On the morning of December 1st, 2017,Mr [redacted] emailed San Tropez the same letter that was also emailed to the Revdex.comWhen Mr [redacted] leased at San Tropez Apartment Homes,he signed a legal binding Rental AgreementHe signed a lease term of months, with the lease beginning on June 29th, and ending on June 28th, Per the Rental Agreement he listed himself as a lease holder and his minor daughter as an occupantMonthly lease charges agreed upon by Mr [redacted] were$1,for rent,$for the water, sewer and trash (flat fee based on number of occupants),$for a renter's insurance waiver and $city sales tax.The apartment that Mr [redacted] leased, was our largest two bedroom which does in fact measure 1,sqftWhile we are disappointed that Mr [redacted] did not enjoy his living experience at San Tropez, the fees related to his breaking the lease are clearly defined in the Rental AgreementRental Agreement paragraph is as follows,Breaking Lease: Resident will be required to submit a thirty (30) day Notice to Vacate,pay back all concessions received upon move in, as well as the Lease Break Fee in the amount of two month's rent.This amount will be due at the time of move outDue to Fair Housing Laws we must hold all residents to the same Lease Break policy.Per the Arizona Residential Landlord and Tenant Act - 1324,we do not feel we have violated our obligation in any waySan Tropez participates in the Scottsdale Crime Free Housing Program and is aware of the crime staticsAs much as I would love to say no crimes are ever committed in our Community that would be unrealisticWe do however have policies and procedures in place for when these unfortunate events do occur,but by no means can we ensure our residents safetyWhen we are made aware of events such as the ones listed in Mr [redacted] 's letter,we would always suggest for our residents to call the Scottsdale Police DepartmentAlso we ask our residents to fill out a NALS Incident Report,this way we can monitor any incident that isn't reported to the Police DepartmentAfter speaking with all my staff members, we concluded that we were not made aware that packages were being taken from his front porch and we did not know that Mr [redacted] s car was keyed twiceHe also did not report to the office staff any complaints regarding people rummaging in the dumpsters,neighbors smoking marijuana or being excessively loud.Two complaints Mr [redacted] did document with the office were an incident involving his daughter in which the Police were called,and a noise complaint on a week night at 10:pm regarding residents playing volleyball at the volleyball court behind his building.This complaint was emailed and responded to by the Assistant ManagerIf Mr [redacted] feels the reasoning for breaking his Rental Agreement applies to the Act above,then the next step would beto refer him to The Residential Landlord and Tenant Act -1361- This section outlines his legalrights as a tenant and the proper steps you must take to legally terminate your Rental AgreementBased on the information provided in this section,I see no breach that would constitute? Mr [redacted] 's claimMr [redacted] would have needed to communicate his intentions with us at the minimum? and shouldhave served us a day written notice specifying the acts and omissions constituting the breach, allowingus a day period to remedy the situation.After Mr [redacted] moved in,he walked his apartment and listed his concerns on the mochecklist we provide to every resident upon move inWe entered a work order for maintenance to address Mr [redacted] 's concernsMost of the items listed were minor so we took care of them to the best of our ability,this also includes having a vendor come out and clean all of his windows,trim half the branches off of a tree that was causing a mess on the stair well and entry way to his apartmentThere were a few times we were not able to enter his apartment to complete work orders due to a minor in the apartment without an adultWe would then call Mr [redacted] to schedule an appointmentSeveral? times maintenance would arrive at the scheduled time and Mr [redacted] would not be there.The counter tops were resurfaced during the turn process prior to Mr [redacted] moving inIf we were made aware of the chips on the counter tops,regardless of who was at fault they were under warranty so we would have been more than happy to have them touched upThe Kenmore appliances were installed in this apartment,in brand new condition on Oct 1st,Those were also under warranty and we would have been more than happy to have those repaired if Mr [redacted] would have shared his concerns with usWe wish that Mr [redacted] would have addressed the window concern with our leasing consultant while reviewing what features were important to him in his new home.Due to Fair Housing Laws we do not discriminate on who we lease our apartments toWe have procedures in place to screen our Rental ApplicationsIncluded in the applicant screening is a credit report,national criminal back ground check,verifications of income,along with a national eviction reportWe will lease our apartments to anyone who meets these qualifications.Anytime you chose to park in a handicapped parking space you take a risk of receiving a ticketOur parking lot is continuously patrolled by the Scottsdale Police Department who will issue parking citations

Attached is a copy of the email I sent Cassie on September 14th regarding the stolen packages, she responded. San Tropez has been caught in a lie about not reporting everything I have laid out in my complaint. They did NOTHING to assist in making my stay with them safe and that is a violation of the tenant agreementi don't owe them a penny, they owe me an apology, they need to do the right thing and remove the balance they claim I owe them or I will see them in court and use this Revdex.com communication as evidence that they lied about not being informed of the theft at my apartment and didn't inform the police because they didn't want it on public record
