Review: So my husband received a phone call from the [redacted] va trupoint bank and he was at work. So I called them to see what was going on, she said someone tried to write a check for a thousand dollars but she returned the check so it wouldn't go through. I said okay wow, who wrote the check and what was it wrote for. She went on the say she had no idea, she didn't even wanna give me any information, I am on the account so I didn't understand. And my father in law, which is friends with the woman he talked to called and she said that he couldn't get any information unless we told her they he could, my father in law went on to say that we alouded him to get this information, which we did, but she did not call us to confirm or anything just let him know who wrote the check and what it was for. But wouldn't let me know anything about what is going on. We found out that it was a check that we had wrote to another company so that could put it on hold for two weeks ago which the other company wasn't suppose to cash. Trupoint, after all this, is still make up pay the over draft fee. My husband and I are fed up with them allowing everyone to look at our account and giving me problems with me being on the account. We are canceling our account and moving on to a bank that follows what I thought were policies.Desired Settlement: I want them to wave the 25.00$ overdraft fee them nothing else cause we are done.

Review: I had been a customer with TruPoint Bank since 2000 and had good service up until these past few months. I was a victim of check fraud. And all the checks were bouncing at the bank with a fee of $25 attached to each returned check the thief drained my entire acct. The checks were out of number sequence that I was using the signature was forged and on top of that the checks were being written at merchants I have never used before. There is a police report filed and the thief is in jail for these charges. I had about $800 taken from me including the bounce fees I was charged. The bank made me wait about 2 weeks to get any of that money back and when I finally got it back I only got $400.00. How is this ok? I mean as I stated the number sequence of checks were out of order, the signature was forged as mine and the bank didn't even bother to check the signature to see if it matched and it didn't even alarm them that the checks were being written at merchants I have never used. I work hard for my money and I am the victim here and I need the bank to take ownership of their errors and give me the rest of my money back. Due to all of this I closed my acct with TruPoint and when I told them I was closing it they simply said OK. I was a customer with them for 15 YEARS and this is what I get. Please help me by making them give me money back this is uncalled for!Desired Settlement: The other $400 that I am owed!

In response to the complaint filed by [redacted] on February 14, 2015, ID #[redacted], please reviewcomments noted below.[redacted] filed an Affidavit of Forgery at TruPoint Bank on February 2, 2015, and a police report wasfiled on February 1,2015 for multiple checks presented for payment at TruPoint Bank and [redacted].The individual referred to as the "thief" in the complaint has been identified as a family member living inthe home with Ms. [redacted], at the time each fraudulent incident occurred.Fraudulent checks were presented for payment on the account in question, and were returned for non-sufficientfunds at a fee of $25 per item. Non-sufficient funds fees are reviewed with all consumers atthe time of account opening. In addition, non-sufficient funds notices are mailed to the account holderfor each occurrence, including details of charges and items presented for payment. In addition, non-sufficientfunds charges and items presented for payment are documented on the customer's statementof account provided monthly.Statements of account history are provided to allow customers the opportunity to monitor theiraccounts for fraudulent activity. TruPoint Bank does not assume liability for monitoring account activityfor fraudulent payee or fraudulent signature; the account holder is responsible for monitoring their ownaccount to detect fraudulent activity and promptly notify the bank. According to the UniformCommercial Code 4406, (a), the customer must exercise reasonable promptness in examining thestatement or the items to determine whether any payment was not authorized because of an alterationof on item or because o purported signature by or on behalf of the customer was not authorized. If,based on the statement or items provided, the customer should reasonably have discovered theunauthorized payment; the customer must promptly notify the bank of the relevant facts.In addition, per TruPoint Banks account agreement:You must examine your statement of account with reasonable promptness. If youdiscover (or reasonably should have discovered) any unauthorized signatures or alterations, youmust promptly notify us of the relevant facts. As between you and us, if you fail to do either ofthese duties, you will have to either share the loss with us, or bear the loss entirely yourself(depending on whether we used ordinary core and, if not, whether we substantially contributedto the loss). The loss could be not only with respect to items on the statement but other itemswith unauthorized signatures or alterations by the same wrongdoer.You agree that the time you have to examine your statement and report to us willdepend on the circumstances, but will not, in any circumstance, exceed a total of 30 days fromwhen the statement is first sent or made available to you.You further agree that if you fail to report any unauthorized signatures, alterations,forgeries, or any other errors in your account within 60 days of when we first send or make thestatement available, you cannot assert a claim against us on any items in that statement, and asbetween you and us the loss with be entirely yours. This 60-day limitation is without regard towhether we used ordinary care. The limitation in this paragraph is in addition to that containedin the first paragraph of this section.TruPoint Bank has gone above and beyond what is required to assist Ms. [redacted] with this situation. Allnon-sufficient funds fees were refunded to Ms. [redacted] within six calendar days of the Affidavit, eventhough the reports were filed well after the 60 day required notice. In addition, all items that could bereturned via the Federal Reserve payment system for forgery have been returned and credited back tothe account in question. As of February 11, 2015, TruPoint Bank has refunded $619.77 to Ms. [redacted],largely at the expense of the bank. The items disputed that have not been refunded to Ms. [redacted], wereprocessed more than 60 days prior to the notice of forgery given to TruPoint Bank, and cannot bereturned to the bank of first deposit for forgery.Regards,[redacted]Regional Executive

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.The fact that the thief has been identified as a family member living inmy home means absouletly nothing, he was still not authorized to writechecks on my account. Having said this, he also had access to my mailbox to retrieve any mailing from TruPoint bank. When TruPoint bankseen all this crazv activing why was I not contacted via a telephone?The bank is wanting to assume no resposbiliities for their own neglect.As I stated the signantures did not match so what d¡d I sign a signaturecard for? As well as the check numbers were totally out of thesequence that I was using. I entrusted TruPoint to protect my moneywhile it was in their care as [redacted] did. Obsiviously they areunable to do so and come up with evey excuse as to why they aren'rresponsible. TruPoint feels they can do this to people because wedon't have lawyers working for us as the bank does. This is not ok.TruPoint is making money on bounce fees because I was a victim offraud. I won't be satisfied until ALL of my money has been returned.I am the victim! And if TruPoint refuses to give it all back I really hopethat the Revdex.com can step in and take action on my behalf.Sincerely,[redacted]
