Fraud in the inducement, failure to explain consumer is agreeing to a 12 month contract, running debit card AFTER cancellation and without permission
TruFit staff do NOT inform consumers that they are entering into a one year contract, diverts attention by emphasizing the possibility to cancel with certain notice.Worse, there is a 3 day provision to cancel if the consumer changes their mind after signing a "contract" - I went in TruFit in person 03/05/20 the following day after apparently signing a "contract", and explained that I was roped into this with false information and inadequate information or disclosure, did not want any contract, and they agreed to cancel my contract and account and even handed me my $239 check back, saying it would all be voided. The next day 03/06/20 THEY RAN MY OLD DEBIT CARD FOR $239 WITHOUT MY SIGNATURE, CONSENT, OR PERMISSION! In fact, it was an older debit card that had been replace they apparently had on file (?) from past. This can not be legal, I want the AG of NC to look into these practices and find similarly situated consumers.

Desired Outcome

1) I would like a corporate executive to contact me and explain these shady business practices, 2) I want an immediate refund of my unauthorized debit card charge, 3) I require a letter stating that I am released and not bound to any contract or further charges with them, 3) I want my debit card and bank info purged from their system so that they can no longer make unauthorized charges, 4) I want assurance from this corporate executive that the company will address these illegitimate and shady business practices so that others do not fall victim as I did

Ms. joined with a credit card for her monthly draft on 11/18/19, she purchased personal training on 03/04 with her checking account that is the only way we could have her checking info. She 3 day canceled her training on 03/06 and the refund task was set up for the money to be returned to her checking account, which could take up to 7 business days to process. We did not run a debit card we processed an actual check thru our billing company.

CONSUMERS BEWARE OF TRUFIT! Once again this company is misleading. I was told $20 per 45 min session 2x per week, and turns out to be 30 min session and $25 each. Personal check was being held 2 days until I brought in the debit car from account I was planning on using for payment, they didn't care and got the numbers off the bottom of my check and processed payment. I was later told account was cancelled, and then AFTER it was cancelled is when they swiped money from the wrong account. Gross misrepresentations were made, I was duped into a 12 month contract, I was not given a copy of anything I signed, and the company doesn't respond to calls or emails, including to the 2 owners/partners. If this was the last place on earth to train, you should self-train at home! BEWARE !!!!!!!

I am sorry she feels she wasn't treated fairly, we followed all procedures and when she requested a 3 day cancel it was processed per the terms of agreement. I show she rec'd an emailed copy of her training agreement on 03/05.

TruFit gym does not uphold their contracts that you sign and are unwilling to resolve issues that are in fact TruFit's mistakes.

My name was *** (***) *** at the time I signed the contract.

In December 2016 I signed a contract between myself and TruFit gym for a one year membership (at that time they were called Gold'sGym). This membership contract includes an $18.99 annual fee and a $25.99/month fee. There is a question on the contract that asks if you wish to renew your membership automatically? I selected the box that said "No". Based on this contract, my membership and all fees associated with the membership should have been canceled on December of 2017. I did not request to renew my membership and I never resigned a new contract with TruFit as I was under the impression that my contract had ended December of 2017. TruFit gym continuously charged me $25.99/ month from January 2018 until June 2019 through automatic draft payments from my *** checking account!!! They have also charged me an annual fee of $18.99 on 1/2/19 and $18.99 on 1/2/18 which were also automatically drafted from my *** checking account. From January 2018 until June 2019 I have mistakenly been charged $467.82 + annual fees of $37.98 for a grand total of: $505.80! I have corresponded with *** (the third party billing company) as well as the ***, NC location of TruFit gym. They have stated that they have now canceled my gym membership and are only willing to refund me $25.99 for June 2019. They have also stated that I used the gym after my contract was 'ended' and therefore I was not entitled to any refund despite what my contract states. I inquired on what dates that I used the gym because I do not recall this- they did not respond to my request. No where on my contract does it state that if you come back into the gym after your contract is up, that it will automatically be renewed. It clearly states on my contract that I do not want to auto-renew and my contract should end on December 2017! I am very frustrated how TruFit and *** has handled my case. All I am asking for is what my contract clearly states! I would like refunded the mistakenly charged $505.80. TruFit has stated that now (June 2019) my gym membership is canceled;however, I would also like this confirmed as I feel I can no longer trust this business or their handling of my billing.

Refund of $505.80 This includes being mistakenly charged $25.99/month from January 2018 until June 2019 ($467.82). This also includes being mistakenly charged $18.99 for an annual fee on January 2018 and $18.99 on January 2019 (total annual fees: $37.98). $37.98 + $467.82 = $505.80 I would also like TruFit gym to confirm that my gym membership is actually canceled per my request as of June 2019 and that I will never be charged from their business again. Thank you

Prior to this Revdex.com complaint, TruFit only agreed to refund the month of June 2019 for a total of $25.99. So now they are agreeing to refund 2 months (May and June) for a total of $51.98. It clearly states on my contract that my membership ended on December 2017 and that I opted out of automatically renewing my contract. There is not a new contract on file and I never agreed to renew my contract after December 2017. So, I should be refunded January 2018-June 2019 including two annual fees ($18.99 each) totaling $37.98. The grand total I am due back based on my contract is $505.80.

