happened to me to transpire with / to anyone elseAEY's handling
of this matter, coupled with their actions (or inactions)
after the fact, are
simply outrageous and disgracefulAs noted in my
message to you as well, it was
simply impossible to get this to you in days as I received this
information from you four days after the
date of your letterHence, the reasons for my message left for
you that this matter is far from resolved and
the horror show with
AEY continues as confirmed herein
They are no longer permitted on
our property as I simply do not trust MrYoung and AEY as is my prerogative for
all of the reasons outlined herein and done so beforeAlso, thank you for sending me the recent response information that you did surrounding this
matterAfter reviewing this at length with
my advisors, one can see why we do not trust a thing coming from
AEYLet me help you, for the record, separate
FACT from fictionMrYoung is good at deflecting the true subject matter at hand, mainly why over the last TWELVE MONTHS perplexingly
has he
and AEY have
not finished our workAnd not been able to come back and complete the single most important
aspect of our job - the supposedly simple final topping that
connects the down slope driveway to his inoperable elevated drains previously installed by AEY, what was to permit water to seamlessly drain off our site and not back up onto our property and homeRegrettably, their actions or lack thereof
have resulted in just a dangerous mess on our property, and experts that
have looked at this after the fact are perplexed as to why AEY did not complete the essential part of the jobWater damage to our home and very dangerous water ponding issues have developed due to reckless AEY project mismanagement, where individuals have slipped or worse and fallen as I did, badly injuring myself that required major surgeryAll because MrYoung and AEY decided not to honor their agreement with myselfI am perplexed, as are the various state authorities, with their (AEY)conduct to dateFACT: MrYoung's company, AEY
Enterprises, was contractually obligated to
complete their essential work for me in as I was to shortly return from major surgery and did not wish to have any driveway ice issuesThis is well documentedAs already noted , their work at my site/home was never completed due to Mr.Young and AEY's poor time, and project, managementThus, incredibly the work
noted above to this day TWELVE MONTHS LATER has NEVER been completedAEY has run out of
excuses and my family and I are simply tired of their nonsenseFACT: MrYoung in his correspondence tells you he was to return to complete my work in the Spring of but TWLEVE MONTHS later it REMAINS
INCOMPLETE and AEY drains remain inoperableThus, very dangerous conditions continue at my home site due to AEY incompetence with
winter weather once again approachingFACT: AEY personnel, who I requested to come out to my property to see the water back up issues due to their incomplete, inoperable elevated drains, told me crews would be back first thing in the Spring of to finish things upThis NEVER happenedFACT: BY AEY leaving these elevated drains incomplete and not brought even with black topping, some of their elevated driveway drains can simply be ripped out of the driveway by snow plowing crews as was the case last yearMore damage because of AEY FAILURE to complete their workFACT: When an AEY VP and Engineer came to my property (at my insistence) as just noted to see first-hand my major concerns with icing/water ponding,
elevated drains being ripped out of the ground along with potential damage to my home if not corrected, I was promised that sand/salt crews from AEY would be returning to
my property for the remainder of winter when poor weather commenced to ensure for the safety of my family and guests (due to water ponding and icing
that was transpiring at the inoperable elevated drains)Amazingly this also NEVER took placeFACT: "Black boxes," supposedly AEY
technology that was promised to be used on my property
with winter closing in and AEY getting to my site late, never was even entertained and my questions as
to why have been left unansweredI believe AEY engaged in "bait and switch" advertising by telling me as their delays getting to my home - and concerns - were not necessary as they could use these black boxes to cure any driveway topping done in early winterNEVER used, NEVER explained whyI believe they do not even exist and the
reason why myself, family
and advisors can draw no other conclusion to the contraryThis unethical
tactic (told of black boxes) was simply used by AEY as
a tactic to get me to sign up to have them do my workFACT: MrYoung states our work began
in NovemberWhat he does not tell you is that we discussed AEY beginning their work months and months and months earlier
Phone records and emails support the claim that I
contacted them repeatedly month after
month to note "where are you folks and when are you beginning my work?" The AEY "black box" story was used with me to calm my fears of EXACTLY what I feared happening - and indeed IT DIDThey ran out
of time with winter closing in and seemingly could have cared less as so noted in an amazing follow up email from MrYoung to myself the next yearIncredibly inconsiderate and unprofessionalFACT: MrYoung has noted in his own correspondence sent to me and that was shared with the Attorney General that incredibly we were lucky to even have AEY get to my property
despite their NEVER finishing our work and leaving a very dangerous slippery/icing scenario behind to this day TWELVE MONTHS later.Moreover, he even noted in writing to me long after that he NEVER intended to
complete our workI was sold on the fact that my work was a high priority to AEY and had
to be completed in It was NOTThen in early It was
NOTExcuse after excuse, and the reason he (Young)
noted in writing he did not finis h
my critical work (as I was returning
home from major surgery)
was that he had other larger, better paying jobsThis is why we have asked the New York State Attorney General's
Office and New York State Police to investigate
the actions of AEY and MrYoung beginning several months agoAgain, MrYoung stated in writing
he never intended to finish our work in 2017, to the contrary 100% of what I was promised by their personnel who sold me the jobSimply incredible, and if I had known otherwise, of
course would have used
one of the many other company's
who wished to do our important workFACT: All along, and when AEY noted they were finished with their main work, I was told that the elevated drains installed in our driveway were fully
operational and functioningI may be currently disabled but I am not blindPhoto and video PROOF has been provided to the Attorney General's office as well as the New York State Police completely refuting MrYoung' s TOTALLY INACCURTE contentionsIf he has photos and video proof, as do we, by all
