[redacted] RE: Complaint ID [redacted] Dear MrPollock, This message is in response to the above referenced complaint number, that has been closed as unanswered due to lack of response by us I apologize for the delay in responding to this matterMrs [redacted] initially came to us in September, as a referral thru a mutual friend, for a car for her son NigelAt the time of that sale she mentioned she had a Malibu that needed some work and wondered if we could help her with repairs if she paid for the parts We agreed to look at the Malibu as a favor and told her that we don’t have a certified mechanic on staff, but that we could see what we could figure outThe further we got into it, we came to the conclusion that it was going to be much more costly than initially expectedWe informed her of the situation and offered to just bring it back because it was in running condition, to which she agreedOn November 28, we took the Malibu back to her un-repaired (as it was still a running vehicle) as well as her money back that she had given us for the partsUpon our arrival, she said she needed a car now and could she just trade the Malibu straight across for the Dodge truck we had on the lotWe agreed to do the trade straight across and her son Brayden went to the lot with our General Manager [redacted] to complete the paperwork.We were waiting on the title for the Dodge to come in from the auction, which can sometimes take a few weeks We were well within the days by law to provide the title We didn’t hear anything from Mrs [redacted] during this time No phone calls regarding anything wrong, complaints, etcuntil she made a comment on our Facebook page about where her title was on December 12thThe general manager immediately wrote her a private message telling her that we would have her title by Tuesday of the next week and if they could come out and swap the Dodge title for the Malibu title I’ve attached the conversation verbatim from Facebook messenger.When [redacted] tried to call her on December 18, to let her know that we had the title for the Dodge, her phone number was disconnected So he contacted her on messenger to inform her so she could bring the Malibu title in and we would give her the title for the DodgeAs seen in the attached conversation, Mrs [redacted] ’s response was nothing short of hostile when we contacted her It had only been weeks since the trade of the vehicle, we were within the law and the day time frameWhen she fired off a list of complaints against us, we were surprised to say the least She had not made ANY contact at all regarding the complaints she listed about the cars not being safe etc Her son Nigel, who bought the Saturn in September, had even been in to get his license plates during this time of silence and he said absolutely nothing about not being happy with his purchase We would do everything in our power to make things right with a customer so they are happy with their purchase She was definitely more difficult than other customers we had dealt with, but we tried nonetheless to make her happy Hence the straight trade for the Malibu and truck.We tried several times to contact the family to have them bring the title for the Malibu in so we could give them the title for the DodgeWe called Mr [redacted] and left a message to which we received no response We knew that time was running out for them to get the title within the days but we needed the Malibu title from them, so we were hesitant to just mail it to them We sold the Malibu in mid-December, creating a new deadline for the title so the new owner could have it.The day deadline on the Dodge came up on January 12, We still had no contact from Mrs [redacted] except the messages from December 18, We decided to mail the Dodge title certified mail January 26, with a letter stating that we would get refund the $she had given us for parts on the Malibu when they gave us the titleWe explained that we could not reverse any deals and that AS IS forms had been explained and signed at the time of the trade We included a copy of the AS IS contract signed by Brayden Sosa on November 28, A copy of the signed AS IS form is attached with this correspondenceWe also explained that we had sold their Malibu and needed to get the new owner the title so she can license her vehicle We also explained that we did not want to have to take legal action to get the title from her, which was looking to be our only recourse The letter is scheduled to arrive on January 28, 2015.We’ve made calls to the county to see if we could get a duplicate title for the Malibu so we could conclude our business in a timely manner They informed us that our only alternative was to file a lawsuit against Mrs [redacted] to get the title.As of January 27, 2015, the new owner of the Malibu’s temporary tags expired According to the county and WYDOT, we cannot issue her an extension, but if she comes in and pays her sales tax on the vehicle, they will issue her an extension They informed us that once the taxes are paid by the new owner of the Malibu, then they will take action to get the original title from Mrs [redacted] .We are a new, small business trying to compete in the marketplace We’re trying to get our names out in Cheyenne as HONEST car dealers We strive to sell good, solid vehicles for reasonable prices and give great customer service in the process If Mrs [redacted] had contacted us regarding anything about the cars being unsafe, or the title problem, we would have gone out of our way to fix the problem Instead she instantly threatened lawsuits and has been very difficult to work with If she would have given us a chance to fix the title and whatever was apparently wrong with the vehicles, we would not be trying to resolve this with youThis situation has been an unpleasant experience when all we were trying to do was help out someone who was referred to us by a friend.If you have further questions regarding