?A gym membership contract, like most other agreements, may be void and unenforceable. I was induced to sign it by willfully false or misleading information, representation, or advertising by the gym. feel that I have been subject to aggressive and possibly illegal sales tactics. Member signed a month to month membership requiring a 30 day notice to cancel she had 3 days to cancel agreement after signing to cancel with no penalties or notice. Member gave 30 day notice and last billing will be 11/21/2018 as per her signed agreement. I can provide the signed membership agreement if needed.

Tried to cancel membership with military orders put us no where near a true fit gym, faxes in orders and they swear they never record them.
When I set up the account, things seemed odd, months later the gentleman who set my account up was terminated for setting up false accounts, I started trying then to get my account corrected. Since then I've had tons of billing problems but the gym always set them straight. We got military orders so I had the gym fax in a copy of the orders, they told me everything was done and canceled. They never faxed in my orders, just simply canceled my auto draft for payment, and then I get a bill in the mail. I called *** (the headquarters for true fit) they said I've never had an account with them and that it must've been canceled correctly. Now I'm getting debt collectors calling me and*** or true fit won't talk to me to clear it up. They lied from the start to get me to sign up, now I find out there was 2 other people added to my account which never had my permission to do so!

I would like for them to fix this problem, have account canceled correctly and stop having the debt collectors call me. Also fix any reports to credit

I have no documentation that member has ever requested a cancellation or sent the required documents to do so, and the billing company has made multiple attempts to contact. With that said we always try to work with our military and have canceled the agreement in good standing nothing further due. If you need a copy of agreement one can be sent.

The business said everything has been canceled in good standing but I'm still sent to a collection agency, I also never got a call from anyone before the collection agency, or it would've been taken care of long before being reported on my credit.

We have never received documentation of any kind to cancel but would be willing to consider is she does provide approved documents and back dating to date of proof, *** is in system as *** not*** which is why she could no be found. Attached is her contract for her billing

I upgraded my membership and it was never disclosed to me that there was a one time $35 fee upon upgrading from my current membership.
I upgraded my membership and it was never disclosed to me that there was a one time $35 fee upon upgrading from my current membership which I had already been paying for. I was told it was an extra $5 a month and never told about an extra hidden fee.

Desired Outcome

Refund in full of my $35 or it counted towards my monthly fee.

The representative that upgraded him to 24/7 access was clear in the cost of the down payment. I spoke with the member personally and he understands there was a misunderstanding. I offered him the ability to revert his membership type back to the original membership and be refunded the down payment or leave it as is and chalk it up to a misunderstanding on his part. He decided to leave it upgraded with the knowledge he won't receive a refund. I offered him a free smoothie as a gesture of good will.

I signed up with Golds Gym of *** NC and paying IN FULL CASH for full membership.I was also paid to have a personal trainer and signed up for a specific number of sessions.I was told that I had to have a CC# on file even though I was paying for it all up front for this two year membership.I have enjoyed my membership with Golds Gym but not who they have chosen to do business with or for them.*** is obviously making thousands of dollars off clients of Golds Gym. Not just in NC but across the U.S. They claim charges of a "Contractual Enhancement Fee" the first of every year totaling $49.98 as well as $18.99 every six months for another fee. ONLY if they have your CC# can they actually just TAKE these fees, unannounced and send you scrambling to figure out when and where. Claiming it is in the original contract which is why I suspect they NEED your CC# to charge you for these heinous fees!I have already consulted with GOLDS GYM to not continue doing business with this company. It is the second company in 3 yrs they have had to work with and it affects their customer base without question, which forces them to do business with *** as I am sure they are also in a "CONTRACT" unfortunately for them.

Last year I signed up for a gym membership with Tru Fit Gym, formerly known as Gold's Gym. I signed a one year contract and signed up for a free introductory session with a trainer. The trainer assigned to me was the owners wife. At the end of our session she presented me with trainer package options. At the time I was 4 months pregnant with our fourth child and knew that I would most likely have to have a repeat cesarean. I explained this to her and that I would not be able to enter into anything long term because I would not be able to attend the gym for a few months towards the end of my pregnancy and after my surgery. I also explained to her that financially there was not way I could afford the more costly options. She was also pregnant at the time and acted completely understanding. She told me I could sign up for 10 sessions for $250 and use them at my leisure. She said that this way I could see if I liked utilizing a trainer, get on a good workout program and then decide if I wanted to sign up for more sessions. She had me sign a digital signature pad twice and told me she would email me the contract. I did not think anything of it until my account was billed a second time for $250. When I called and spoke to her she told me that she signed me up for 12 months, 10 sessions a month, for $250 a month on a reoccurring payment plan and I could not cancel. When I told her there had obviously been some sort of misunderstanding she refused to cancel my contract and has subsequently sent me to collection after I stopped the gym from billing my account. Not only was she fully aware that she was fraudulently utilizing my signature but she knew I was a disabled Army veteran and military spouse. Thus far they have successfully collected a second $250 charge from me that I cannot get back and have negatively impacted my credit score. Due to all of this I have also not returned to the gym because I feel so uncomfortable and have forfeited the almost $400 membership I paid for originally.
