Thank you for this opportunity to respond to Mrs*** issuesFirst, we must note that her estimate and installation occurred during a variety of construction activities on her property, which are on-going. At the time our salesman *** met with Mrs*** this was pointed out and
she asked him to install the fencing higher off the ground than so that another contractor could re-grade her property, filling in the area around the fenceThat request is noted on her contract.On 9/21/17, day one of her two day installation, our crew met with Mrs*** and her landscaping contractor and was again asked to keep the fence far enough off the ground to allow for re-grading.On 09/22/17, the second day of installation, she called *** at 9:am, before the crew arrived, and told him that the fence needed to be higherShe also met with the crew when they arrived and showed them how high she needed the bottom rail from the groundOur crew followed her directions.Mrs*** was happy with the work and paid the balance on her contract after completion and her inspectionHowever, since that time, she has been calling us insisting that we again move the fence, now set in concreteWe are more than happy to correct issues with fence placement for Mrs***However, this should not be attempted until the grading and other ongoing construction activities are complete

Once the construction is completed it will not be possible to adjust the fence in the areas that need to be adjusted.  We are also expecting rain on Sun, Mon and Tuesday once it has rained the dry concrete will harden and will not allow adjustments.  The missing caps have also not been addressed.

This firm represents Triple K Fence, Inc.
("Triple K Fence") and I have reviewed your letter dated February 24,
2017 along with the customer complaint filed by [redacted] ("Ms.
[redacted]") in the above-referenced case. As indicated in the customer
complaint, Triple K Fence was hired by...

and contracted with [redacted] to
build a fence at [redacted] (the
"Property"). The Property is owned by [redacted], and Mr. [redacted] was a tenant at the Property. As stated in the
complaint, the tenant submitted an . application for a permit to install the
fence, the application was denied, and the tenant was aware that a permit was
not issued to install the fence at issue. It is the responsibility of the owner
or applicant to secure a permit to construct a fence in the City of
Fredericksburg, and Triple K Fence had no way of knowing that the tenant chose
to proceed without a permit. Ultimately, it is the responsibility of the
homeowner to comply with the Development Ordinance of the City of
Fredericksburg, and this is an issue between the homeowners and their tenant.
While it is true that Triple K Fence applies for permits and assists homeowners
obtain permits to construct fences, it did not do so in this particular
instance because the tenant indicated that he had it covered. Triple K Fence
constructed the fence exactly as it was called for in the contract and denies
any breach of contract or wrongdoing whatsoever. Triple K Fence has no
statutory or contractual duty or obligation to obtain a fence permit, and it
had no way of knowing whether or not such a permit was issued to the tenant
applicant in this instance. It is also worth noting that the person who filed
this claim with the Revdex.com ("Revdex.com") was not even the
customer of Triple K Fence. It appears Ms. [redacted] is attempting to exert pressure
on Triple K Fence to obtain relief (free work) she is not entitled to under the
law by submitting complaints to the Revdex.com that could damage Triple K Fence's
reputation and status within the community. For these reasons, Triple K Fence's
reliability report and status with the Revdex.com should not be affected by this
matter, and we request that the complaint filed by Ms. [redacted] be dismissed
and closed. Please contact me if you have any questions or concerns. I would
appreciate notification when this matter is closed and/or when Revdex.com makes a
determination as to how it will treat this complaint. Finally, Ms. [redacted] and
Mr. [redacted] have made numerous and repeated calls to Triple K Fence in an effort
to achieve their objectives by harassment and intimidation. By copy of this
letter to them, they are directed to cease and desist all contact with
representatives of Triple K Fence. If they want to take any further action on
this matter, they may do so in a court of law where we will vigorously defend
the position of Triple K Fence. With kind regards,

We do not accept the offer submitted by [redacted], Attorneys at Law representing Triple K Fence. The
original response from Triple K Fence, via their law firm stated, “It appears
Ms. [redacted] is attempting to exert pressure on Triple K Fence to obtain relief
(free work) she is not entitle to under the law by submitting complaints to the
Revdex.com that could damage Triple K Fence’s reputation and status within the
community. For these reasons, Triple K Fence’s reliability report and status
with the Revdex.com should not be affected by this matter, and we request that the
complaint filed by Ms. [redacted] be dismissed and closed.” The response went on
to say that I and my husband were trying to achieve the objectives of harassing
and intimidating Triple K Fence by calling and we are directed to cease and
desist all contact with representatives of Triple K Fence. Also if we want to
take the matter any further, we may do so in a court of law where the law firm,
writing the response on behalf of Triple K Fence, will vigorously defend the
position of Triple K Fence.
  
