First and formost, tree in question was damaged after day warranty Secondly , the tree was not damaged or in poor condition when planted or purchased from nurseryThe tree has a "broken lead branch" which my staff has shown Jim ,most likely caused from bad weather We have pictures of the tree the day after it was planted and is in perfect condition We are not responsible for plants or material that was damaged outside of our companies installation and after the day warranty in which customer was fully aware at the time of signing the agreement Customer has been extremely rude and harassing me and my staff for weeks about this It is unfortunate that the tree has been damaged, but it was not by my staff or the nursery it was purchased from so we feel as though we cannot be responsible for the replacement We have records of emails from client in which he recognizes the damage from tree was after the day warranty and he is still looking for us to replace the tree.We have two facts that need to be recognized ...1) tree was damaged after the day warranty 2) Tree was not damaged by Nelson's landscaping or the nursery it was purchased fromWe want the Revdex.com To be aware that this customer even left us an extremely positive Google review and we are disappointed in complaint We have a copy of the positive review from Google if the Revdex.com wishes to see it One might think it would be easier for us just to buy $tree and replace it, but this comes down to principalIf we go against policy and just up and replace it then I guess we would have to do that for every single complaint weather its true or notThank you for your time on this matter and hope to have this case closed immediately We are in good standings for the years that we have been in business and hope to maintain that status with Revdex.com We dont want case on record with Revdex.com because complaint holds no warrant or responsibility to Nelsons landscaping and snow removal

I fully disagree with *** Nelson that the claim was made after the day warranty period on the tree As I stated in the original claim Mr Nelson made us aware that the tree was in distress prior to the project being completed This is well within his company policy of days The tree was in distress and dying before the winter months and Mr Nelson's claim that the tree was damaged during the winter months is the result of the tree dying is untrue Mr Nelson told us, as is evidenced in his e-mails that the tree may have been in shock after planting The soil around the tree has sunken - inches, which means the tree was not planted properly For all we know, the tree was damaged last year upon planting and Mr Nelson did not see the damage until he inspected it in March of All last fall (2016) Mr Nelson stated that he would replace the tree come spring and now that the reality of doing this is here he is going back on his promise I agree that the principle of the matter is just as important at the monetary figure Mr Nelson needs to honor his companies day warranty period He was well aware of the tree being in distress prior to the day warranty period ending It was his advice to wait until the spring season to replace the tree Now Mr Nelson does not want to replace the tree He has come up with another reason (tree was damaged during the winer season) to not fulfill his obligation As to my harassing Mr Nelson or being rude to his employees This is totally incorrect and untrue I want him to stop staying this and damaging my reputation by his accusations Mr Nelson is not an honest business person His companies day warranty has no meaning if he is not going to honor it in situations like this His company does good work and it is terrible that he is taking this route when it is clear that he made a promise to replace the tree and is now making every excuse not to replace it
