This letter responds to the complaint referenced above, which I received on November 27 th. The past due account upon which the complaint is based, which was referred to me by a client for debt collection, is owed by [redacted] **On September 15, 2017, [redacted] *. contacted me via telephone and said he... wascalling regarding account ending in ***. I advised [redacted] *. that his name was not on that account. [redacted] *. explained that this was his wife's account. I told ***. that although the Fair Debt Collection Practices Act provides that a debt collector may communicate with a spouse of a debtor, Trinity Services' policy isto obtain the consent of the debtor prior to speaking with a third party, including aspouse of a debtor. [redacted] *. then became quite upset, almost combative regarding Trinity's policy. He then advised me that he would have his neighbor call and say she was [redacted] **, and asked if that was okay. I told him no, that was not acceptable .The following day, I left a voice message for [redacted] to please return my calLAs of the date of this letter, I have not received any communication from [redacted] **After our initial conversation discussed above, [redacted] *. left another 3 or 4 voice messages on Trinity's answering machine regarding paying the debt owed under this account. I did not return his calls because at that point, he was aware of Trinity's policy of not discussing an account with a non-debtor without thedebtor's prior consent. To be clear, if I had received [redacted] **'s consent to speak with [redacted] *. regarding this account, I would have done so. Further, if [redacted] *.and/or [redacted] wanted to make a payment on the account, which [redacted] *.indicated in his voice messages, Trinity Services' address is contained in the letters issued to [redacted] **I look forward to hearing from the RevDex.com, or in the alternative, from [redacted] so that she may provide consent for me to speak directly with ***. regarding this account. Very Truly Yours,Marcy [redacted] ***Trinity Services [redacted]
