Complaint: [redacted] I am rejecting this response because:I agree with the business that I was told in June that my current tenant was vacating the property in July and I remember telling them back to start the search for a new tenantThey told me that they will start advertising once they are in the day tenant moveout periodI completely disagree that I was told that they will not advertise until the contract was signedBut I think it is my fault that I did not get that in writing and relied on good faith.I always had a cordial relationship with the business during the first contract of and I did not see it mandatory to get everything on paperI ended the contract because I did not find the service to be as good as it was in the earlier yearMy calls to check on the status of the property were not answeredI had to call from different phones to get the business to answer my calls and even when they did, their answers were unsatisfactoryThe only reason for this dispute is that I do not believe the business provided the service they advertiseI'm not disputing the contract but the service provided which was very disappointingI had to pay the mortgage on the property for the month of August in addition to the lease break fee at the apartment I was residingI saw no other option but to move to the property to avoid more financial lossHad their service been on par, I would not have lost more than $5000.I just hope that the $termination fee is returned to me at the earliest Sincerely, [redacted] ***

The complaint filed against our company is completely without meritID ***. We first got the contract for this property in June of and rented it within daysOnce this lease was coming to it end I call (may 2015) and let ** *** know the tenants will be moving out at the
end of JulyIn which they were required to give a day notice to vacateAnd we will be sending him a new contract to re-rent the property to new tenantsI provided ** *** the new contract in the beginning of July He took over a month to return the contract to me on August 1st going back and forth on priceThis was the first day we begin marketing the property, as I told him I would not be marketing for a new tenant without a signed contractOn the 22nd of August he cancel his contract without a day noticeStating he needed to move back into his home. Which the contract states he would have to give us a day noticeAnd the early termination fee of 3 months management fee would be charged as stated in the contract. (contract attached)He gave us a total of days to rent the propertyIn which we show it multiple times and actually receive an application to rent which was approvedThat tenant later decided they did not want to move-inUp on *** *** cancellation we actually return the $he paid for advertisement of the property due to good business practiceWe did charge the termination fee of $which was due to us. And a credit of $was return to ** ***Is account is now at a zero balance with us, and we were within our rights to charge an early termination fee

They told me that they will start advertising once they are in the 30 day tenant moveout period. I completely disagree that I was told that they will not advertise until the contract was signed. But I think it is my fault that I did not get that in writing and relied on good faith.I always had a cordial relationship with the business during the first contract of 2014 and I did not see it mandatory to get everything on paper. I ended the contract because I did not find the service to be as good as it was in the earlier year. My calls to check on the status of the property were not answered. I had to call from different phones to get the business to answer my calls and even when they did, their answers were unsatisfactory. The only reason for this dispute is that I do not believe the business provided the service they advertise. I'm not disputing the contract but the service provided which was very disappointing. I had to pay the mortgage on the property for the month of August in addition to the lease break fee at the apartment I was residing. I saw no other option but to move to the property to avoid more financial loss. Had their service been on par, I would not have lost more than $5000.I just hope that the $390 termination fee is returned to me at the earliest.

The facts are whether we were given 19 days as the contract proves or 48days has [redacted] thought. This contract still states if you canceled within 360 of signing the contract, you will need to give a 30days notice and a 3 month management fee will be charged.there was no notice given and he did canceled within the 360 days of signing the contract.  Page 5. L TERMINATION    1. Agreement may be terminated by either party upon thirty (30) days written notice after one (1) year.  Notwithstanding any provision to the contrary, Agent may terminate this agreement for cause by giving the Owner thirty (30) days written notice.  Upon termination, Owner shall retake possession of the premises, subject to the rights of any tenant rightfully in possession. Owner's proceeds shall be distributed by Agent forty five (45) days after termination, unless outstanding Agent or thirdparty obligations remain, in which case distribution shall be accomplished immediately after the last such obligation is satisfied.   2. In the event that Owner requests early contract termination prior to first year of contract period, there will be an early termination fee in the amount of three (3) months management fees at the current rented amount, or current advertised amount. If within three hundred and sixty (360) days of said termination, Owner leases property to a Resident procured or identified by Agent, Owner must pay Agent a fee of 100% of one month’s rent within 15 days of commencement of lease.         Thanks.
