Review: I have recently taken a training course at the above mentioned school for the renewal of a construction managers license..After taking the course at my expense I have found out that they gave me the wrong course.They now want me to take the correct course at a 50% reduction in cost to me. This is beyond unfair, they made the mistake and now they want me to pay again!Desired Settlement: Allow me to take the correct course at no further cost to me..

TSC Training Academy (TSCTA) would like to first thank you and express our appreciation for the opportunity that has been given to us to submit a response to the consumer complaint that was placed by [redacted], ID# [redacted].

[redacted] attended a 7 HR Site Safety Manager Refresher Course (SSM Ref) with TSCTA on July *, 2013. Our database is set up such that individuals can register themselves online through our website or by submitting a registration form that is input and processed by one of our representatives. Review of [redacted]’s account reveals that he (or another entity other than a TSCTA staff member) registered online on June **, 2013 from computer with IP address [redacted]. Thus, no member of TSCTA staff directly registered him for the event he claims we incorrectly advised him to attend.

Further, [redacted] contends that it was a TSCTA staff member who informed him of the need to take the SSM Ref course prior to him registering online however he has no recollection of the name of the staff member he spoke to nor the date of that communication. However, TSCTA’s database has the means to record notes in Client accounts and all staff are instructed to record any communication with Clients’ yet none exist in [redacted]’s account prior to his call to our offices on Monday, July **, 2013. On said date [redacted] contacted TSCTA to complain that the NYC Department of Buildings (DOB) rejected his SSM Ref course certificate.

Further review of [redacted]’s account revealed that he was previously registered by Calcedo Construction Corporation to attend a SSM Ref course in November 2012. Upon receipt of the registration request for that event, TSCTA staff reviewed his CS registration status and noted that it was expired in excess of one year, which rendered him ineligible for participation in the SSM Ref course. Contact was made with Calcedo Construction Corp. and, based on the publicly accessible references provided by the DOB, discussion took place as to what the appropriate steps would be to start the registration process anew including the proper course to take to comply with the DOB requirements. Please note that TSCTA took these steps of their own accord as DOB approved providers are not required to screen participants eligibility to attend the training. However our organization always strives to provide accurate assistance to our Clients even if it is not required.

After reviewing the DOB requirements, at the Caledo Construction Corps request, [redacted] was registered for the correct course, that being the 8 HR SSM for Professionals and Experienced Managers (8 HR SSM) that was scheduled for December **, 2012. Our records reflect that he did not attend this course and no request was subsequently received from him or the organization to reschedule him until such time as [redacted] registered himself online on June **, 2013.

[redacted] contacted TSCTA’s offices on Monday, July **, 2013 stating that when he presented the DOB his certificate of completion for the SSM Ref course it was rejected. However it is more accurate that they rejected his request to RENEW his Construction Superintendent (CS) registration given that it had been expired in excess of a year. Thus, [redacted] needed the 8 HR SSM course and not the SSM Ref course solely because of the amount of time his registration had lapsed, information that could not have been provided to TSCTA for a registration they did not directly process given that he registered himself online.

Despite TSCTA’s lack of direct responsibility for [redacted]’s registration and participation in the wrong training course TSCTA extended a generous discount towards the 8 HR SSM course, which we do not frequently offer, to try to provide some accommodations and/or relief in this unfortunate situation. [redacted] has declined to accept this offer. We have tried our best to assist [redacted] and hope he finds a resolution.
