Their response was not satisfactory for the reason stated below. The Feb. **, 2015 update below has already been posted to the Revdex.com as an amendment to the original complaint.
Update to Complaint, Feb. **, 2015On Feb. *, we received our first communication from the business since filing the complaint with NY Revdex.com. The business offered us a ‘settlement’‘ of $2,000, from the original $4,000 deposit we paid, if we signed a release. The business wanted to keep the other $2,000, claiming that it was the value of the work they did. We notified the business on Feb. * that we rejected this offer, given the work was inconsistent with our request and had no value to us, and we wanted the full $4,000 returned.  We further stated that the business had not made any claim on the remaining $2,000 deposit, and we required that they return it to us by the end of Feb. [redacted] . We did not hear from the business before the date. On Feb. **, the business again offered us $2,000 to end the matter, and we wrote back on the same day stating that we rejected this for the same reason as before. We informed the business that by withholding half the deposit, they were using money they had no claim over as a bargaining tool. We stated that they had no reason to hold the $2,000, which they had held for a month, and asked for it to be immediately returned, as part of our claim for the total $4,000. Update Status on Mar. *, 2015Since our communication to the business on Feb. [redacted], we have no received no further communication or response of any kind.

Review: We hired [redacted] at Trinity Development (the contractor) to stain our floor at our apartment. The contractor, using a sub-contractor, ended up staining the floor to the wrong color, specifically to the color we said we did not want. We asked the contractor to fix the work, but he said this would cost us another $6,500 (plus the original $2,000 for the initial work). After failing to get resolution, we canceled any further work. We had given the contractor a $4,000 deposit before the job started, which he has failed to return to us after we had requested it. We are now requiring for refund of our money back, plus the costs to correct the job, and attendant costs.

The work started on the morning of January **, 2015 and we were told it would take two days to complete, and that we could not stay in the apartment during this time because of the smell of the stain. We therefore had to incur $428 in costs to stay at a hotel for two nights. When we visited the apartment on January [redacted], we found the floor was the wrong color and told the contractor.

There was no signed contract between myself and the contractor for the work that was to be done. We proceeded on the basis of an estimate that the contractor provided, which stated it was an a la carte menu from which we could choose. This estimate did not specify the colors of the floors (or the walls for that matter). However, It is implied that a contractor will do the job in the colors requested by the client.

On January [redacted], before the job started, we emailed the contractor to ask for a list of possible colors for the floor. On the [redacted] the contractor responded by email saying he could not duplicate the existing color of the floor but would send us a picture of other colors that afternoon, which we did not receive. The problem could have been avoided if the contractor had raised the subject of the floor color during the 'walk-through' in our apartment, when we discussed the work to be done. It is the responsibility of the contractor to raise this issue of color ahead of the work starting..

The contractor left our apartment on Tuesday morning, before the work on the floor had started. We discussed with the sub-contractor using a water-based floor stain to cut down on time and fumes. Our concern was that the floor would end up being too light, and showed him the color that we did not want. The sub-contractor assured us that he could get a more ‘golden’ color, and gave us a reference in terms of another piece of furniture we had. We would not have agreed to the job proceeding if he had not committed to us that he could achieve the color he committed to.

We were told the floor would take two days to complete. When we spoke to the sub-contractor in the evening of the first day, he said the work was finished, and that it had come out lighter than he thought it would. This response is a recognition that sub-contractor was aware of the color we wanted, and the color that we did not want. At no time during the work did the sub-contractor call to tell us the finish was coming out lighter than he told us could be achieved.

We set up a meeting with the contractor on the next day (January [redacted]), to show him the results, and see if he was prepared to correct the work. However, the contractor did not turn-up, which we only confirmed after we called him several hours later. Attempts to resolve the matter by phone and email were unsuccessful, with the contractor becoming completely unresponsive to our attempts to contact him. He claimed that he was owed $2,600 for the 'work' he did, despite this being work we did not want. He gave the implication he would offset the '$2,600 costs" against the $4,000 deposit we had given him. The contractor has never seen the work by his sub-contractor, as he was not present when it was done.Desired Settlement: We want the following amounts refunded.

The return of the full deposit we paid the contractor $4,000.

Cost of the hotel we stayed in for two nights $428.

The cost of a new contractor to rectify the floor $3,000.

Cost of staying in a hotel when the new contractor is rectifying the floor $428

Pain and suffering of dealing with contractor and the incorrect floor $1,000.

The total payment we seek in restitution and compensation from the contractor is $8,856.
