they can be complexWhat has made them more so, is that computers are auto-generating notices that alarm customer's, and DMV clerks on the standard (non-Dealer) helplines are not familiar with the nuances of Motor Vehicle Dealer Law and can only see and communicate to a concerned customer what is on the screen in front of them.My apologies to MrA*** for the delay in processing his registration on his new vehicle due to a mis-dated application, He was made aware of the issue when the DMV returned the document after our first attempt to process and he had to return to re-signThis caused an approximate week delay.However, the manner in which we process trade ins pay-offs, transfers, titling, etcabides by all current DMV laws and regulations, MrA*** may not understand why it works the way it does, or even agree with these Motor Vehicle Dealer Laws, but it is how thousands of Dealer transactions are processed every day in the state of California.| hope this explanation helps and that MrA*** will consider removing the negative comments he has publicized about me and my dealership on social media at his earliest Convenience.Thank you for listening,P*** *** Tri-County Powersports

I am familiar with Mr. A[redacted]'s concern and have tried my best to explain the sales and transfer of ownership regulations of a Motor Vehicle Dealer on two occasions. I will again attempt to explain my 30 years of DMV experience in a brief summary, here it goes:1. Purchase of the 2015 Honda Gold Wing – A delay in processing his registration occurred due to a wrong date on one of the DMV forms. This required Mr. A[redacted] to return to the dealership and resign the document, which he did. We then filed his application with along with other customers in a bundle. From that point on, assuming no corrections are needed, it's in DMV's hands as to when license plates and registrations/ titles are issued. A motor vehicle dealer has 20 days to post fees (in essence make a deposit towards completing the transaction) and 40 days to complete the transaction without fine to the dealer, Due to the incorrect date on the form, and having to resubmit the application this transaction took longer than 40 days to complete and we paid the $10 penalty, During that time Mr. A[redacted] was in possession of a temporary registration card so he could operate his new motorcycle. This temporary card does not have an expiration date. So, yes this process had a delay but I believe is complete at this time.2. Trade in of used vehicle – The vehicle he traded in was owned by a lien holder that uses a paperless titling system.
