Tri County Towing and Transport

On December 18, [redacted] (Owner)agreed to transport my toolbox from Santa Cruz, CA. to Scotts Valley, CA. via a flatbed tow truck. He arrived at the location to load the tool box in [redacted] at approximately 10:00 A.M. The weather was cloudy, but no rain. He load the tool box and headed to Scotts Valley by way of Ocean Avenue to Highway 17 north. I was the lead vehicle in my 2004 GMC truck driving approx. 50 mph. As we approached the Pasatiempo turnoff it started to rain. I slowed to about 40 mph and watched in my rear view mirror to see if he was pulling over to re-tighten the straps securing my tool box to the bed of his tow truck. He had mentioned before we left the location of departure that if it rained, the straps would loosen up. He didn't stop, so I assumed he believed everything was OK. We proceeded to drive to the final destination in Scotts Valley, CA. I pulled into the parking area before him. After I parked, I got out of my truck. I then turned around and saw him pull into the driveway of the parking area. My tool box was no longer standing on it's wheels-it was face down on the bed of the tow truck. 2 months later (after many unanswered phone calls), he tells me he doesn't feel it was his fault. He offered me $100.00 compensation for ruining my tool box (can't unlock it or open drawers to remove and inventory my tools-BROKEN BEYOND USE) or take him to Small Claims Court.
