We signed for plan early January. When discussing the plan, we were given details of what the plan included. We took the top plan because it appeared to cover everything like unlimited PT access (not 1 on 1 PT training, just unlimited access for general operation and safe usage), a nutritional dietary plan to get us going and regular assessments for progress. This what the rep said to us and sold to us. I also asked about cancellation and downgrade options as we were undecided on what plan to take. We were told (and what we signed up for) was that we could take the top plan and if it didnt suit us, we could downgrade.

Access to PT was an outright lie. We get no access for general operation and safe usage and the ONLY access to a PT is by a separate PT contract.

the dietary plan was also a lie, that doesnt even exist in the gym.

I tried to downgrade, I was told that I was tied into a contract and I would be charged $100 to downgrade (not was I was told)

The gym closed for 2 months during the pandemic, I was still charged even though I could not even access the gym.

Now, the gym cannot guarantee good health measures in lieu of the Virus spread and I asked to cancel to which I was again told that I am tied into a contract.

1. They are in breach of contract by product misinformation by sale
2. They are in breach of contract by failing to provide a clean sanitized environment risk reduced environment
3. They are in breach of contract by not allowing the cancellation even though it was part of the original agreement with the gym rep.
4. they are in breach of contract by charging for services they couldnt provide while in state wide shut down for May & jun*

The recent Virus pandemic is a serious matter and even upon visiting to cancel, it was visually clear that social distancing is not being followed and regular sanitation of equipment is not carried out.

*Jun - the gym was open but extremely limited without child access (part of the agreement)

So when I signed up for gym membership they offered me training sessions to which they said try it out, the least amount of days you have to do is a month, then you can cancel at anytime. Little did I know they were lying to my face. So fast forward to a month, I wasn't satisfied with the classes as the trainer slacking off. Changing the dates and times on my appointments. I let them know a week before my month was up that I would like to cancel the training sessions to which the "manager" replied "I'll go ahead and talk to my manager". Few days went by and I went back for an update, he said he hadn't gotten a response from his manager because apparently he was on vacations. I had already told him I couldn't get charged on the *** they had on file. He replied "I guarantee you won't get charged". Two weeks went by and I see the charge on my *** for the training sessions. I was furious as I said I'd like to cancel and had no use of the service nor satisfied with it. So I asked to talk to the another manager, and all he says is that training sessions are mandatory due to them being under contract. I was blindsided. They said I could cancel after one month and neither told me it was a contract. Now I'm stuck with something that I won't be using at all and being charged a hefty amount by these shady people. After I voiced my displeasure multiple times they basically threw me under the bus saying it was my fault and basically saying I have to break a leg and get a state doctors notice that I can't continue going to the gym, or that I have to go live somewhere else, pay rent and bring the bill to them so they can put I relocated, or my last option, to pay half of what I owe they call it buyout. These people are not competent enough to do business nor communicate correctly with customers. I am not the first one this happens to. This should get investigated because they are using shady business practices. There is several reviews online of them using these same business practices.
