On 10/02/2019, I purchased a SHAQ Cyber Hoop Shot for a Christmas gift for my son. On Christmas day, 12/25/2019, after opening the gift, we started putting it together and noticed two missing parts and a damaged part. We assembled the item as much as we could hoping to get the missing parts from the company, after all the manual did say to contact them for missing parts. On 12/27/2019, I contacted them through email and was told that since this purchase was within 90 days that they would send the missing and damaged parts, at no cost. I sent the requested information, pictures of the item, purchase information, and shipping information. I then got a reply stating that they are unable to send me the replacement parts because I purchased the item from Sears, because they were in bankruptcy. I was told to return the item for a refund. Two things to note, I purchased this product prior to my local Sears going out of business. Secondly, the store is now going out of business and no longer takes return items. With that said I am currently stuck with this incomplete item because of the lack of quality assurance from Tri-Great USA, failing to make sure they sent out a complete product. I have this item assembled as much as possible and it can be used, with caution. However, the item is not supported correctly, therefore it has a chance of collapsing on my son or wearing out sooner than it should. Also, there are two open ends of a support tube that could cause injury if someone would trip and fall into it. I feel as if I am being punished because someone failed to ensure a complete product was sent out. I also feel like I am being punished because of where I bought this, having no idea their financial status. I am hoping that I can get this resolved, if the company holds any value, care, or concern for their customers. Realizing that this was in no way my fault, so why am I, and mainly my son, being punished. They are no longer replying to me through email or phone.

Desired Outcome

Replacement Initially, I was only looking to get the two missing parts and the one damaged part replaced. However, since my initial contact with them, we have been able to use the item with caution. I fear that the other support pieces have been compromised because it is not put together the way it was designed. This is putting more stress on the pieces we do have and could cause the product to become weak where the support pieces have bends in them.