Given the response from Triple K Fence, Inc. (via their
law firm) we realized that we had to seek other options to resolve the location
of the fence on our property that was improperly installed by Triple K Fence
and we were given a deadline to move the location of the fence within code (off
the drain easement) by the [redacted]. Therefore, we sought the assistance of another
provider to properly and professionally handle the situation. Furthermore,
after reading the first response by Triple K Fence (via the letter mailed and
emailed to us by the law firm representing Triple K Fence), we no longer had
confidence in this firm because in addition to the fence being improperly
installed, and the manner in which we were treated as well as the negative
comments in the letter regarding our character; it was clearly stated that
Triple K Fence had no intention of resolving the matter; therefore, we had no
other option but to seek services elsewhere.

Below is the written text of the response attached submitted:The response received from Triple K Fence, Inc. is not an acceptable response to our complaint and offers no resolution to the fence that Triple K Fence, Inc. improperly installed without an approved permit on our property in Fredericksburg, Virginia. The following reasons are detailed below.-          The response from Triple K Fence, Inc. states that they had no way of knowing an approved permit was not obtained, which is required for installation in Fredericksburg. As the hired contractor Triple K Fence, Inc. knew that they did not obtain the permit for the fence installation, so they should have requested (from the tenant that hired their firm) to see the approved permit by the [redacted].  The permit indicates where the fence is to be installed. If this step had been completed the fence would not have been improperly installed by Triple K Fence, Inc. and would not have been installed out of code (over the storm drain easement) in the [redacted]. -          Triple K Fence, Inc. submitted a quote document to our property manager to repair the installation. Even though the quote document was confusing and scratched out in several areas, the document stated a quote of $[redacted].00, fee. The document states Repair, for the owner to mark exact location, and the line “Permit” on the document has the field HOA written-in, which is incorrect.  In addition the word “Repair”, as written on the document, indicates the initial installation is in need of correcting. Before signing any documents and paying any money for repair work to be completed, either my husband or our designee (property manager) would need to ask questions of the contractor.  When we contacted Triple K Fence, they would not even discuss nor try to come to a reasonable resolution.  They just kept hanging up on us.  And my husband never talked with them.  When he attempted to contact them they put him on hold and after 10 minutes of holding on, someone came to the phone and hung it up. They had no knowledge that he was the one calling. That was very rude and unprofessional. -          The Department of Professional and Occupational Regulation-Virginia Board of Contractors provides a handbook to consumers regarding what you should know when hiring a contractor. On page 8 of the handbook, the handbook explains that your contractor should obtain any necessary building permits. On page 9 of the document in the “A Word of Warning” section states: “Anyone who tries to talk you into getting your own building permit is not doing you any favors. Licensed contractors should obtain all building permits, not the consumer. The permit holder becomes the general contractor and assumes responsibility for the overall job – which may include taxes, workers compensation, and other legal liabilities. Unless you are very experienced in construction, it is best to leave the matters to your licensed contractor – and insist the contractor obtains all necessary building permits.” -          A Triple K Fence representative stated to me that as a courtesy to some customers they obtain the permit. Triple K Fence, Inc. did not provide the courtesy of obtaining the permit for our former tenant that hired their firm. Triple K Fence, Inc. did not ask to see the required permit before beginning installation of the fence.  A Triple K Fence, Inc. representative stated to our property manager that they do obtain the permit for work to be done. The [redacted] (Community Planning and Building Department) explained that Triple K Fence, Inc. does obtain permits all the time to install fences. Triple K Fence, Inc. maintains a license with the Department of Professional and Occupational Regulation – Virginia Board of Contractors (License #[redacted], Class A, May 21, 1998 – May 31, 2018). As a licensed professional for several years, I am surprised that Triple K Fence, Inc. would refuse to “Repair” the fence that was improperly installed by their firm and as a long standing business in the Fredericksburg community I would think that they would want their best and accurate work reflected in every project to demonstrate professional integrity. -          Therefore, we want Triple K Fence, Inc. to repair and re-install the section of the fence that is out of code compliance with the [redacted] and to install the fence in accordance with an approved permit with the [redacted].  The corrections must be completed no later than 30 March 2017, in accordance with the extension granted by the [redacted] and this case must not be closed until we the customer are completely satisfied. Failure to take responsibilities for their actions should reflect a negative rating against Triple K Fence, Inc.Please let me know if there is any issue with the submitted attached document. Regards,
