Thank you for the opportunity to respond to MrA***'s letter. To this date, MrA*** has not provided any proof to support his claim that the hot tub was dirty. I've asked for photos and a timeline during which he inspected the hot tub, but he has refused to provide either. We cannot be held responsible for what happened to the hot tub after we vacated the property and have no way of knowing who else might have accessed or dirtied the hot tub after our departure. While MrA*** claims that he has witnesses to testify that the hot tub was dirty, I also have witnesses to testify that we followed his check-out instructions exactly as described and that nothing out of the ordinary occurred with the hot tub during our use.Again MrA*** has tied the $fee to the reviews I posted on various travel review sites. Considering that he is unwilling or unable to substantiate his claim of a dirty hot tub, I can only assume that charging me the $fee was in response to the negative reviews I wrote. My contract with Trickle Creek LLC states nothing about being charged a fee if I write a negative review and as a result, I believe MrA*** may be in breach of our written contract for charging an unjustified fee. Furthermore, I am confused about MrA***'s accusation of "slanderous" reviews. I can only assume the word he intended to use was "libelous," since the reviews were written, not verbal. The reviews I wrote are fact based and provided a balanced view of our experience with him and his property. Perhaps MrA*** can help me understand which portion(s) of the reviews he believes to be untruthful and I will reassess the way they've been written.If MrA*** can supply proof of his claim that the hot tub was dirty and that the dirty condition was caused by me and my friends, I will gladly remove the negative reviews from the travel sites. If he cannot support his claim, I demand the refund of the unjustified $fee in order to avoid a breach of contract dispute in small claims court