means, please share with us allHe has NONEWe will not be buffaloed any moreIf you
wish to be paid, DO THE WORK, as is required under our agreementFACT: MrYoung has alluded to the fact that he was not
paid anything by me and the reason for his unethically considering a mechanics lienIt doesn't get any more unscrupulous
than thisThat is my opinion and seems to be that of my advisors as
wellIt is PATENTLY
that AEY was not paid anythingHe was paid$27,000, of which I was never obligated to pay until AFTER the project was COMPLETEDHe shoveled that sad story to the AG's office so I provided checks totaling $27,to them to see what I was dealing withThe project remains incomplete to this day TWELVE MONTHS later at the hands of AEYYet he continues to spout off he is unpaidHere is where I made my only mistake, mainly paying MrYoung and AEY before they completed their work as our agreement called for (days after completion) But I
believed they had finished the main work as communicated to me by AEY and thus the reasons
for monies beginning to be paid to them by myselfAs soon as I saw
folks slipping and falling, regrettable also including
myself, on advice from my attorneys all payments to AEY were stopped as we now knew the elevated drainage they had installed was far from complete and absolutely
without question extremely dangerousFACT: MrYoung notes in his response to you that gratification was provided by me to AEYThis is a half-truthI was TOLD by AEY that as noted above the water flooding mitigation drainage
system was complete and now fully operational but regrettably AEY still needed to return to complete the simple black toppingI did thank them believing AEY had completed their work but was I wrongI returned from the hospital to what would soon become a very dangerous icy driveway as water could NOT reach the elevated drainage and drain properly off my drivewayBut what they told me was NOT accurateThe drains were NOT operationalMrYoung and company left us with a dangerous messFACT:
MrYoung noted to you he is no longer permitted on our property to complete his workMrYoung has had the good part of a year to get out and complete our work that he was obliged to completeBecause I am currently disabled, I am not appreciative of his callous disregard for my safety
and that of my family when the work he was to
complete was supposedly "simple work" as we were told by AEYThus, his painfully insensitive
comments of my condition are not appreciated, but more importantly his comments
are not accurate as he has had enough time to complete this supposedly simple
work and now we have had enough and wish to have an unsafe scenario made safe againI have every right to protect the safety of myself and family from actions or lack there of from folks such as AEYMrYoung and AEY have been apprised of
our actions and the reasons why, time and againI cannot care more about MrYoung's business than MrYoung.FACT: In an attempt to have this matter finally amicably resolved, I invited MrYoung to my home to address any differencesInstead of finally giving myself and family a long
awaited final completion date, MrYoung
and his Comptroller, Tammy R., incredibly showed up with a Judgement they asked me to signWhen
reviewed by each and every advisor that I have, including one of my advisors who is a former AstUnited States Attorney, folks could not believe their eyes as AEY would have had access (according to my attorney's) to all of my bank accountsCustomers service, it is fair to say, is not one of hallmark services of AEY and that we have enjoyed although MrYoung would like one to believe thisAnd I have had this matter
carefully reviewed by countless individuals, with all coming to the same "horror show" conclusions as I did at the outset of this letterFACT: I believe that Mr Young continues to engage in highly questionable activity
The first of which is that he continues to share, WITHOUT MY CONSENT, proprietary information with other unauthorized third partiesBut it goes well beyond thisMrYoung has bragged, in his OWN WRITINGS to me, that he has obtained
other highly proprietary third party *** family information from other folks we have done business with over the yearsSo how
did that come aboutSuffice it to say this is the subject, along with other serious
events, of an investigation going on right now by state law enforcementFACT: MrYoung wishes one to believe that
our communications with all law enforcement and investigative groups is because of his current actionsThis is PATENTLY FALSEOur attorneys did not like the handling of this matter with AEY for quite some time and wished MONTHS AGO for myself to alert
authorities of highly suspicious AEY activityWe have done soFACT: Finally, MrYoung notes he has filed a mechanics lien against myselfThis is also the subject of a current investigation because
not only does it not property conform with NYS law ten months later, but he never completed his work as AEY was so obligated to doHe notes as such himself in correspondence to meI believe this constitutes highly questionable activity and have been told directly by law enforcement some of what is going on (some of which I cannot share at this time as directed by my attorneys' & law enforcement) is potentially unlawful activitySo if we follow MrYoung's logic, he feels he doesn't have to complete his work when he is so contractually obligated to do based solely on his poor time and project management; his fall-back position to finish up my urgently needed work in the spring is also not complied with as more and more excuses follow from Young and AEY; he then thinks his company can tell me they have completed my project and the major components of it when this could not be further from the truthAnd he expects to be paid in full after all of his nonsense as
one year later my home project sits INCOMPLETE at the hands of AEYAnd his additional attempts,
along with some of his staff and third parties we have previously fired, to inaccurately and obscenely demonize myself and family is simply patheticWe have received
word he is attempting to obtain as much information about me as possible from any and all third patties as noted hereinWe will keep you informed when he catches up with my kindergarten teacher to hear what she has to say about myselfI don't think soThese AEY actions and others as noted above are under investigation and I cannot further comment on
it beyond this pointI wish I could share more with you about MrYoung
and company's shameful actions but I simply cannotI apologize for any inconvenience this may causeThanks so much for all your helpBut because we waited over a year to have AEY complete their contractually obligated work, in their absence (and leaving our property in such an unsafe condition for so long) they are no longer permitted on our
private property ever again for any reasonLet the buyer bewareThank you again for
