To whom it may concern:Let this serve as my formal response to [redacted] ***'s disputeFirst and foremost it is custom to request a refund with the company in which you have a dispute before attempting to remedy matter through external sourcesThis is an attempt to slander my business by Ms.*** Ms [redacted] is apart of a group in which African American business owners share ideas services and offers among a few other bonusesI responded to Ms***'s request for someone to create a website for her businessI provided her with links to sites that I had previously designed and explained to her what the expectations of her would be as the client and what she could expect from me as her web designerMs [redacted] to date has still not provided information in the form of content that she was asked to haveMs [redacted] was also provided a survey at the beginning of our business relationship that captured the design she would have likedI took on Ms.***'s project as it was a discounted project with the understanding that she had all content ready and it would not interfere with other projects however she informed that someone was working on the content for her about me pageI waited over a week for this content which would then interrupt scheduling for other projects and clients nonetheless I worked with Ms***She then sent over pictures with no labels or pricing (almost as if I was to assume what products were which)She later finally sent over a list of prices separate from pictures that again had no names/labels and had multiple pricing optionsAll of the information was added to the site as sent overIn addition to this Ms[redacted] was unable to provide information to connect her domainThis is in most cases not the job of the web designer however I then spent another week after receiving strange passwords that did not work for a [redacted] siteI told Ms[redacted] on several occasions that the password did not work and that she needed to contact her provider because I am unable to access this informationShe did not do any of this and instead I was able to get on a chat screen from [redacted] and he agreed to send Ms[redacted] an email that she would simply have to respond to and he would speak to meThe domain was then connected within hours and a cover page to the site was put up and Ms [redacted] was able to view her siteI told Ms [redacted] her site was completeShe was difficult on several occasions saying that she was viewing the site on a friends phone and she would contact me when she was able to get to a desktop another hold up that took over hoursMs [redacted] contacted me finally not requesting any changes but said she loved the site and she wanted to possibly change the picture of the homepage (a picture I advised Ms[redacted] wasnt the best choice however she insisted several times that this was her choice) I told Ms[redacted] to let me know any changes she needed madeI also provide training for my clients as a bonus so that they are able to use their site after it is designed a service many dont offer and results in customers being forced to return and spend money time and time againI have sent numerous emails requesting a date she was available no responseMs[redacted] then contacted me asking me about hosting options at which point I was honest in letting her know that the question she was asking me was best directed to [redacted] as I am not aware of what products she has with them and they would be able to give her a better understandingFrom there somehow the relationship began to go downhillMs[redacted] later finally viewing the site at her leisure said there were changes she needed made, NONE of which were made clear when she sent over content in piecesI agreed to make the changes once she sent over the contentMs[redacted] before even sending over the content began to ask for a turnaround date which was absolutely crazy because yet again she had not done her partI expressed to Ms [redacted] that once she had the content to me I would have the information completed by the weekendShe promised to have the content over by the beginning of the previous weekend however did not until that MondayMs [redacted] then sent a [redacted] message saying she would be out of townAs the information was late I did not blame Ms[redacted] for her part but explained that I would have it complete within a few daysShe still at this point had not provided a date for when we could go over the site or complete her trainingMs[redacted] also went into the group where we first connected and asked several other people about this and was told that this is not a microwave job and that many people like herself grow weary and dont understand the jobIn closing Ms [redacted] has been rude she unlawfully took access of the site and I am unable to make any changesPlease note all changes were made to the site as she requested but due to Ms [redacted] allowing her payment to lapse the changes were lostI also asked Ms[redacted] to schedule a call to remedy the situation and she declinedI am willing to make any additional changes to the site however will not offer a refund as we were already under price point and clearly went above and beyond for this clientShe simply did not do her part and expected everything to come together without her part

1. Due to our business relationship being irretrievably broken due to Ms*** personal attacks which are evidenced in emails, and her comments encouraging me to file a complaint, I decided to file a dispute. I would have much rather dealt with this situation internally, however, Ms***’ poor customer service and haughty demeanor when she was held accountable for her shortcomings regarding the project prevented me from doing so.2. On June 3rd, Ms*** said that she would create a Landing Page. The Landing Page was not done for some time afterI know this because I constantly checked it and saw the Maintenance Page that I initially started with ***. 3. Ms*** was then supposed to have her assistant, ***, send me a welcome packet which detailed what was to be expected. That was never done, even after I alerted Ms*** and asked Ms*** to send a second timeSo, I was left with no information regarding expectations of me or Ms*** throughout this process. 