October 22, 2014Dear [redacted] ***, I am writing in regards to the response to my complaint against Triton LandscapingIn the response, MrD [redacted] states the nowhere on my estimate does it state that there is a warranty for the plants | purchasedI would also suggest that nowhere on the estimate does it state where or how the plants would be planted—it was an understanding that the supplied plants would be delivered and installed as wellWe came to a verbal agreement the day of delivery (April 25th, 2014) as to where the plants should be placed around my new pool (as location was not in the estimate either) and it is during this discussion with MrD [redacted] that I asked about any warranty he provides on the plants and his response was that it would be a “standard 1-year warranty"in regards to MrD [redacted] 's response regarding the care I was providing to the plants, I would like it noted that at no time did MrD [redacted] dig up the dead plants and replace them with new onesIn fact, he simply had one of his workers drop off replacement plants that were smaller than the original plants and I was responsible for planting them – which I paid my local lawn care provider to do at an additional cost to meMrD [redacted] states that he noticed during the replacement that the dead plants weren't being watered properly, but this is not the case at allI am enclosing copies of email correspondence between us where upon seeing pictures of the dead plants, he stated, “Please soak them 3X per week" - in other words, he believed the plants weren't receiving enough waterWhen my lawn care worker replaced the plants, he noticed the plants were very wet at which point I notified MrD [redacted] and his response was, “If that is the case, the shrubs are dieing (sic) from too much water and you should back-off on the watering.” This is in direct contradiction to his prior email telling me to water them morein the enclosed email exchange, MrD [redacted] and I also discussed the warranty for the plants and at no time did he state that he does not offer any such warrantyIn fact, he directly states that he will drop off new plantsAs you can see from the emails, MrD [redacted] seemed very willing to work with me on the plants and it was not until July 4" (email enclosed) when I told MrD [redacted] that I was unhappy with the service I was receiving and that if I did not get a satisfactory response I would report him to the Revdex.com that he stopped responding to my emails other than to say he would take “statements and defamation seriously"He states that he is not responsible for my soil, but he knew exactly what my soil was like the day of the planting since he was on-site and I paid for $of screened topsoil to supplement the existing soil per my estimate.Thank you for your assistance in this matter

October 17, Dear *** ***:After receiving your letter dated October 7, 2014, I have reviewed our estimate to *** ***, #***Nowhere on the estimate (copy enclosed) is there a mention of a warranty, as plants are
living things and after they leave my company's possession, I have no control over their careI offered to and did replace a few plants in good faith, but at the same time noticed they weren't being watered properly, and instructed him on how to better care for the plants.I do not feel I am responsible for his negligence.Thank you for your time.Sincerely,John D
