The Homeowners bought their house in September 2013, and inFebruary alleged that [redacted] “had put in wrong generic flappers orparts into a brand manufacturer toilet.” In 2013, the toilet tank came complete from the manufacturer with theentire flushing mechanism, which includes the flapper, already installed by themanufacturer [redacted] and its plumbing contractor did not installthe toilet flappers The Homeowners bought the house in September Regularreplacement of toilet flappers is a home maintenance item In2013, the toilet manufacturer had a one year warranty on the flushing mechanismfor the toilet model installed in the Homeowners’ house The Homeowners’need to replace toilet flappers in January-February is not uncommon,especially if the local water supply had high chlorine levels and/or theHomeowner used in-tank cleaners In April 2014, the toilet manufacturer changed the flush valve assemblyin the toilet model installed in Homeowners’ house, at which time themanufacturer changed its website information on parts and repairs In addition to the manufacturer’s and the [redacted] ’s respective oneyear warranties, the [redacted] also purchased for Homeowners a year/10year home warranty program To our knowledge, the Homeowners did notcontact the home warranty company FYI---Between early September andNovember 6, 2014, [redacted] had fixed all items on the one year warrantylist prepared by Homeowner The Homeowner first contacted [redacted] regarding this matter onFebruary 26, 2015, which was six (6) days after the Homeowners first called aplumbing company and after the plumbing company replaced the flappersThe Homeowners never gave [redacted] a chance to inspect the toilet or tocorrect any problems Most importantly, the Homeowner told us that shedid not keep the supposedly defective/generic flappers, so there is no way toconfirm whether the flappers were or were not “generic” or “defective”
