[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: statements by the contractor are not true The original estimate dated 2/13/was for $ Contractor did not clean thoroughly after drywall finishing was done Homeowner had to run shop vac and and mop floors Homeowner had to clean tobacco spit off new screen windows, newly painted walls, and bathroom sink and toilet (every day that contractor was there) Homeowner did not say to leave the storm window off Contractor was told to not install trim on these windows because they would eventually be replaced Both transom windows worked prior to contractor removing hardware They do not work now Contractor stated to homeowners wife "you better not use these, they don't work right" The glass was NOT broken prior to construction Homeowners wife was very specific about keeping original working transoms in home as they are antique and original to the 1920's home Homeowner's wife heard him banging the windows open and closed trying to get them to work and cleaned the broken glass out of the hallway so that homeowners pets would not be injured by the glass(picture available) The window installers did not smoke and there was no defect in the newly installed windows as they were thoroughly inspected, with the window contractors present, prior to them leaving the job site The drywall installer was observed smoking by homeownerNo one else has smoked in the home These windows were only month old prior to remodel taking place We will not budge on this, as we feel this is unacceptable (Picture available) See # above, the transom windows do not work properly Not true Contracted admits to spitting tobacco in our home, which shows a lack of respect Homeowner would not clean someone else's spit off windows or walls Homeowner did not add any large or heavy items to the dumpster It would not have made it heaver than the allowed weight.Unable to read the rest of the contractors responses on attached PDF file.We will not budge on the replacement window and the transom windows We are trying very hard to remodel our home and have it niceOur windows were perfect before the contractor started and we expected them to be perfect when he was done Having our new windows ruined after only one month and our transom window glass broken and not operational is not acceptable to us and shows a lack quality workmanship and not offering to fix the problem shows a lack of business ethics Regards, [redacted]

7/13/15This is incorrect my original estimate was $ 3,to $ 3,167.00.The actual cost of my original estimate came to $3,466.94.Cost of additional work other than original estimate came to $ 1,486.22.For a total job cost of $4,customer paid $ 2,and had a credit of $leaving a balance of $ 2,508.80.Under Customer's Statement of the Problem:Billed twice for drywall hanging and finishing this is incorrect! Drywall hanging and finishing was included in original estimate part of $3,Partially incorrect; floors were swept and walls were cleaned before owner painted wallsIt was his choice to paint walls and ceiling before trim was installedOwner said to leave storm window off because he was going to have replacement windows installed at a later dateIncorrect, I believe glass was broken and transom was never removedUnaware of it; was never brought to my attention as far as I know my subcontractors do not smokeOther window installers were working on windows before I started his jobTransom windows worked when I completed job, windows were never removedTrue, I offered to clean, he said he would handlePartially true; home owner and relative also added personal itemsIncorrect, at the halfway point I felt I would be close to the estimate and

7/29/15Under Message - Complaint [redacted]1. Wrong, read the signed estimate $2,967.00 was not the estimate the estimate was $3,127.00 to $3,167.00.2. Yes, I chew tobacco, I did offer to clean a spot on the wall, but homeowner said he would do it and did it when I was there. I used his bathroom sink for drinking water, I filled a tea container or plastic water bottle after it was empty and on occasion I used the sink for a spittoon, but I always rinsed the sink and on occasion I spit out of an open window.3. Left storm window off because he was replacing windows.4. Incorrect, I told homeowners wife that the windows would work better if sliders were not painted, but never told her not to use windows. They did work when I left, but would slide better and easily if sliders were not painted. Also, the transom glass in the one unit had a crack in the glass, glass was intact but cracked. As for banging the units open and closed - untrue they were never slammed open and closed, just operated like normal.5. Damage window by smoking, I never saw drywall installers smoking while I was there. Customer said he was not overly happy with job done by window installers as told to me.6. Father-in-law threw several bags of trash and other trash in dumpster. Majority of bags were removed by homeowner, but other trash remained. Homeowner also threw items in dumpster underneath old drywall.Homeowner needs to look over the estimate and additional work order sheet he signed. As for cleaning, the job site was swept after completion and the walls were prepped for painting after drywaller was finished. Any homeowner would re-clean rooms before moving in furniture.Homeowner said, he would send me a $1,000.00 right away. He also stated, he did not have the additional money to pay the remaining balance, I told him I would accept payments. I have not received any money on the remaining balance of $2,508.80. There was never any complaint about the workmanship or my conduct until he received the final bill.Sincerely,H. Michael M.owner
