Upon receiving the complaint, our Director of Accounting attempted to call the former resident and confirm their address on file, since the address on the original check matched the address provided in the complaintOn 12/10/a replacement check was cut
for the full $350, as requested by R***Since we did not receive a response to our phone call, the new check was sent to the address included in the complaintAt this point in time, Tropicana Gardens has refunded R***'s full deposit in a sign of good faith that the lack of response was due to miscommunication in our office and not done in bad faithThank you,

Review: On September 24, 2015, I moved out of Tropicana Gardens Student Housing. The contract states that our $350 security deposit would be refunded within 20 days less a $50 cleaning fee. However, the apartment was not clean when I moved in. My mother and I had to clean the apartment as it had not been cleaned prior to us moving in. Floors were dirty, bathroom was dirty, etc. I had obviously not been cleaned prior to move-in.
Under California law, 21 calendar days or less after you move, your landlord must either:
Send you a full refund of your security deposit, or
Mail or personally deliver to you an itemized statement that lists the amounts of any deductions from your security deposit and the reasons for the deductions, together with a refund of any amounts not deducted. Tropicana has done neither of these.
After 6 weeks, I did not receive the refund, so I called and was told that they would leave the accounting department a message. After still not receiving the refund or a phone call, I phoned them again 2 weeks later and the dept. was closed, so I left a voicemail message that it was urgent that someone get back to me as I have been waiting for my my refund since the beginning of October, 2015. Again, I received no contact from them. As of today, December 9th, 2015, they have still failed to contact me, provide an itemized statement, or refund my security deposit.Desired Settlement: I would like to be refunded the full $350 security deposit. I would like for them to waive the cleaning fee since the apartment was dirty when I moved in, and since they have acted in 'bad faith" and failed to operate within California law in regard to properly refunding my security deposit or providing the itemized statement.
