obscene message saying she will file complaints with the Revdex.com, all my social media and threaten to *** and cursing at me, she did not give me time to respond and started on my social media with serious deflationary statements, we removed some wood chips but she continued to slander my business, why should I spend my money on someone who is so nasty and so willing to slander my business, she needs to remove all posts and I may deal with her then

I do not accept Labat's Tree Care / *** ***'s statement as it is overwhelmingly inaccurate
On the day the wood chips were dumped, I was told by the employee of Labat's who was driving the truck that the load of wood chips was absolutely safe for dogs and it was a "clean load" (which means it supposedly had no leaves, branches, etc...)Based on this falsehood, I allowed him to begin to deposit the loadWhen hundreds of small leaves began to pour out of the truck onto my property part way through the process, I saw that each leaf had a needle like spire on the tip, and was thoroughly unsafe for dogsThe owner of Labat's and respondent to this claim was fully aware of my need for wood chips that are safe for dogs and she has been aware of this condition of accepting wood chips from her company for over years
As the owner of Labat's Tree Care, *** *** is ultimately responsible for this upsetting and dangerous errorOn the day the chips were dumped, I immediately tried to contact her via phone to discuss the matterAfter many subsequent attempts to reach her by phone in the following days, Miss *** never called me back which was quite distressing as one of my own dogs suffered a painful injury when he stepped on one of the leaves and it got stuck in his foot
I take the utmost caution in protecting my dogs as well as the wildlife here in rural Contra Costa CountyThe dumping of this huge pile of cubic yards of wood chips that were full of needle sharp leaves and other debris was something that had to be removed before any other dogs / animals / people got injured
Miss ***'s negligence in correcting the matter along with her consistent refusal to respond to my numerous phone calls over the course of more than two weeks implied that she had no intention of taking care of the situationAs have so many of Labat's former customers, I left an honest review on YelpA brief look at Labat's Tree Care's Yelp reviews shows that Miss *** has upset and angered many people with her emotional, defensive, argumentative manner and her refusal to provide a modicum of satisfactory customer serviceLabat's Yelp reviews are replete with many negative, one star ratings and stories similar to mineThere are also Google reviews of Labat's which reveal the sameThere is a clear, documented pattern of abominable customer service and inferior product and business practices
After two plus weeks of trying to reach Miss *** I used the "F" word in a voice mail message specifically in reference to the pile of wood chipsAt no time did I use obscene words directed at her, but Miss ***'s portrayal of me in her statement paints a dramatic and image of me using such terms in an overwhelming, cavalier fashionRegarding threatening statements - I merely described the thoroughly legal actions I would take if necessary in hopes of inspiring Miss *** to remove the dangerous and harmful wood chips from my property which had already caused one dog to require veterinary helpThese actions included filing a report with the Revdex.com, engaging my lawyer if necessary and asking for financial recompense in Small Claims Court for the costs incurred by having to hire my lawyer to follow up on this matter for me, etcAgain, Miss ***'s description of my "threats" is emotionally charged, ambiguous and casts a shadow on what can only be considered a reasonable response to the situationHurling wild, highly charged accusations does not equate to a rational, truthful assessment of what actually transpired
The entire fiasco could have been handled - and should have been handled - simply and in a timely fashionHad Miss *** called me back and removed the pile of wood chips from my property, the entire debacle would have been resolved and put to restHowever, keeping in mind that I was lied to by her employee - an employee she sent to my property with material that was undeniably dangerous for dogs - and Miss ***'s lack of concern, responsiveness, and professionalism, I chose to share with her how I intended to move forward if she continued to ignore her responsibility and correct the error she made
The potential saving grace in this situation was a woman who worked part time for Miss ***, *** was kind and concerned and very much wanted to correct the situationAfter speaking with ***, I felt reassured that the wood chip pile might indeed be removed after all, and I told *** that after the wood chips had been removed, I would amend my Yelp reviewHowever, once Miss *** caught wind of the fact that *** had arranged for a truck to come and remove the wood chip pile, she immediately fired ***, sent me a barrage of accusatory text messages which stated, in part, that she now has to close her business down and it is all my fault, that *** was fired and the wood chips will not be picked up, that I am a nasty person who will be punished by God, that she didn't have time to return any of my phone calls as she was busy planning a baby shower for her daughter, that she is suffering from "aneureziums" (sic) etc etc etcSo *** is gone, and the man who delivereed the wood chips has quit working for Labat's / *** ***
I stand by every thing I have reported to the Revdex.com and that I have written in the Yelp reviewThere were two people on my property the day the Labat's employee pulled up who were witnesses to the entire event and who are ready and willing to provide their perception of the course of events
It is true that Miss *** never called me in response to the voice mail messages I left for herHowever, Miss *** did answer the phone one day about days after I began calling her about this matterShe said she would send a truck and the entire pile would be removedThat did not happenWhat did happen is a pair of men, hauling a tiny open trailer behind a pick up truck showed up unannounced at my propertyTo give you an idea of the size of this trailer, they had a lawn mower in the trailer which took up almost half of the space in the trailerTheir instructions were to take one small load of chips away and not to return to deal with the rest of the pileThey were also instructed by Miss *** to get a sample of the wood chips, which they placed in a paper bag*** later remarked to me that when she saw the bag and placed her hand inside of it, she was pierced by several of the leaves and she was very surprised that this load was ever brought to and dumped on my property as it was clearly not appropriate or safe for dogsThe men estimated that it would take or more trips to remove the remaining wood chips but they had no orders to do soMiss *** therefore lied to me about her intention to have the entire pile removed, and once again, my subsequent and numerous phone calls went unanswered
This has been a stressful, expensive and literally painful experience as I myself was stuck by the leavesYesterday I had a professional hauler come and remove the pile for several hundred dollars, as did another of Miss ***'s former customers as indicated in one of the several negative reviews she / Labat's Tree Care has received on YelpI have a receipt for verification if necessary
In conclusion, I do not accept Miss ***'s statement

Due to the dangerous nature of the wood chip pile and the necessity to have it taken away immediately (after waiting for more than two weeks for Labat's Tree Care to remove the pile from my property), I paid to have it removed by a professional hauling companyTherefore, the resolution I seek is full reimbursement for the cost of removal of the wood chip pile