4. On June 16, I asked what the turnaround was for the website to make sure I got all content to her in a timely fashion. She told me the next day that it normally took two weeks and that my website had already been started and most likely would be completed in less than two weeks. She also requested as many photos as possible and told me she creates graphics for her clients as a bonus (these bonus graphics were never done).5. On June 18th, I reached out to Ms*** to tell Ms*** that I had questions about what to provide to Ms*** and that I needed (particularly the product/shop page).6. On June 26th, I reached out to Ms*** because she stated that I would be shown the website on June 25th. That never happened and I had to reach out to Ms*** after that date was missed to get an update. Ms*** replied that her day became hectic. I was fine with that, as I had also had days like that. That same day (June 26th), Ms*** said she’d send over a screenshot that evening. That was not done until the next day. 7. After the delay, Ms*** contacted me on June citing a new job as the reason for the delayAt that time, she stated that the site would be going “live” that evening. She also requested additional items that she felt would enhance the site and some other elements needed on the Contact Page, About Me pages.8. The Contact Page content was sent to Ms*** on June 28thIt contained my company’s Toll Free number, Business Address and email address. NONE of these elements were incorporated into the Contact Page. All that was included by Ms*** was an area for visitors to fill in their name, email and question. This was not what I wanted nor expected to have done. 9. On June 27th, the *** saga began. On July 28, I sent Ms*** all administrator passwords and information for ***. She informed me on June 29, that she could not get access and that I needed to do something on my part. I completed that task and sent her a new password via email on June 30thYet she will have you believe that I held up that processMs*** and I both decided on doing a Terms and Conditions page on June 29thMs*** stated “a terms and conditions page is especially important because you are selling products.” On June 30th, Ms*** stated the site was coming along well. On July 6, I sent over the Terms and Conditions and Prices/Names for Products, which was the final content to be sent. On July 7th, I sent a revised Terms andConditions document because of a typo foundOn July 10th, I inquired with Ms*** to check to progress on the site. Ms*** told me that she needed to reach out to *** again because of an issue and that the site just had a few finishing touches to be made - this was after receiving the shop page content which, Ms*** should have contacted me about if there were any clarifications needed. On July 14th, Ms*** told me there was still an issue with ***. After not hearing back from Ms*** the rest of the day about the *** issue, I reached out to Ms*** to see if she needed me to expedite things Ms*** told me yesI requested that she email me to let me know what to express to *** (in layman's terms) and Ms*** told me she’d send me an email that next morningThe next day, I messaged Ms*** at 5:PM because the email was not sent and again fourhours later at 9:(after not receiving any response). Ms*** told me that she “completely forgot” to send the email and she’d be sending the email at that timeThat did not happen. 16. On July 19th, three days later, she sent me an email stating that the “website is now complete.” She also stated the following: “Please review the website thoroughly and let me know what changes if any you would like to have made.” 17. On July 20, I contacted Ms*** to inform her that it was discovered that there were no amounts or lengths designated for the photos on the shop pageI explained whythis was important in an emailNever once did Ms*** reach out to me before the website was deemed “complete” to let me know there was clarification neededregarding the products on the shop pageWhen Ms*** gave me access to the “completed site,” the products on the web pages were unnamed, with no descriptions, andall showing as costing $0.00. How can a established web designer claim this is a finished site with such crucial information missing and why didn’t Ms*** reach out to me prior to releasing the site to me if there was additional information needed18. On July 30, 2015, Ms*** was paid in full for her services. The site had still not yet been completed.19. On July 30, I inquired throughout the day as to the turnaround once all final content was sent (which was only the information that was left out of the shop page by Ms.*** and for which she never touched based with me to fix).20. On July 31st, Ms*** informed me that she was out of town and would not be working until Monday Between July 30-Aug 2, because of the errors with the site, I compiled individual emails which contained the photos, related prices/lengths and descriptions.These were all to be incorporated in the products page. Of note, two of the products (closures) were nowhere on the site at all when it was deemed finishedI explained in detail in an email on August 2nd, what needed to be done to the Shop Page. On August 5, three days later, she contacted me to tell me that shewould have “all changes made no later than Saturday, August 8, 2015.” On August 11, 2015, I inquired about the site being finished and was told, as mentioned in my complaint that Ms*** “didn’t get around to making the changes.” It was then that I requested a hard deadline of August 18, for all final changes to be made. On August 18, when it was discovered that the Shop Page was incomplete and contained multiple errors and omissions, and the Contact Page did not contain the information I previously gave her more than a month ago to include, I advised her of my frustration and unhappiness and that I would be planning to file a dispute if the situation was not remedied by today, Friday, August 21stMs*** became angered and began making insulting personal remarks toward me via email which were completely unprofessionalOn August 19, I discovered the password for the site which I now had full control and ownership of (due to paying Ms*** in full, her transfer of ownership to me as evidenced in her own communications to me, and paying for the remaining hosting of the site) had been CHANGED by Ms***. I had to contact *** and have the issue escalated to their Safety team in order to get my site transferred to me, as rightful owner. I have all the documentation regarding this including chat transcripts and emails with ***. For the aforementioned reasons, I reject Ms***’ interpretation of the events and also her offer to fix the site. I request that Ms*** refund me the $immediately to show a good faith effort to mitigate the damage caused to me by Ms*** for her blatant refusal to adhere to the obligations she was hired for and the subsequent inconveniences caused to my business by the website being incomplete.
