I am rejecting this response because:
When *** showed me the stucco and he showed me the stucco that he put on our house, I specifically told him that I do not like that kind of stuccoI showed him the stucco that was on the neighbour's house and stated: 'I want the stucco like that but finer' and left it at thatI did not know that this kind of stucco is called California stuccoThe first time he mentioned it was during the signing of the contract in which we asked what it was and he stated : It's just the name."
They started working on the house and when I realized that they are pushing all the frames of the window in, I stopped themIt is NOT TRUE that I told him that we deal with it laterThis is a flat out lie!
In regards to the broken window, *** promised that he is going to replace itI had originally asked them to cover the windows with mesh during the removal process, in which they didn't, and that is when the window was brokenThe windows to the house are all brand new and none of the windows were broken before the start of this project
I begged him to place netting against the house to that debris would not fly around and cause damageThey netted the house up to the second floorI had told *** that the fence was brand new (we just placed it at the end of June) and I didn't want it damagedWe had to replace two posts ($each) and three pickets due to their negligenceThey did not do everything that they could to protect the property
When *** took the job, they saw the house before hand and saw that I have eaves and porches ( a large front porch and a small side porch)He never mentioned anything that they can not take the job because of the rookThey should have said that they were not roofers and should not have accepted the jobWe had leakage in the front room (family room) in the kitchen and in the second upstairs bedroomWhere ever there was a leakage is where they had placed the flushingThe weather and the amount of snow we had this winter has nothing to do with the leakageThe top roof did not leak because they didn't touch itit's only the places that they touched that there was a leakage problemSo I had to hire roofers to fix the problem and I took the lower estimate
I never told them to paint anythingI wanted the white trimming that was agreed upon and they could not give it to me with the cement that they putThey decided to paint it, not IFrom the beginning, they lied about everything that they were going to do in regards to this projectIt's not only around the windows, it's on every corner of the house on all three stories
*** came and took some measurements on the window that the frame is not only pushed in but the frame was also splitHe never came back to replace it
We always gave the the payment on site and they never had to ask for it, but at the sudden, they stopped coming They left the fixtures undone, the railing support off, the windowsill and door frames splitThey are fully responsible for the leakage and they have to accept that

[redacted] came into agreement with Tri-State Brickface
and Stucco Co. on August 28, 2013. Work was begun shortly sometime in September.
On the exterior of the residence, the walls had original stucco which was
installed when the house was built close to a hundred years ago....

In responds to
the job taking longer than 2 weeks, the stucco and scaffold was finished months
ago sometime in October. We even left the scaffold for over a week since Mrs.
[redacted] hired a painter and he used our scaffold to paint the exterior soffits
etc. In responds to the damaged window frames inside the house, since this
stucco was original on the house, as well as the window frames were original,
all the windows were replacement windows. Mrs. [redacted] stated that she wanted
all the exterior wood moldings removed from the outside so during the removal
process the impact from the removal of the moldings, the interior windows were
moving around since they were replacement windows. Mrs. [redacted] advised us
during the first couple of windows that the window moldings inside were moving
and we asked her what did she want us to do, she said continue on and we will
deal with it later. On our contract, #12, states Tri-State is not responsible
for any interior damages. This was a difficult situation since the house is
old, and Mrs. [redacted] wanting us to remove all the exterior window frames.
Upon competition of the exterior stucco, we did caulk and push back most of the
window frames in the house and Mrs. [redacted] told us she would take care of the
rest. In regards to the broken window, we are not sure if that was from our
cause or if that window was broken before. Regarding the damage fenced and
yard, the fence was protected as much as we could and Mrs. [redacted] did not
advise that the panels were damaged. In regards to the yard, this was a removal
of stucco on a 4 story house, we did the best we could with removal of all the
stucco, and yard and job site were cleaned up daily. In regards to the leakage
and the flashing, we are not roofers and not responsible for the installation of
flashings etc. Since the stucco was original on the house and the roofing
shingles were changed before, upon removal of the stucco there was no flashing
and we installed flashing to the best of our ability. Furthermore, our area was
hit with the biggest snow storms this year and Mrs. [redacted] did not call us in
the winter that there were any leaks in the house. In regards to the stucco
Mrs. [redacted] did not want, samples were showed and a contract was signed for
California Stucco. In regards to the recent cracks around windows, I did not
see any cracks in the stucco, and hairline cracks are common in concrete as it
is stated in the back of our contract. Furthermore, right after application of
cement around the windows, Mrs. [redacted] wanted us to paint the white trim
around the windows. We advised her that it was not good to paint it right away,
but she insisted and we painted all the trim around the house at no charge.
During the winter we spoke to Mrs. [redacted] a few times and told her we were
going to put roofing cement on the flashings at no charge since she was holding
$7,000 from us. However, it was cold and most of the time snow was on the roof
and there was nothing that we could have done in the past 3 months. More recent,
we spoke to Mrs. [redacted] and wanted to set up a time where we can go and take
care of the roof, but then the leakage issue occurred. Our resolution is that
we will take care of any stucco issues that could have arose, but we should not
be responsible for charges that Mrs. [redacted] spent on the roofer or any other
charges. We never threatened Mrs. [redacted] to pay us the remainder of the sum
in the past 3 months because we knew we had to go there until recently where I had
an attorney sent a letter in regards to the payment. When I advised Mrs.
[redacted] that an attorney will sent her a letter regarding payment, she said she
is not worried because she signed the contract, but the residence is in her daughter’s
name.

Review: We hired them to place stucco on our house in which they stated that it would only take 2 weeks (starting in September 2013) and they haven't finished the job. Besides that, they pushed all the frames of the windows from the wall into the house requiring every room in the house to have the windows caulked and painted. We have been spending countless amounts of money on caulk and paint.They broke one window which needs to be replaced.They damaged the frame of one window and ruined a window sill inside the house which needs to be replaced.They damaged a brand new fence (placed in June 2013 and costing $6000): two posts and panels had to be replaced. And they also ruined the yard (and they were former owners of a plant nursery).They removed the outdoor light fixtures and never placed them back in place.They never re-enforced the porch railings.When they placed the flushing, they put the wrong flushing resulting in leakages all over the house whereby we had to hire roofers twice to fix this problem. We never had a leakage problem in the house.He gave me the stucco that I did not want.They have a very rude and chauvinistic behavior and when you stand up to them, they start using profane language and threatening you.He stated that he came to the house when we were not here and went on the roof to look at the job the roofers had made.This morning, I noticed the stucco surrounding the windows with multiple cracks apparent in the corners.This job cost was $39,000. I withheld $7000 as they have not finished the job and they will get the remainder when they finish the job to my liking.Desired Settlement: They have to finish the work.The money that we spent on the roofer (we have receipts) will be taken out of the remaining $7000.Now they have to fix the stucco which is filled with cracks (6 months later).
