Tru Construction received this job lead based off of a referral from the homeowner’s friend. I was made aware that a Columbia, MO contractor had already abandoned the project and the clients needed someone to come and complete the work. This project began on 10/18/17 and was nearing our contract...

completion around 10/30/17.  After 2 attempts by us to contact and meet with the clients so that we could get their “punch list”, we were able to reach them and agree on 11/2/17 as an evening to meet.  At this point, Tru Construction is owed $850 for extra work completed, as well as the final $1000 of our $8,925 contract. For a total of $1850 owed. The punch list that they had waiting for us on 11/2/17 was completely surprising to me. Most of the requests were pretty outlandish; adding work to be done outside of our contract, saying the most expensive items on the contract were wrong after the clients had seen and approved them and not acknowledging our extra cost for work completed.  As I interjected that we had come to completion and there were many things on their list that were not in our contract, the client became upset and I was asked to leave. We have corresponded back and forth for 6 weeks. I have attempted to come and finish any touchup, as well as reimburse and discount monies owed. The situation just becomes more and more odd & confusing.  I feel that this complaint is an attempt to avoid payments due with unsubstantiated claims and unachievable requests. We have taken many before and after pictures that can validate the work was completed well.  I am only allowed by Revdex.com’s system to attach 4 pictures, but you’re able to see that in both sets, that the work had been completed. We also have many emails and text messages that show we have followed the client’s instructions and that the work was done as requested. The vanity was approved by the wife before installation and on 10/30/17 she asked for additional work to be done by telling us (after the vanity was installed) that she wanted a new faucet as well.  There was no issues or complaints about the vanity brought up. We had 2 trailers on-site. 1 for our tools and work area, 1 for trash removal. Our crews were instructed to load the trash and remove it on the trailer, which was done. Near project completion (10/27/17) we had a couple of small pieces of drywall in the tool trailer that was being loaded into a truck, the client told a crew member “if its just a few scrap pieces, throw those in the dumpster”.  We were fully able to take the scrap and also had multiple trucks at the jobsite on any work day. Our work area was clean when we left the site.  Floor protection was brought and available on first day of job, however client informed us that flooring protection was not necessary as new flooring was being installed. Only for the clients to later reference that it wasn’t put down. I have attached pictures of the flooring that was installed.  1/16th” gaps are not visible in the pictures; however, it may have occurred with a weather change as this was a “floating” floor system and flooring has been known to expand/contract. The flooring was installed correctly. The client was shown the flooring before installation and gave approval to be installed. After installation, it was referenced that it was done incorrectly as it did not have an underlayment. I had explained to the client’s that underlayment is not necessary with this type of flooring. Drywall was fully completed and finished in a professional manner. Photos are attached. Water shut offs were still functioning properly and the client was advised. Tru Construction was instructed to use that savings towards fixing a large hole in the toilet/shower area. The clients home is a 4-piece two story modular home. At a pre-start meeting in the client’s home, I was told by the clients that they had sued the contractor in 2004 who had put the modular home together for not building the home correctly. Upon visual inspections it was very clear the home had a multitude of issues. The upper sections of the modular home were shifting and breaking drywall, HVAC Returns and vents were not sealed or installed correctly, the main breaker box was very loose and not installed correctly, and wiring was installed in large bunches throughout several receptacles. As the project was going, we figured out several issues with the wiring and made the client aware. On 11/10/17 I notified the clients that a wireless doorbell could be installed to circumvent that wiring issue. All other electrical items were completed. Painting was completed and touch ups were offered by our company. The section painted was matched to the remainder of the walls. Weeks later, the client indicated in an email that they were not happy with the paint color and would like to have it entirely repainted despite our contract explaining the color would be as close a match possible and may not be identical. During the course of the project, Tru Construction completed several small items which were not billed for. Tru Construction has made best attempts to satisfy the clients. Based off of monies owed being a breach of our contract and the clients asking us to leave the property, as well as multiple attempts to resolve issues only to be met with dissatisfaction, I feel very uncomfortable with my crew or myself returning to the rural home site at this point. I have already offered to reduce the total owed to which the clients did not take. So, in another honest effort to resolve this issue, we will waive 100% of the extra costs incurred that are due (-$850), as well as 75% of the final payment due per our contract (-$750).  For a total of $250 due (saving the client +$1,600). This does not mean that we are admitting to any breaches of contract, it is only an offer to allow both parties to go separate ways with compensation. If home owner accepts these terms, we only ask for the Revdex.com Complaint to be withdrawn/resolved Tru Construction has not made any threats to sue, but homeowner was made aware with a 14-day notice that with monies owed, it could go to collections. Tru Construction has had no complaints to date and would like to fully rectify this matter. We are disappointed that the project had to come to this, but we hope that the savings offered will allow the clients to feel compensated. Best Regards

Tru Construction has no compulsion to fall into a “back and forth” with clients who are dishonest and fraudulent. We have been corresponding with the clients for roughly 6 weeks before Revdex.com was contacted, and have tried multiply times to finalize our dealings with the client. Our position is that the offer to save the clients $1600 was VERY generous and was offered only to be finished with this client and his taradiddle. For the client to turn down our offer was foolish as the work in our contract WAS done, and we find the whole ordeal with them unfounded and bizarre. Our work has been left in many homes and businesses throughout our community and for nearly 8 years we have had zero complaints, which is why we carry an A+ rating with the Revdex.com.  We also continue to have great standings with all of our past clients and have confidence that our company will continue to thrive and be successful long after these ridiculous allegations are forgotten. We would be more than happy to present our photographic evidence, along with communications and our contract to defend our company against these completely absurd and false accusations. We believe that clients have been threatening us with legal action and complaints to the Revdex.com, to try and force us to fix things that are wrong with the modular home from the original builder, or get the work we did for nothing. We hold that the clients have breached our contract and that based on the extent of the client’s falsehoods; we have no other obligation to continue negotiations or work for the clients. We have FULL confidence that if the clients continue this charade, the truth will prevail and that any dishonesty will expose itself. We have nothing further to add. Thank you for your time in this matter
